Hi Isauro. So, legally, you are always supposed to have a valid, non-expired green card on you. However, just because your green card is expired, it does not mean that you are not a permanent resident anymore. You are still a legal permanent resident. So, you should not have any problems with an expired green card, however things are getting a little more strict these days. So, please carry your green card AND the receipt for your I-90 (Form I-797C). The I-797C will show that you have applied for your new green card.
My wife and I are traveling to the Philippines soon. She has an expired GC, but USCIS gave her an I-797 Notice that she has an extension for 18months. Hi AlphaOne. Yes, that should be enough for travel outside the country. CBP should know what that is without a problem, but sometimes the airlines get confused. The extension notice and expired green card should work, but it is also helpful and safer to also have either the extension stamp directly in your passport or the extension sticker right on your green card. That usually makes things easier for people not familiar with just the extension notice. In Texas you can Renew your Drivers License with an Expired Green Card. You need to bring your Expired Green Card and they will run the numbers to see if you are Lawfully staying here or not.

You should not have to renew your green card because you are waiting in line and have a valid receipt number and Form I-797 notice. Your receipt letter (Form I-797) should extend your green card by one year. You can call 800-375-5283 with your receipt notice to ask about the extension of your green card. Hi Laura! It will depend on your cruise line and the ports of call. Please contact your cruise line to see what documents they will need for boarding and if your expired green card will be an issue. Please check with them about the I-797 notice. Some cruise ships and airlines are not familiar with the letter. A temporary I-551 passport stamp or sticker on your green card is usually better. You can usually get one through InfoPass at your local field office. You can try to schedule online or you may need to call the 800 number. The stamp on your green card is fine for travel. Just make sure you have enough time and you are not too close to the expiration of the sticker. You may need to point it out to the airlines if you get any questions. Some are not familiar with the sticker. Customs and border patrol should be familiar with the sticker when you return. There is such a backlog of applications right now that many people have extension letters, stamps, and stickers. If you have a receipt for filing for a new green card (I-797C), or a receipt for filing for citizenship (I-797), please bring a copy of the receipt with you as well. That will proves to CBP that you have filed the proper paperwork and are just waiting for your new card or for your interview. :)

Hi!! My parents card expired last year and they applied for renewal 6 months before the expiration date. I filled the form l-751 in order to remove conditions and get my 10 years permanent resident green card( I did all of this on time... 90 days before my 2 years green card expired) They gave me the letter I-797, Notice of Action, which says I can work and travel while my status is defined. They say If I want to travel I must do it with my expired green card and the letter. My question is how safe is this? If she does not have a reentry permit and she stayed because of an emergency, she may be able to get a returning resident visa (SB-1) But basically, if you are outside of the United States when the card expires and you have not applied for the renewal card prior to your departure, you should contact the nearest U.S. Consulate, USCIS office, or U.S. port of entry before attempting to file Form I-90 for a renewal green card.

You can request an oath ceremony as soon as possible because of your situation. Sometimes oath ceremonies are very soon after your interview. Hi Ketan. If they have not left yet, they they could obtain a re-entry permit before the trip to allow them to re-enter the US and not lose status. If they are currently in the U.S. after coming back from the trip, they may need to wait five years past the date of the long trip in order to apply for citizenship. If they are still out of the country, they may risk losing their card during re-entry. They may be able to obtain a returning resident visa (SB-1) from a U.S. consulate while abroad though. It may depend how long you have been outside the country. Less than 6 months is best. How long have you been outside the country? If you got stuck outside the country because of COVID, they may just ask you to renew your green card at the border. Basically file the I-90 to renew and pay the fee. You cannot do this outside the country. Many different scenarios here based on your situation. It also depends on the mood of the CBP officer you get tbh - much is left up to the discretion of the officer.

If you filed your N-400 with at least 6 months left on your green card, they may be able to give you the 551 extension stamp at your biometrics appointment. If they re-use your biometrics because of COVID, then you may need to request an InfoPass appointment in order to ask for the extension. If your green card has expired you will not be able to become a citizen believe that I went through all the steps my card expired too so they told me to apply for my green card this takes up to a year but once you have proof that you applied and payed for it they will give you a temporary card with that you are able to do your interview and tests.Good luck

Hi Luz. Do you have another form of photo ID that is not expired, such as a passport? You usually need a valid (non-expired) form of photo ID to get through security at the airport. However, On the TSA website, it says that expired licenses will be accepted up to one year after expiration. Hi Luz. You can try renewing your driver's license and get the Real ID, however....you might need a valid, unexpired green card in order to get the new driver's license. The system (depending on your state) should give you a "not found" or "not registered" answer. Something like that. It might ask you if you want to register. Make sure you don't. If you did accidentally register in the past, you will need to contact the state to get that cleared out.

