    Thank you for your help this has been something tugging on my heart strings for a while now and for some reason I have been procrastinating out of fear. I also tug of war up in my head about whether or not my church idea is "normal" it brings love service and community so I don't know why we can be so hard on ourselves?? I appreciate your help and any other pointers.

    Super Easy to follow! Thank you soo much for everything! I did have a question. My state, MD, asks for a COF-85 Financial Report form to register and I did start working on the church last year and did receive food donations that I distributed. They asked for the monetary value, also it says that I need to do this every year! Is it similar in SD?

      In South Dakota, all they ask us for is the names and addresses of the leadership. Maryland sounds like they made their own version of the IRS's 990. Hmmm.... What I've done with donations of clothing (from the individual side) is count the items, and then look in the store for about how much they are selling for. For you, I'm not sure how you track it, but if you track canned items and boxed items. I would just make a quick judgment on what the average value is and multiply it by the number of items.

    What if you are an established church applying for an EIN for banking purposes and there are no employees?

      After you choose "Church", choose "Banking Purposes" instead of Starting a New Business. I think it will still ask you for a "Responsible Party" which is normally the Treasurer.

    I am new to this, we are just starting, renting the place, can I put my home address as both the church address and the mailing address even though the physical address is different than my home address?

      Yes you can. The main thing is making sure any communications from the IRS go to the right place. The Secretary of State is a lot pickier about address. When the time comes, you can complete the Form 8822b (www.irs.gov/pub/irs-pdf/f8822b.pdf) to update the address with the IRS.

      I haven't actually done this before, but when you get to the part where they ask if you are a New Business, etc., Choose "Banking Purposes." Since I've never gone past this point, I'm not sure what you will be asked after that.

    Does a small town church *have* to get an EIN number?
    How does it work? Do you have to pay taxes at the end of the year? No employees.
    Also what would you have to do if a business gave a check for their tithes?

      Does a small town church need an EIN with no employees? Probably not now. Without employees, the only other time you might need it is if you open up a new bank account. It doesn't cost you anything to get an EIN, but, if you don't use, it's easy to forget that you have one.
      For a business, if you give out giving statements at the end of the year, I would give the business one too. The rules are different for businesses than individuals, but they are able to claim charitable contributions for tax purposes as well.

      @@JeffPospisil thank you so much for the response. For the business that gave a donation, can I still do some sort of giving statement, even though we don't have an EIN number? Is that just writing out who gave what and what amount?
      Sorry for all the questions. We're new to this and completely confused.

      @@Arianna561 You don't need an EIN. This is just a letter on behalf of the church saying how much the business gave and when they gave it. You do need some IRS language "No goods or services were given in return for the donation besides intangible religious benefits."     Do you need a DBA for a nonprofit church organization to apply for EIN?

      What I needed was either a DBA or to be incorporated. The IRS is looking for some documentation from your State that says you are a legal entity.

      @@Neshafilthyrich Kind of funny. That's my post for tomorrow. Long story short, churches are automatically 501c3 according to the IRS.

    Is the church ein print the form 990 ?

      Churches are usually exempt from filing the Form 990 but would use their EIN for any 1099's or W-2's.

      I think this one post has saved churches a lot of money as most will just want a CPA or lawyer to take care of getting the church EIN.

      Follow the same process as in the video. A 508c1a is the Internal Revenue Code that says all churches are automatically 501c3 (www.law.cornell.edu/uscode/text/26/508)

      @@shaycooper3989 I'm not going to argue...that's why I put the link to the Internal Revenue Code. I 100% agree that church's are accountable to the LORD first. Tax considerations are secondary.

      @@JeffPospisil this wasn't an argument on my end it was a fact ! do more research on the 508 FBO and you'll see that it's more freedom going that route instead of the 501 , read Federal law 26 USC section 6033(a)(3)(a) on what it says about the 508c1a FBO
