    👍 I agree with you. Kyunki maine 2014 me khud ka ghar bechke supertech me paise bhara tha ghar kharidne keliye. Jo ki aaj tak mai rent pe rehe tha hun. Aapne 7 years kaha builder ku saja keliye 7 years tho kam hai. Kam se kam 20 year ki saja honi chahiye.

      Yes , only 3 things needed.
      1. Govt should make it mandatory to deposit the 25 percent of the amount needed to develop the project in Ascrow account and it should be forfeited if builder fails , by this a). Most of the non serious builder's will be out of market .
      B) in case of default , all personal assets should be attached , जो लोग दूसरे के घर बर्बाद करते है, सबसे पहले उनके घर सरकार को attach करने चाइए।
      C) therse builder's should be sent inside the Bar , with Six month No hearing of bails ,
      2. Only experience builder's should be allowed to initiate projects above 100 cr । Koi bhi muh utha ke builder na bane ...
      3, in case of home loans of such default builder's , EMI of bank should be stopped। Home buyer alone should not suffer

    In our company case the ongoing company production stopped. Took decision to sell after two three years and sold it scrap value. Now by using different sections day by day transfering our staff dues from secured to unsecured sections. If anyone asks to the liquidator he show supreme court judgement. Interested only how to reduce our dues.

    It is very true. NCLT should take strict action against the defaulter. I stay at Mumbai. In our locality our slum was gone under redevelopment scheme. Developer took the loan of 270 Crores from bank and other private investors and now around 3000 people are roaming on the road that the new developer will fulfils NCLT court decisions

    Hi sir, provisions already exist in the insolvency and bankruptcy code for preferential, undervalued, fraudulent and Extortionate transactions under Sections 43, 45, 47, 49, and 66. All the money siphoned off by the promoters of the company have to be returned accordingly

      Further, not anyone can provide a plan for resolution, the resolution applicant's eligibility has to be checked and verified by the provisions of Section 29A. Moreover, the eligibility criteria has to be set by the Committee of Creditors only, which ultimately includes the homebuyers as well.

      NCLT has little or no role to play in the value provided by the resolution applicant. The NCLT is limited, unlike High Court and has to comply with the commercial wisdom of the Committee of creditors, that again would include the homebuyers.

    Sir maine apni property future retail ko lease par di, co rent time par nahi de rahi thi to agreement as cluase terminate ho gya, maine notice diya, par co ka koi answer nahi aya, maine apni jurisdiction me eviction ke liye case kiya, in between co ne store band kar diya aur insolvency proceding start kar di, 180+90 days bi ho ge, par co/ rp possession nahi de rahe, nclt is totally big company favor law.

    Sir, i invested in Ajnara India Ltd (it's Khel Gaon Project) in Greater Noida. Builder failed to deliver the project therefore i appealed in UPRERA against Ajnara India Ltd. UPRERA gave decision in my favour and accordingly directed the builder to pay my money but builder didn't pay. I again appealed in UPRERA and this time UPRERA issued Recovery Certificate. But meanwhile proceedings were started against Ajnara India Ltd in another housing project case and one IRP is appointed. Now please let me know what should I do in this case.

      Only other solution is to file a special leave petition in SC , for amending the law ....
      However please file your claim as per order of RERA to the IRP .... So that whenever settled , atleast you can get the due amount...

    yesterday the nclt decision towards the builder is not in favour of financial creditors . Is there any way to appeal a decision on nclt case ?? Judge has been changed on last hearing and new judge has cancelled all the application of financial creditors

    आजही O2आहुजा प्रोजेक्ट NCLT मे गया है। फाईननशिअल कंपनी कार्बन हाईव्ह लि.को NCLT ने टर्मिनेट कर दिया हैं। 510 टेनेंट का प्रोजेक्ट है।देखते है अब कितने महिने लगते है। अब बंद होकर 12 महिने हो चुके हैं।काम बंद है और रेंट भी बंद है।

    have booked a flat in Ninex City sector 76 Gurugram in 2018 and taken a home loan of 99 lacs under buyback scheme. Builder has been given an EMI for 10 Months after that builder goes into NCLT and home loan goes into NPA. I have already filed a our Claim in NCLT. Now the bank filed a case against me in DRT for loan recovery. Now kindly suggest any legal suggestions

      It's really technical issue , in fact , subvention is not legally allowed by RBI , but builder's get it done cleverly.
      Can you please share your TPA ( tri party agreement) in which builder's had promised to pay EMI is mentioned.
      Iam really sorry about the situation you are facing , please quickly share TPA ... I will have to read it .