So I applied for naturalization and I was denied on the basis that I was already a citizen under my father, who recently gained his citizenship status, months after I turned 18. Now I need a passport and proof of citizenship and I don't know what to do, my green cars is expired, I can't use a foreign birth certificate to prove my heritage to my father, and my twin brother who went through the same process of naturalization was approved perhaps this may even be an error on the other end but I am stuck. Edit: I was 17 at the time he gained citizenship however I do not know how to claim it, since I am 20 now. It is also important to not that my father was not married when I was born overseas.

Hi Arturo. You are technically supposed to renew at least six months before your expiration date. You can renew now, or apply directly for citizenship if you are eligible. If your card expires, you can use your I-90 renewal receipt or your N-400 naturalization application receipt to show that you have applied and are currently waiting. When the offices open back up, you can ask to see if they will give you an extension letter, an extension stamp in your passport, or an extension sticker for your green card while you wait. You will need to make an InfoPass appointment through the 800 number to do that. Call after you apply to set up an appointment for this summer - once things return to normal. You can also ask at your biometrics appointment for the extension. They may give it to you at the biometrics appt, but usually only if you applied with the 6 months left on you GC. Times are a changin though, so they may start making exceptions. You can also ask a direct question through your online account once you set that up. My card has expired the beginning of 2017. I renewed it in July and got an appointment for the biometrics in August. Completed that and now waiting for my new card. I didn’t realize that my green card expired in 2017 so I applied for citizenship back then. I’ve been waiting over a year and when I login to view my case it says that it will be completed in Jan 2019. I have recently been informed that my company is laying off a number of us. I now have to find a job.. I know e-verify works for me but if they want to see my green card I’m screwed. I went to the USCIS to ask them to stamp my British passport with something that is written saying that I’m ok but the guy refused and offered me to apply to renew my green card. I did so and paid them the last of my savings and now realized that I might not get that or my citizenship in time either. I think the only thing I can do is plead my case to the potential employer and hope they go with the e-verify only and see my open cases with the USCIS.

They couldn't give the stamp since your green card was expired. You had to apply first and then bring the receipt notice to them to get the stamp. You can use the stamp in your passport to travel. Hi Mai Vu. They are waiving some of the biometrics appointments, but it might depend on how long ago your last fingerprints were taken. If you still have some time left on your green card, you might be able to apply directly for citizenship without renewing first. That would save you some money. You will need to check in with an immigration representative first. There is a good chance they will still want you to renew though - especially in order to receive the extension stamp in your passport or on your green card. We've seen this go both ways depending on the field office. The extension stamp gives you another 18 months on your green card while you wait for a new one. It also allows you to use your expired card for employment and other identification situations. They are waiving some of the actual biometrics appointments, but they are still collecting all the fees. If you want to renew your green card with a fee waiver, you can file the I-90 with the I-912 fee waiver - www.uscis.gov/i-912. You cannot do fee waivers online. There is no option for a reduced fee for the I-90 renewal application. For citizenship - the N-400 application must be sent through the mail with either the I-912 (fee waiver request) or the I-942 (request for reduced fee - www.uscis.gov/i-942). Using public benefits legally should not be a bar for citizenship. The new rule typically only applies to people trying to get their first green card. Hi Anyelis. This has gotten a bit more complicated with the Trump administration. The OFFICIAL answer from USCIS is that you must submit Form I-90 (for renewal or replacement) first and then apply for citizenship with the N400. You don’t need to wait for your new card in order to file the N400. You can use the receipt from the I-90 to show you filed that first. You would then put a copy of the receipt in with the N400 application. That said, many people have successfully filed the N400 with an expired green card. Prior administrations have not really been as strict as the Trump administration with this situation. So, in the end, it is really up to the discretion of your particular field office at this point. Some offices are accepting the N400 with the expired green card, but some field offices are requiring that you file the I-90 first. Ours is accepting the N400, but then still requiring payment for the I-90 as well. Citizenship Works will help you fill out your application and answer all legal questions. Traveling without a green card is much too risky. You will not be allowed back into the US without proof of permanent residence status. You will need to renew your green card first. While waiting for your new green card, you can request a temporary I-551 stamp in your passport. This should allow you to travel outside the country without your actual green card (although having the green card is always best). Hi Pavinee. Unfortunately, if you lost your Permanent Resident Card, you generally must still file Form I-90 even if you plan to apply for citizenship. You don't need to wait for your new green card to apply for citizenship though. Send in a copy of the I-90 receipt with your N-400 application to let them know you filed for a replacement.

