Hey Laura! Nice video! I thought I would add my .02 cents worth. There's another way to avoid probate if you have property. It's called a Revocable Transfer on Death Deed. I notarized sigs for friends a couple of months ago. Husband and wife held title as joint tenants. They each signed their own RTDD. Upon death of the first one, it goes to the other. Upon death of 2nd one, it goes to their 2 kids. No probate. Their total estate, other than the property, does not need to go through probate so the kids don't have to deal with all of that. I have other friends whose parents unexpectedly died within a month of each other. They could not make the house payments while waiting for probate to be done and lost the house to foreclosure. Setting up a trust can seem excessive for some but a RTDD would have given them the property and they could have sold it instead of losing it. Also, I am not an attorney and can not give legal advice.
Teri, sorry I didn't see your comment but I am familiar with this type of deed and have notarized it. This gives people who have a home but cannot afford a trust a way to leave their home to family without having to go through probate. However it is not available in all states, but definitely in CA.
Someone is asking me to notarize their updated will but they don’t believe they need witnesses. If I tell them they need 2 witnesses and explain why is that legal advice?
I have a question as a California Public Notary when notarizing a Will or Trust, “hypothetically speaking”, if I have 2 witnesses (everyone has their valid IDs and everything that is required by law) am I supposed to notarize the witnesses signatures as well? Do I need to record witnesses in journal as well if they are not credible witnesses ?
In Florida is a simple word document able to stand in court? What if the notary didn't date her stamp? Also when is it a conflict of interest in regards to witnesses?

Griselda, you do not have to be a loan signing agent to notarize a deed or any other real estate document. ANd Notary signing agent and Loan signing agent are the same things.

Depends on your state rules. Notary fee plus tiered travel if you are allowed to charge travel.