      Please file the claim form as soon as possible, and file it with either as per the agreement mentioned penalty or as per the interest rate given to some others in the order of consumer forum orders , which is generally 12% ,
      Do everything jointly to save the time and confusion , choose one person who can communicate properly in the IRP proceedings,
      This NCLT is drauclian law for home buyers , still after attaining the status of financial creditors, please write letters to PMO office and Law ministry, the law will get amended futher if people write letters, they read them and some day , some good person sitting on chair will take call ,

    Good Afternoon Sir, I bought a 2bhk flat in Supertech in Greater Noida which is still under construction. That complete project is under NCLT now. L&T gave 32 Lakh loan on my name to the builder. What is the procedure now.. Do i have to wait for longer period.. I have no hopes now and planning to give up.

      Kuch nahee milta NCLT me , Full Gundagardeee hai builder's kee . Ye Jaan bhooch kar , planning kar ke jate hai NCLT me , isme Jane se builder ko Fraud karne ki Saja bhi nahee miltee . Wo side me khara hoke tamasha dekhte Hain.
      It's very sad that Government had included Builder's company in NCLT route . It's a legal loot .
      Their is no relief as i think even the Big Politicians are hand in glove with such builder's , it can be relieved only if Supreme court takes suo motto cognizance and revieves all the builder's cases , how IRP and New bidders have looted commen man money .
      Try to get some link in Print media and in the Honerable supreme court.

      All to file .
      A) registration and possession obtained than file only for delayed compensation.
      B) only possession done ... File full but don't ask refund , ask for only registration and payment for delayed compensation.
      C) if not even possession, can file for full refund , if not interested to continue , with intersted. Interst to be calculated at the rate in which home buyers representative suggests ।
      All coc , participate on voting very closely , it's all eye wash activity, basically it's a very dirty game , in which home buyers have no control, the ship will move as per choice of banker and IRP .
      Let's form a group or s trend in social media , pan India level as in most of the cases decided home buyer is not given justice .
      The act needs only one amendment, that in case of real estate company going in NCLT , the promotor and all the subsidaries companies of the promotors and the directors of such companies, in which funds were diverted , should be attached by court and no moratorium shoud be allowed ... Serious legal action against the personal assets of such companies owners should be taken . First the owners should be put behind the bars , as in most of the cases , the owners take company to NCLT deliberately. They are looting the funds the home buyers and enjoying their all luxeries..... Why ..
      Why .... Not their personal assets be attached .

    Hello Sir , Maine 2015 mein builder se ghar liya bangalore mein..builder ne default kiya loan...now it is with NCLT....mujhe possession mil gaya tha ghar per registration nahi hua bcoz of noc from bank...ab agar company liquidate hoti hain then mere liye kya options hain....pls pla guide me

      First of all, you need to file your claim to IRP , since you have paid fully , hence IRP has to get it registered in your favour.

      Yes , definitely, if you can obtain a request from your college to NCLT adjucating authority, and it's at his discretion. But no doubt , you should try . It's a new field and very learning field.

      GBP has gone to NCLT,And Gupta brothers have left to Dubai.More than 2500 buyers are suffering from the fraud of crores of Rupees done by GBP. RP has been appointed now.What we can do now ? We are not hopeful for good results.

    Sir I am in rolta India Ltd we have not paid salary from 4 yrs we move to court in Feb 2021 , we got court order which told company to pay our dues but till date no dues are paid than we file contempt of court but our advocate sold out to company till case going on and now in jan 2023 NCLT ttok over. Now we don't understand what to do. We are in pressure as our whole dues are with company. Now we are 50 yrs and no company is willing to give job.

    Sir I agree with you, I m from Mumbai, i want to share my pain with you, and look after your suggestion,
    I was booked flat in 2012 with a reputed builder in Mumbai, with commitment to complete the flat in 2015. I was paid 80% on good gesture and reputation. But in 2015 i come to know that builders not started working and I was shoked. After long follow up with builder I was cancelled the MOU and got refund cheque with interest in 2018 June, and unfortunately all the cheque bounced.
    I filled the 138 case against builder in July 2018.
    And by December 2018 this company comes under NCLT,
    As on date there are not any disclosure about the company from NCLT, and my case is just pending, says unless the NCLT matter close director don't have any power, and unfortunately I will not be allowed any compensation in this period because matter under NCLT.
    If possible can you help me on this so I can call ur number.