You will need to make sure you have the new Real ID compliant card in order to board a plane. www.dhs.gov/real-id-public-faqs Each state is handling this differently, but everyone will need to have one by next year. In order to get a new Real ID driver's license, you'll probably need to renew your green card. Most DMVs and MVAs won't accept an expired card. Driving across the states should not pose a problem because you are still a legal permanent resident even if your card is expired. However, the law (Section 264 of the Immigration and Nationality Act (INA)) states that you must always carry official evidence of status, so technically an officer can make problems for you if they choose to do so. If you have already applied for a renewal or if you applied for citizenship, then you can carry your receipt letter (Form I-797C) to show that you have applied for renewal or citizenship. You can sometimes get an extension stamp in your passport (or sticker on your green card) while waiting for citizenship.

If you don't get it at your biometrics appointment, then you can make the Infopass appointment. After you get a stamp or sticker for extending your PR status, you can use it to travel. However, still bring a copy of your I-797 receipt form.

Please remember you cannot travel with an expired green card. There are different rules for the military though, especially if you are stationed abroad. We encourage you to file for citizenship if you are eligible (and then request an extension on your green card). Active military have special rules and usually the process is faster. We are not familiar with all the military requirements, so it is best to give that military line a call. The official word from USCIS is that according to the law, you must always have a current green card, so they will probably tell you to renew or apply for citizenship. Even though that is the law, you don't lose your permanent residence with an expired card, but it could turn into a headache and cause a lot paperwork problems. Hi Chrissy. You should be able to travel with the extension letter, but I don't think you can travel with an expired passport. You will most likely need to renew your passport. The extension letter with the expired green card can sometimes be tricky, especially if the airlines are not familiar with the document. Hi there. The official answer from USCIS is that you must renew before applying now. You can renew using form I-90 and then apply for citizenship using a photocopy of the receipt showing that you have filed Form I-90 . This allows you to apply for citizenship while you are renewing so you don't have to wait for the new card before applying. In the past, many people applied with an expired card without an issue, but they seem to be more strict now. Please get another opinion though because it is so expensive to do both. Hi Jenny. You should be able to travel with an unexpired passport, your expired green card, and your I-797 unexpired extension notice without a problem. Some people report that they like to get the I-551 stamp in their passport as well because there seems to be less questions when re-entering. You can get the stamp at an Infopass appointment. Things are a little more complicated these days and people want to be extra safe. Hi there. You can usually show your N400 application receipt notice (or your I-90 receipt notice) to show that you have applied for citizenship and are waiting for USCIS to process, but it depends on your employer if they will accept it. You can also get an appointment from USCIS on InfoPass - my.uscis.gov/appointment - and see if you can get an extension stamp (I-551) in your passport. They will also do this sometimes at your biometrics appointment if your card is not yet expired when you go. You should actually still have your card. Just send in a copy with the N-400 or I-90. That's a bit tricky. It may depend how long they have been outside the country. If they have been outside the country for too long (over a year) and did not retain ties to the US, it could be difficult to renew. That means that they have broken continuous residence and may have abandoned their permanent residence status. However, if they were outside the US for less than one year and if they can prove that they did not obtain employment while abroad, that their immediate family remained in the US, and they retained full access to their US home, then that would be very helpful for their case. Good morning and thank you for the information. What if you are already working with insurance licenses for a company and the card expires while already employed? Can the expiration cause a red flag to pop up are cause any holds on the licenses?
It should not cause any problems if your green card expires while you are employed. If you green card expires, you are still a legal permanent resident. That does not change. There is no reason your employer should re-verify your green card. If you are working with a work authorization that expires, then that would be different. They may re-verify a work authorization.

