As is usually the terms of the lease.
I have MS (Multiple Sclerosis) and my neurologist ordered a 🐕‍🦺 service animal for me, which needed to be a SMART dog 🤣 (so a little chihuahua wasn't going to do, obviously)... But my landlord had said NO! NO PETS!!! 👿 We were trying to work WITH her and not make it get ugly. But eventually had to point out the both the Ohio law AND the requirements of ADA (Americans with Disabilities Act, which is FEDERAL). This simple statement silences ALL PIEHOLES:
"All terms of lease or building occupancy which prohibit the presence of professionally trained and properly registered canine service animals assigned to the service of their handlers, who are individuals with qualifying disabilities and/or needs, on or about the premises are void."

I work as a landlord tenant attorney. There are many things you don't want to mess with as a landlord and one of those things is the security deposit. In some states, a landlord can end up owing a tenant 3x the security deposit if they play games like these landlords are.

One potential problem is even winning in court may not get the deposit back....especially if landlord is in a different state than rental, so small claims judgement does not help when the landlord ignores it...a bank sweep does not help with landlord in different state, a lien on the property does not help if the landlord is not selling for years. Tenant never gets the security deposit.
Another example, we won judgment against a contractor for the maximum $10,000 and we are still trying to collect over ten years later, despite an unsuccessful bank sweep and lien on contractor's property...hard to squeeze blood from a turnip.

Even then sometimes they try to pull stuff when the place is spotless. I moved out of one place and had two weeks left on the rent. When I came to clean, the landlord had allowed their cleaning staff to come in when they were not allowed to enter. They stole my vacuum broom mop etc. I went down and chewed him out for allowing them to enter illegally when I still had two weeks of tenancy. They had done less cleaning than I would have also! I ended up with every penny back and the return of my property. I told him I was filing a police report otherwise as he aided thieves in entering by giving them a key!

This one hits home for me, as a one time renter. I was leaving a room in a house, I didn't even get to the point to pay rent. I moved out before. But I knew I needed to leave that room, the same way I came in. Clean . I was told by the homeowners that I could leave a bag of trash in the room and they would dispose of it later. We didn't have the time to move my bag of trash right then and there, so they told me I could leave it. I wiped down, swept and made sure that room looked better then when I left it. But in the end I got blamed for a bag of tied up trash! and money they owed me in the end. I've learned so much from that situation. None of it never again. And the landlord sounds lax, then wants his money later. When never deserved. If she left the property in good standing then at least as a landlord you have to make it presentable for the next person and you should have a little chunk of funds to be able to support that

Or just leave without paying the rent that equals the deposit since that's the game they force you into.

When I was younger, my mom cursed out my landlord because he wouldn't give me my deposit the day I moved out even though he was there and able to inspect the property fully. She did this because, as a young mother, she would get screwed out of her deposit time and time again.
The landlord gave me the deposit weeks later, but I'll always wonder if it was because my mom tore his ass out 🤣

Oof i remember my first time i got to rent a room when i was young. Apparently there hasnt been water for 2 days and the landlord didnt give a shit. Always wanted to be paid in cash because for sure the moment he got it on his bank the company that delivers g/w/e Takes it from the bank and he doesnt want that. Luckily my dad was with me and he kinda forced him to fix this problem immediatly and not in a few days, which was an obvious excuse. Luckily i lived there only 4 months until i found something new.

In Australia, your only obligation as a tenant is to leave the property “reasonably clean”. There is no tribunal here that would have thought otherwise of those photos.
Also in Australia, you are NOT required to steam-clean carpets unless the agreement you signed at the time of the lease lists it as a requirement - except in NSW, where they can’t make you do it at all.

When I used to rent I always ALWAYS insisted that the landlord walk through the place with me on the day that I moved in and on the day that I left.
On one occasion we got to the living room where the landlord had written that there was a stain on the carpet when I moved in .. and it wasn't there anymore .. and the landlord actually said to me ''There is supposed to be a stain on the carpet by the window'' in a way that sounded like he was going to charge me because I had cleaned it off 🤪 !

I have my past apartment trying to charge me an additional $600 on top of the 1200 deposit they decided to keep over supposed damages, yet when i ask them what damages and for photos they can never seem to show or prove it. Im at the point of wanting to take them to court as well over this crap. The few pictures that were hung up were patched, i had a professional carpet cleaner come out and do the rooms and the rest of the place was laminated wood which i mopped before i left. Most landlords ive encountered in my life are so scummy.

I just don't understand how when Landlords see damages to the house like stains and cracks, they blame their tenants? How are they so sure it's not regular wear and tear from the age of the house?

  • @cynthiatolman326

Landlords will keep deposits to use to do things that are their responsibility before they move in another tenant. It's wrong, and illegal.
