You have to prove intent to defraud which is an insanely high bar. The Contractor intended to do the job and started in "good faith". The first step to tightening the laws is to set a a timeline of X days, requireing X hours onsite and if the contractor misses that requirement the job becomes legally abandonded and the owner can go after the contractors insurance which should be also be raised to a 1mil bond and attach jail time to contracting without that insurance/bond. That is how you clean up the system.

The homeowner's insurance needs to go after the first contractor. He was paid their money and absolutely failed the client. The city should also strongly consider having the contractor's license pulled.

What an amazing group of men who came together to be a blessing for this gentleman. Now I wish there was a GREAT attorney out there who would be willing to take on a case Pro Bono and sue the 1st contractor in civil court! Tbh he should be charged with theft as well!!

I know there were a lot of supply issues during the pandemic and the first contractor gets a pass for that but that doesn’t explain the failed inspections . If for any reason he couldn’t finish the job he should have done the right thing and refunded the money. I think the angel 😇 contractor will be blessed with plenty of work after this.