I was laid off in April from my job. I have an expired resident card when applying for a new job. HI Andres. You are still a lawful permanent resident, however, yes, it is very difficult to apply for a new job with an expired green card. New employers are required by law to check identity and employment authorization. The best bet is to see if USCIS will issue you an extension letter or extension sticker for your green card. This will extend your green card by 18 months while you wait for your new card. Usually they will only give those if you apply with 6 months left on your card, however because of Covid19, they are making many exceptions. An employer may be able to accept the receipt of your I-90 application as proof of identity and work eligibility. Typically your receipt is valid for 90 days. If your green card is already expired, they may tell you to make an InfoPass appointment. Try to get it at biometrics though, since it is sometimes difficult to get an InfoPass appt. Biometrics will sometimes make exceptions if you need to travel because of a family emergency.
@@EssaGroup one of the issues I have is that I lost my green card as we have moved 4 times I'm sure it's somewhere in a box but it also expired and I could only choose one of the two so I chose to renew.perhaps I should contact somebody and let them know that my card is also lost as they did request for my biometric appointment to bring my old green card..... There are other acceptable documents for Employment Authorization. For example, you do not need to show your green card if you have a valid driver's license and an unrestricted social security card. Green cards issued between 1979 and August 1989 do not have expiration dates and do not need to be renewed unless you wish to use Global Entry kiosks at international airports in the U.S. you will have to get a replacement card. GE kiosks cannot read the old format Green cards.

Hi Isauro. So, legally, you are always supposed to have a valid, non-expired green card on you. However, just because your green card is expired, it does not mean that you are not a permanent resident anymore. You are still a legal permanent resident. So, you should not have any problems with an expired green card, however things are getting a little more strict these days. So, please carry your green card AND the receipt for your I-90 (Form I-797C). The I-797C will show that you have applied for your new green card.
My wife and I are traveling to the Philippines soon. She has an expired GC, but USCIS gave her an I-797 Notice that she has an extension for 18months. When we come back to the U.S, would that be enough proof for the CBP that my wife has Permanent Resident status even if her GC is expired? What else would she need to provide?
Hi AlphaOne. Yes, that should be enough for travel outside the country. CBP should know what that is without a problem, but sometimes the airlines get confused. The extension notice and expired green card should work, but it is also helpful and safer to also have either the extension stamp directly in your passport or the extension sticker right on your green card. That usually makes things easier for people not familiar with just the extension notice. Hi Neemat. Yes, the N-400 is expired as well. USCIS is accepting these expired forms until they release the new version. It is recommended to apply online for your I-90 directly through the USCIS.gov website if possible. It will go faster and is more secure.

They should be able to extend your green card. Sometimes they will only do it one time if you file for renewal after the first one is expired. Try to schedule an appointment with your field office here to go in to ask in person - my.uscis.gov/appointment
I think she needs it as a proof that she is qualified to work while not yet a citizen. Employers are careful about this when hiring.
In Texas you can Renew your Drivers License with an Expired Green Card. You need to bring your Expired Green Card and they will run the numbers to see if you are Lawfully staying here or not.

Hi Ragna. That field office is running at a 13.5 to 16 month complete processing time, so it looks like it might still be awhile. You should not have to renew your green card because you are waiting in line and have a valid receipt number and Form I-797 notice. Your receipt letter (Form I-797) should extend your green card by one year. You can call 800-375-5283 with your receipt notice to ask about the extension of your green card. Please check with them about the I-797 notice. Some cruise ships and airlines are not familiar with the letter. A

The stamp on your green card is fine for travel. Just make sure you have enough time and you are not too close to the expiration of the sticker. You may need to point it out to the airlines if you get any questions. Some are not familiar with the sticker. Customs and border patrol should be familiar with the sticker when you return. There is such a backlog of applications right now that many people have extension letters, stamps, and stickers. If you have a receipt for filing for a new green card (I-797C), or a receipt for filing for citizenship (I-797), please bring a copy of the receipt with you as well. That will proves to CBP that you have filed the proper paperwork and are just waiting for your new card or for your interview. :)

Hi!! My parents card expired last year and they applied for renewal 6 months before the expiration date. And USCIS gave a letter that allows it to be a legal document along with the expired card, for 12 months after the expiration date. And that is up now. I filled the form l-751 in order to remove conditions and get my 10 years permanent resident green card( I did all of this on time... 90 days before my 2 years green card expired) They gave me the letter I-797, Notice of Action, which says I can work and travel while my status is defined. Hi Time. This might be a bit of a problem. Usually the US will consider this as an abandonment of permanent resident status. If she does not have a reentry permit and she stayed because of an emergency, she may be able to get a returning resident visa (SB-1) But basically, if you are outside of the United States when the card expires and you have not applied for the renewal card prior to your departure, you should contact the nearest U.S. Consulate, USCIS office, or U.S. port of entry before attempting to file Form I-90 for a renewal green card.

