The violin may have been appraised at $15,000. but if no one would be willing to buy it at that price, the appraisal is not worth anything. Values for certain items goes up and down based on what people would pay for it. Watch revisit episodes of antique roadshow where they show earlier appraisals and then show if the value is higher and lower to get the idea. If she thought the violin was worth $15,000. she should have insured it for $15,000.
I think she's saying the violin is now worth over 14k. So she is suing for the difference. She needed to purchase the violin first and then sue for the difference. She actually underinsured her violin and that is her fault. No $ for her.

I am 69 and I started my violin lessons at 9 years old, my parents took advice from my teacher, Mr. Christianson, they bought me a new violin but a good quality violin from Italy, a Stradivarius knock off, it cost $300.00 it 1964, and a the lady said, good violins are worth more over time, especially a violin made by a specialist. I just got another violin 🎻 in September, I am going to polish up, so I can give my granddaughter violin lessons, she just turned 7 years old.

But this garbage of a man had it gold plated and put in a glass case for display. It is entirely ruined! It's not playable and it has no value! Like who the hell ruins one of the rarest and most perfect instruments just to keep someone else from having it especially the someone else being family!

I didn’t want to wait. I didn’t like violin and wanted to switch to flute but because my mom paid $500 for it, she wouldn’t let me quit. I was forced to play for four years. The way I finally got out of it was when we moved to a small town, and she couldn’t find an instructor less than half an hour away. I didn’t even pretend to be sad. She eventually gave it away to a cousin. Years later I took up guitar. I absolutely love playing guitar.

Because she UNDERINSURED her violin. Even if the appraiser had come to testify as a witness, JJ's approach would still have been the same because her insurance paid out. So the appraiser being her witness (and her appraisal for that matter) only CONFIRMS the fact that she underinsured her violin!! It does not help her case .. It actually hurts it!! Plaintiff is the PERFECT example of the fact that when you insure a personal item, you really need to check it and have it appraised every year in case you have to increase your insurance on it for replacement value!

JJ is actually wrong on this - if the woman decided to sell that violin for $11500 before it was damaged and replace it with a $5000 violin and spend the difference on a gold kazoo, that's her prerogative. She's entitled to the value of the violin at the time it was damaged even if she had no insurance at all (it's not required on musical instruments even if prudent). Establishing the value of that violin though is the crux of this case. What hasn't been discussed is what a luthier would charge to repair it (it's not that difficult really).
She said at the start it isn't repairable. So what she needed was an expert witness to educate JJ on the value of the violin. Or she needed to have bought a new violin, sadly we know the maker of that one is no longer around, but if she had done that with the insurance check and added money to it then JJ would have proof of the value and she would win. You can't go to court and expect the judge to take your word for it that you should get another $4000. Appraisal letters can be faked which is why they aren't acceptable on their own. You have to properly prepare for court as you only get one shot at it.
Finally, a case without a Pitt bull or an uninsured driver!

Who cares how much the value increased JJ, she is asking only for 3500, that is much below the value. Just grant it to her!
JJ is actually wrong on this - if the woman decided to sell that violin for $11500 before it was damaged and replace it with a $5000 violin and spend the difference on a gold kazoo, that's her prerogative. She's entitled to the value of the violin at the time it was damaged even if she had no insurance at all (it's not required on musical instruments even if prudent). Establishing the value of that violin though is the crux of this case. What hasn't been discussed is what a luthier would charge to repair it (it's not that difficult really).
She said at the start it isn't repairable. So what she needed was an expert witness to educate JJ on the value of the violin. Or she needed to have bought a new violin, sadly we know the maker of that one is no longer around, but if she had done that with the insurance check and added money to it then JJ would have proof of the value and she would win. You can't go to court and expect the judge to take your word for it that you should get another $4000. Appraisal letters can be faked which is why they aren't acceptable on their own. You have to properly prepare for court as you only get one shot at it.
