Based on the current law I think the cops are right. But the ATV rider says he registered the bike as street legal so he can ride on public road. I’m not sure if an ATV that is registered as an street legal are allowed to ride on public road and street or still have to ride on public unpaved road.

And btw, he was the one that asked the cops if he could pull over to avoid blocking traffic. Neither are motorcycles the distinction in most laws across this country is that 4 wheels makes it a "car" and subject to all the federal requirements to be street legal. That's why you see all these Polaris trikes popping up. They are cars, but that fourth wheel is taken off to bypass the laws.