You can request an oath ceremony as soon as possible because of your situation. Sometimes oath ceremonies are very soon after your interview. The form you receive at the end of your interview will prove your status. If there is a problem with your interview, you can ask the officer to please stamp your passport with an I-551 temporary evidence stamp to extend your green card expiration date. What options does the people facing such situations have to save their green card and permanent residency status.Remember the green card was renewed in December-2015 for next 10-yrs and this happenned first time that due to sudden and last minute govt decision to demonitize the currency caused tons of problems to citizens back home and govt came with several new laws to put strict restrictions and limits on financial transactions which badly affected many NRIs and Foreign Residents to go back and travel abroad to maintain their legal status and that's one of the main reasons including some immediate property, land and other assets law changed and came into effect due to which my friends brother who went to his home country last time in Dec-2015 after renewing his green card could not come back due to govt emergencies n new laws applied since Oct-Nov-2016 & since he could not return back to US thinking his green card might have got automatically cancelled and he might not be allowed to enter US. Hi Ketan. If they have not left yet, they they could obtain a re-entry permit before the trip to allow them to re-enter the US and not lose status.
If they are currently in the U.S. after coming back from the trip, they may need to wait five years past the date of the long trip in order to apply for citizenship.
If they are still out of the country, they may risk losing their card during re-entry. They may be able to obtain a returning resident visa (SB-1) from a U.S. consulate while abroad though. It may depend how long you have been outside the country. Less than 6 months is best. How long have you been outside the country?
If you got stuck outside the country because of COVID, they may just ask you to renew your green card at the border. Basically file the I-90 to renew and pay the fee. You cannot do this outside the country.
Many different scenarios here based on your situation.
It also depends on the mood of the CBP officer you get tbh - much is left up to the discretion of the officer.

If your green card has expired you will not be able to become a citizen believe that I went through all the steps my card expired too so they told me to apply for my green card this takes up to a year but once you have proof that you applied and payed for it they will give you a temporary card with that you are able to do your interview and tests.Good luck

Check the language used on your N-400 receipt. Hi Luz. Do you have another form of photo ID that is not expired, such as a passport? You usually need a valid (non-expired) form of photo ID to get through security at the airport. However, On the TSA website, it says that expired licenses will be accepted up to one year after expiration. Hi Luz. You can try renewing your driver's license and get the Real ID, however....you might need a valid, unexpired green card in order to get the new driver's license. Just be sure you don't actually register. The system (depending on your state) should give you a "not found" or "not registered" answer. Something like that. It might ask you if you want to register. Make sure you don't.
If you did accidentally register in the past, you will need to contact the state to get that cleared out.

If she has been outside the United States for longer than 6 months and has let her green card expire, it is possible that she has abandoned her permanent resident status. If she has been outside the US for less than 6 months, she might be able to fly back (if the airline will allow an expired green card) and renew her green card at customs when she arrives in the US.

Any type of criminal history during the last five years may be a cause for concern, even if your record was expunged. Essa, I have been a green card holder since the age of about 11. I was born in 1986. My mom was naturalized before I turned 18 years old, and I did not turn 18 until October 11, 2004. I quickly wanted to ask about my own issue if that's okay.
So I applied for naturalization and I was denied on the basis that I was already a citizen under my father, who recently gained his citizenship status, months after I turned 18. Now I need a passport and proof of citizenship and I don't know what to do, my green cars is expired, I can't use a foreign birth certificate to prove my heritage to my father, and my twin brother who went through the same process of naturalization was approved perhaps this may even be an error on the other end but I am stuck.
Edit: I was 17 at the time he gained citizenship however I do not know how to claim it, since I am 20 now. It is also important to not that my father was not married when I was born overseas.
Hi Sigmund. Sounds like you might be able to file Form N-600 to get your Certificate of Citizenship. If you were under 18 years of age on February 27, 2001, it may be possible to file application N-600 to obtain a Certificate of Citizenship if you meet all of the requirements. www.uscis.gov/n-600

The N-600 is quite expensive, so you may be able to just apply directly for a US passport using your father's Certificate of Naturalization. That would be much cheaper and faster.
The N-600 is technically optional, but we highly recommend getting it to have as a backup source of documentation.

