    Eve Brennan disappeared in Dublin in July 1993.
    Eve lived in an upmarket Rathgar apartment with her own car parking space.
    Eve disappeared, and it was noted that her car was parked in the wrong parking space.
    Someone,other than Eve had clearly parked that car. Was the car forensically examined?

    The home developer should be held responsible for not providing the correct information to the purchasers of the property and their solicitor.

      The issue is with the acquiring solicitor not properly investigating the existing planning specifications. Makes one wonder: what else did that solicitor get wrong when they did the conveyance.

    We need to be clear, they haven’t lost 1.64 million. They have (at the moment) lost the value of one car parking space in the development. So whatever that is worth (and possible legal fees).

    I would be raging. I imagine the two spaces would have been a huge incentive to purchase the Property in D4 for that price tag.

    I would record Any appointment with a solicitor AND do my own research.

    Planning laws is only for plebians. If it was for a new Irish person this wouldn't be an issue.

    Does this sort of thing make property more or less expensive? My guess is it makes property more expensive. But if so, you are getting less value for your money.

    Seems petty seeing as my neighbours could build a one storey house in their back garden without planning permission. Its way higher than the regulations allow. A whole house v parking space

    I just can digest someone paid 1.64 million to live in Rathgar. Just cant get away with that amount. 😢

      And if you look on Google Maps they're horrible looking houses. For that kind of money I want something that at least looks nice. .

    A parking space isn't a permanent structure, and parking a vehicle is intrinsically not permanent. I can't see how parking spaces can require planning permission.

      Parking is a use of private land for which pl. consent is required as it often relates to arrangements for access to a public highway or via the land of others to a highway.
      With consent the use can be made at any time or in compliance with any conditions attached to the consent. Restrictions may include proximity to occupied neighbour's dwellings in order to avoid nuisance, interference with daylight and type of vehicle.

    Arrogance on part of the house owners? Or they just got crap and no doubt expensive solicitors. First one, when buying the house and the second one for letting the problem going to High Court. The mind boggles on what sort of advise the house owners were getting or maybe ignoring. If you can afford a 1.6m house, you can afford proper professinal solicitors. Me thinks, the High Court action was driven by the house owners rather than the solicitor or barrister. Will we ever know, doubtful. No having full info one can't come to any full conclusion.

      I would generally concur with you view. A pertinent question maybe to ascertain if the couple were using the same solicitor for both the convenance and this judicial review??? If so, it would cast a very stark shadow on the case and this recent development in the High Court....

      @@kc8485 Indeed, they could have used the same solicitor. That might explain a lot. But, surely a barrister would have advised too and one would expect they would know better than either the house owners or the solicitor/s. Thus, I think the case was driven in the manner it was by the house owners. No shortage of arrogance and entitlement by house owners in upmarket areas of Dublin, that I can assure anybody on. Spending 1.6m on a house and only getting on one parking spot rather than two, wouldn't be a great story to tell at a dinner party! That might seem like a petty comment but it's not an exaggeration.
      Of course, I could be totally incorrect but it's hard to understand the High Court action ever being considered never mind actually presenting the case prior to not travelling the common and usual legal roads first that the HC would normally expect and insist on for a Judicial Review.
