in my case which is going on from last 8 years(its a civil property case) :-
total parties :- 4
out of 4 , 3 parties are ready for settlement But 1 has sticked and is not ready for settlement .
3 are ready for case withdrawl .
so the 1 which is not ready , he will continue with the ongoing case or he has to file a new one??? (●he is not main plaintiff)
sir plaintive ne suit withraw karne ka pection dala h to isko kharij kiya ja sakta h
kyoki cese 1/10 ka h ab jagment ke samay withdraw arna chata h
hm defedent h
Sir 1a clear Nhi ho raha h defendant khud plaintiff Kese ban sakta h????

Sir i had filed a property suit during 2012. Then the opponent came to compromising. As per compromise i had withdrawn the suit and the court cancelled the case during 2013. Thereafter he suddenly cheated me. Now can i again file the same case.

If there are 2 plaintiffs who has filed the property suit court case
and until now, just only one hearing is held that's it
But now One among the 2 plaintiffs wants to Withdraw the case permanently due to feels not interested in the case involvement
But the second plaintiff wants to continue the case
So how should the first plaintiffs Remove his Name from the Case
by allowing the other palintiff alone to continue
What is the procedure to withdraw the case by just one plaintiff
Kindly I request you to kindly Guide me and suggest me in this process of Case withdrawal by one plaintiff

Such person make an application to the court for withdrawal his name ,the court will do after giving him the information in respect of effects of such withdrawal.
Please upload video on Order XXII of CPC wherein please explain right to sue survives or not in great depth.

Sir thanks for the video. What if the plaintiff submits a false affidavit in court and the JD submits his objections. If the Plaintiff has no answers to the JD objections can he withdraw the case?
If he withdrew in such situation also court will impose liability on him.

In civil cases generally court will impose damages

Abondonment means aapne claim nahi kiya, jabki withdrawal means aapne claim kiya but us pe jor nahi diya ya wapas le liya.