Hi Arturo. You are technically supposed to renew at least six months before your expiration date. You can renew now, or apply directly for citizenship if you are eligible. If your card expires, you can use your I-90 renewal receipt or your N-400 naturalization application receipt to show that you have applied and are currently waiting.
When the offices open back up, you can ask to see if they will give you an extension letter, an extension stamp in your passport, or an extension sticker for your green card while you wait. You will need to make an InfoPass appointment through the 800 number to do that. Call after you apply to set up an appointment for this summer - once things return to normal.
You can also ask at your biometrics appointment for the extension. They may give it to you at the biometrics appt, but usually only if you applied with the 6 months left on you GC. Times are a changin though, so they may start making exceptions.
You can also ask a direct question through your online account once you set that up. Secure questions can be asked through the "Send a Message" link under the "Resources" tab on the right side. This is often easier than trying to call the 800 number. 👍

Yes, the extension sticker on your green card or extension stamp in your passport should allow you to continue to work in the U.S. However, new employers may need to re-verify your status with the I-90 form. If you are working for the same employer when your card expires, your current employer should not need to re-verify your status.

My card has expired the beginning of 2017. I renewed it in July and got an appointment for the biometrics in August. Completed that and now waiting for my new card. You will be fine to travel within the US on an expired card, but it is always better to have an unexpired one just in case. If you don't receive your card by June, I would try to get another extension by making an InfoPass appointment.

You can ask for an extension stamp in your passport. The extension stamp will extend your green card for another 18 months. They may be able to do this at your biometrics appointment, or they may tell you to make an appointment with your field office closer to the expiration date on your green card. 👍

I didn’t realize that my green card expired in 2017 so I applied for citizenship back then. I’ve been waiting over a year and when I login to view my case it says that it will be completed in Jan 2019. I have recently been informed that my company is laying off a number of us. I now have to find a job.. I know e-verify works for me but if they want to see my green card I’m screwed. I went to the USCIS to ask them to stamp my British passport with something that is written saying that I’m ok but the guy refused and offered me to apply to renew my green card. I did so and paid them the last of my savings and now realized that I might not get that or my citizenship in time either. I think the only thing I can do is plead my case to the potential employer and hope they go with the e-verify only and see my open cases with the USCIS.
Hi Duncan. Since you applied to renew your green card, they should now give you the temporary extension stamp in your passport. It will be good for a year. They couldn't give the stamp since your green card was expired. You had to apply first and then bring the receipt notice to them to get the stamp. You can use the stamp in your passport to travel. Also - your new employer may not ask specifically to see your green card. That is illegal. You can present other documents. Duncan Cunningham uscis is bullshit, after you file the application to renew your green card you can make an info pass appointment and have them stamp your passport. I got citizenship denied twice in Los Angeles then moved to a free state and got it in flying colors. Try not to live in a communist state.

Even if your green card expired while working for the employer, the original submission on I-9 should still stand as proof of status. Your status as a legal permanent resident does not change if your green card expires. You are still a legal permanent resident with the same work authorization.
However, it is very hard to get a new job with an expired card because the new employer will be required to verify your identity and your work authorization.

Ah. If you already have a valid, legal extension for a conditional green card then you should be fine as long as you don't stay away too long and don't miss any interviews (if needed). Please be sure you have already done your biometrics as well. If your I-751 gets denied while you are outside the country, you might have trouble re-entering. If your extension letter is in danger of expiring, you can usually get an I-551 extension stamp in your passport by calling the USCIS customer service line and asking for an InfoPass appointment.
Note: If you have had your conditional green card for 2 years and 9 months AND you have been married to a US citizen for at least 3 years, you might be able to apply directly for citizenship (Form N-400) while your I-751 is pending. 👍

Hi Mai Vu. They are waiving some of the biometrics appointments, but it might depend on how long ago your last fingerprints were taken. If you still have some time left on your green card, you might be able to apply directly for citizenship without renewing first. That would save you some money. You will need to check in with an immigration representative first.
There is a good chance they will still want you to renew though - especially in order to receive the extension stamp in your passport or on your green card. We've seen this go both ways depending on the field office. The extension stamp gives you another 18 months on your green card while you wait for a new one. It also allows you to use your expired card for employment and other identification situations.
They are waiving some of the actual biometrics appointments, but they are still collecting all the fees. If you want to renew your green card with a fee waiver, you can file the I-90 with the I-912 fee waiver - www.uscis.gov/i-912. You cannot do fee waivers online. There is no option for a reduced fee for the I-90 renewal application.
For citizenship - the N-400 application must be sent through the mail with either the I-912 (fee waiver request) or the I-942 (request for reduced fee - www.uscis.gov/i-942).
Using public benefits legally should not be a bar for citizenship. The new rule typically only applies to people trying to get their first green card.

