    • @pirateadam3686
      @pirateadam3686 2 ปีที่แล้ว +23

      Pretty much. THere's some bits and peices about power outpu and whatnot, but the key thing is the pedals. If you can pedal it normally and the motor just provides assistance, then it's an e-bike. If you require the motor to make it go, then it's a motor vehicle.
      Oversimplifying, but meh...

    • @elijahhmarshall
      @elijahhmarshall 2 ปีที่แล้ว +2

      It actually depends on the state here, since ebikes are relatively new and not common in some areas, the laws can sometimes not draw boundaries between ebike and e motorcycle causing confusion. for example some states dont mandate pedals as long as the power output/speed is low enough, other states literally dont have a single thing in the entire legal code mentioning electric bikes whatsoever.

    • @elijahhmarshall
      @elijahhmarshall 2 ปีที่แล้ว +1

      @Dougal Douglas haha, yeah. I guess it can be confusing. Where I live there is basically no laws about it, so if what you are riding looks like a bicycle and you are going a reasonable speed, you will probably have no issues whatsoever, and if what you are riding looks like a moped/scooter and goes less then 30mph you will also probably have no issues, if what you are riding goes more than 30mph you will probably want to have it registered and have plates and insurance. This is because most cops will probably just try to apply our laws about regular motor bikes when dealing with you. Again, because my state hasn't actually written any ebike laws.

      Legal or not should not matter when you are on a motorcycle. Your life, and knowing that people are unpredictable, is all that should be taken into account. With that said, you should never drive a car or a motorcycle thinking you have rights. You don't. You have responsibilities. In most places, the first rule of the traffic laws is that you first and foremost have a responsibility to make sure the users of a road are safe.

You are to ride on the side of the road unless you are turning left or avoiding something o the side of the road. You can ride in the road if you can do the speed limit. This would be roads that have a limit of anything under 35. 3:03 this is a good advertisement for having bright and visible turn signals equipped. Yes, some older bikes do not have them, which leaves you with hand signals, but the hand signal should be held up to the point of the turn. If you're using hand signals, you have to be deliberate about it. Additionally, holding the right hand out is not the signal for a right turn. The hand signal for a right turn is: left arm out and bent up at the elbow, left hand straight up with palm facing foreward. Yep, Harley guy should have been paying more attention, but there are things we can all do to make sure we are clear about our intentions.

    • @JohnRunyon

      Holding the right hand out is a perfectly acceptable signal for a right turn on a vehicle with no cabin. In fact, it's a much better signal than using your left hand (where it may not be seen by people on your right side i.e. in the direction you're turning). However... turning right from the left side of the lane is a pretty bad idea.

    "Local and state regulations may vary. In general, electric bikes are regulated like bicycles. The same rules of the road usually apply to both e-bikes and human-powered bicycles. E-bikes are not subject to the registration, licensing, or insurance requirements that apply to motor vehicles.
    Many states designates three classes of e-bikes:
    Class 1: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 20 mph.
    Class 2: Bicycle equipped with a throttle-actuated motor, that ceases to provide assistance when the e-bike reaches 20 mph.
    Class 3: Bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the e-bike reaches 28 mph."

    On the e-bike, the first question by the officer was “Do you peddle it?” And the answer was “No.” At that point, it is a motorized vehicle only, not a motor assist vehicle - as he tried to imply. In my state, anything with a motor requires a license to operate. Small cc motor bikes operated on the road do not require a registration, but they do require a basic drivers license. You would need the M-class for anything over 49cc, as that would be a motorcycle. So this guy trying to convince the cop that his motorized vehicle is “just an e-bike”, as in electric assisted bicycle, is being entirely dishonest and he seems to know it.
    For the group ride twats: you know what also makes a good turn signal? Actual turn signals like those on road legal bikes. Yes, the one twat made a hand signal, with the wrong arm, from the left hand lane position for a right turn. He was already in the wrong having a illegal bike on the street, never mind not knowing the correct signaling for a turn. A dude who looks over 50, has no business riding with little kids.

    The Sur Ron ebike is a legal gray area.
    It's classified as a regular ebike, unmodified. As it doesn't achieve speeds higher than 35 mph stock.
    Because it's electric, it's basically a big scooter, but also like motorbike by appearance. It both is and isn't street legal. Which is stressful if you don't have a pedal kit installed on it. I feel bad for the dude 8 at 6:36. PEVs (personal electric vehicles) are still very niche and likely won't get more legal mandates until they're a *LOT* more common in places especially unknown for having rental EVs on street corners.

The officer did not know if he was committing a traffic infraction so if they are not in a stop and i.d. state then the rider would not have to provide identification as he was not or not about to commit a crime. What he should have done was look at the traffic code with the rider and find out. They would both learn something and no identification would be required to do that

The cop can definitely ask for an ID and see if the rider has a registered motorcycle and tell if the bike is a bicycle or an electric motorcycle. I'm sure if someone wanted to hide their vehicle specifications, they would lie. Could have avoided all this by just IDing.

      They can ask but unless you’ve committed a crime, they can’t obligate you to show ID which is what that cop was doing. The laws would define what an e bike is which is what the cop should have looked into first. If determined it is a vehicle requiring registration THEN you would be obligated to ID.
