Registration of Sports Clubs In Kenya

The Sports Registrar is an office within the Public Service. The Sports Registrar is responsible for the registration and regulation of sports organizations and multi-sports bodies representing sports organizations at the national level, the Sports Registrar is also responsible for matters relating to the licensing of professional sports and professional sports persons among other things.

I however disagree that a sports club becomes a separate legal entity on registration. The Sports Act doesn't expressly state so. This is just registration with the Sports Registrar as a sports organization. I believe for it to be a legal person capable of suing and owning property in its own name, it has to be incorporated under the Companies Act. Thoughts?

Thank you for your response. You are right the sports act does not expressly say so however sports clubs have enjoyed some of the benefits of a company,For example we have cases of Gor Mahia being sued and suing federations e.t.c and even AFC leopards owning property. Some sports clubs are functioning as businesses in their current state. There are sports clubs registered as companies,the registrar of sports writes letters of no objection.