Hi Anyelis. This has gotten a bit more complicated with the Trump administration. The OFFICIAL answer from USCIS is that you must submit Form I-90 (for renewal or replacement) first and then apply for citizenship with the N400. You don’t need to wait for your new card in order to file the N400. You can use the receipt from the I-90 to show you filed that first. You would then put a copy of the receipt in with the N400 application.
That said, many people have successfully filed the N400 with an expired green card. Prior administrations have not really been as strict as the Trump administration with this situation. So, in the end, it is really up to the discretion of your particular field office at this point. Some offices are accepting the N400 with the expired green card, but some field offices are requiring that you file the I-90 first. Ours is accepting the N400, but then still requiring payment for the I-90 as well.

Traveling without a green card is much too risky. You will not be allowed back into the US without proof of permanent residence status. You will need to renew your green card first. While waiting for your new green card, you can request a temporary I-551 stamp in your passport. This should allow you to travel outside the country without your actual green card (although having the green card is always best). Hi Pavinee. Unfortunately, if you lost your Permanent Resident Card, you generally must still file Form I-90 even if you plan to apply for citizenship.
You don't need to wait for your new green card to apply for citizenship though. Send in a copy of the I-90 receipt with your N-400 application to let them know you filed for a replacement.

If you are still living outside the United States, then you most likely have abandoned your legal permanent resident status because you broke the continuous residence and physical presence requirements. Each state is handling this differently, but everyone will need to have one by next year.
In order to get a new Real ID driver's license, you'll probably need to renew your green card. Most DMVs and MVAs won't accept an expired card.
Driving across the states should not pose a problem because you are still a legal permanent resident even if your card is expired. However, the law (Section 264 of the Immigration and Nationality Act (INA)) states that you must always carry official evidence of status, so technically an officer can make problems for you if they choose to do so.
If you have already applied for a renewal or if you applied for citizenship, then you can carry your receipt letter (Form I-797C) to show that you have applied for renewal or citizenship. You can sometimes get an extension stamp in your passport (or sticker on your green card) while waiting for citizenship.

Hi Ricardo. Sometimes they will give you a stamp in your passport or a sticker on your green card if you ask at your biometrics appointment. They will usually do that if you applied 6 months before the expiration of your green card. However, sometimes they will still do it because the backlog is so long. If you don't get it at your biometrics appointment, then you can make the Infopass appointment. After you get a stamp or sticker for extending your PR status, you can use it to travel. However, still bring a copy of your I-797 receipt form.

This is not true, if you have a GC without expiry date, it is still valid, as long as your GC is i-551 your card is valid

Please remember you cannot travel with an expired green card. There are different rules for the military though, especially if you are stationed abroad. We encourage you to file for citizenship if you are eligible (and then request an extension on your green card). Active military have special rules and usually the process is faster. We are not familiar with all the military requirements, so it is best to give that military line a call.
The official word from USCIS is that according to the law, you must always have a current green card, so they will probably tell you to renew or apply for citizenship. Even though that is the law, you don't lose your permanent residence with an expired card, but it could turn into a headache and cause a lot paperwork problems.

It is a good idea to always have a unexpired, valid card though. They may be able to send you an extension letter to put with your green card. Sometimes they allow the receipt number from the I-797C, Notice of Action receipt letter to be used as an extension as well.

Yes. You can renew earlier. However, if you have at least 6 months left on your green card, you may be eligible to file directly for citizenship instead though. That would save a lot of money!

Hi Chrissy. You should be able to travel with the extension letter, but I don't think you can travel with an expired passport. You will most likely need to renew your passport.
The extension letter with the expired green card can sometimes be tricky, especially if the airlines are not familiar with the document. You can renew your green card right online with Form I-90, or you can send in a I-90 paper form. If you use a paper form, you do not need to send in your expired green card. The receipt letter they send you in the mail will extend your green card for 12 months. You can file for citizenship using your expired green card and your receipt letter showing that you sent for a renewal.

Hi there. The official answer from USCIS is that you must renew before applying now. You can renew using form I-90 and then apply for citizenship using a photocopy of the receipt showing that you have filed Form I-90 . This allows you to apply for citizenship while you are renewing so you don't have to wait for the new card before applying. In the past, many people applied with an expired card without an issue, but they seem to be more strict now. Please get another opinion though because it is so expensive to do both. Hi Jenny. They should just mail your new card. Processing time right now is 6-9 months. In some cases, they will make a request for additional information or schedule an interview though. It depends if they have questions related to the application or the biometrics results.

Hi Jenny. You should be able to travel with an unexpired passport, your expired green card, and your I-797 unexpired extension notice without a problem. Some people report that they like to get the I-551 stamp in their passport as well because there seems to be less questions when re-entering. You can get the stamp at an Infopass appointment. Things are a little more complicated these days and people want to be extra safe. I have an expired permanent resident green card and had to send in the card and the n400 paperwork for citizenship to the Government agency. Is there any was to ask for, or provide, proof to prospective employers that my residency is in transition to citizenship?
Hi there. You can usually show your N400 application receipt notice (or your I-90 receipt notice) to show that you have applied for citizenship and are waiting for USCIS to process, but it depends on your employer if they will accept it. You can also get an appointment from USCIS on InfoPass - my.uscis.gov/appointment - and see if you can get an extension stamp (I-551) in your passport. They will also do this sometimes at your biometrics appointment if your card is not yet expired when you go. You should actually still have your card. Just send in a copy with the N-400 or I-90. That's a bit tricky. It may depend how long they have been outside the country. If they have been outside the country for too long (over a year) and did not retain ties to the US, it could be difficult to renew. That means that they have broken continuous residence and may have abandoned their permanent residence status. However, if they were outside the US for less than one year and if they can prove that they did not obtain employment while abroad, that their immediate family remained in the US, and they retained full access to their US home, then that would be very helpful for their case. It should not cause any problems if your green card expires while you are employed. If you green card expires, you are still a legal permanent resident. That does not change. There is no reason your employer should re-verify your green card.
If you are working with a work authorization that expires, then that would be different. They may re-verify a work authorization.

There are exceptions, especially if you have an approved Form N-470 or a re-entry permit that allowed you to stay outside the U.S. You can check with your closest U.S. embassy or consulate before proceeding - www.usembassy.gov/
Often, it will be up to the airline whether or not you would be allowed to board the plane to the U.S. with an expired green card. You will need to talk to the airlines. If you can get to the U.S., it will then be up to Customs and Border Protection (CBP) at the airport when you land whether or not to allow you into the country.

I was laid off in April from my job. I have an expired resident card when applying for a new job. I already e-file the I-90 on the website in April 30 I finally got my receipt notice of action stating that they will send me a letter for biometrics but I was wondering how can I apply for a job now or do I need to wait for my green card. HI Andres. You are still a lawful permanent resident, however, yes, it is very difficult to apply for a new job with an expired green card. New employers are required by law to check identity and employment authorization. The best bet is to see if USCIS will issue you an extension letter or extension sticker for your green card. This will extend your green card by 18 months while you wait for your new card. Usually they will only give those if you apply with 6 months left on your card, however because of Covid19, they are making many exceptions.
An employer may be able to accept the receipt of your I-90 application as proof of identity and work eligibility. Typically your receipt is valid for 90 days. That will give you 90 days to wait to see if you can get that extension letter. www.uscis.gov/i-9-central/acceptable-documents/receipts

Unfortunately, it is not easy to renew outside of the US with an expired green card, especially if you are outside the US for longer than 6 months. Outside the country for longer than one year is often taken as abandoning your permanent resident status.

If your green card is already expired, they may tell you to make an InfoPass appointment. Try to get it at biometrics though, since it is sometimes difficult to get an InfoPass appt. Biometrics will sometimes make exceptions if you need to travel because of a family emergency.
@@EssaGroup one of the issues I have is that I lost my green card as we have moved 4 times I'm sure it's somewhere in a box but it also expired and I could only choose one of the two so I chose to renew.perhaps I should contact somebody and let them know that my card is also lost as they did request for my biometric appointment to bring my old green card..... I’m in a immigration group on Facebook, and they are sending green cards trough mail right now, they still working on cases that doesn’t need face to face appointments, so she might get it soon even though the quarantine still going on, if not an extension letter like somebody mentioned here.

If your green card will not expire until 2023, then you don't need to renew. It would be best to apply directly for citizenship now. The cost will be going up soon, so we are encouraging those that are eligible to apply as soon as possible.
