- Rep. Alexandria Ocasio-Cortez was mocked online after she claimed “RICO is not a crime” during a heated exchange Wednesday with President Biden impeachment hearing witness Tony Bobulinski.
Ocasio-Cortez (D-NY) asked Bobulinski, a former business associate of Hunter Biden, whether he witnessed “the president commit a crime,” seeking to rebuff GOP narratives about the Biden family during the second public impeachment probe hearing.
“How much time do I have to go through it,” Bobulinski shot back before listing off several items such as “corruption statutes, RICO and conspiracy, [Foreign Agents Registration Act].”
“What is the crime sir, specifically,” the progressive darling pressed again.
“You asked me to answer the question. I answered the question. RICO, you’re obviously not familiar with. Corruption statutes. FARA,” Bobulinski replied.

And RICO by itself is NOT a crime, it is a statutory framework used to prosecuted all participants in a criminal conspiracy equally, not allowing the higher-ups (e.g. the mob bosses) to avoid personal accountability. This is why RICO is being used to put Trump in JAIL in Georgia.

One has to commit “at least two acts of racketeering activity” drawn from a list of 37 federal crimes within a 10 year period to be charged under RICO. She’s spot on correct.
I believe RICO is a federal law but it is not a specific crime. It's a blanket term used in prosecution, and AOC was clearly asking if the witness can testify that he saw the President commit a specific crime. Seems like an easy question if you actually witnessed a specific crime. For example, Trump is facing a RICO charge but he's not being charged with "committing RICO". Trump is being charged with "knowingly and willfully joined a conspiracy to unlawfully change the outcome" of the 2020 election in Georgia... That is considered one of many types of crimes under the category of RICO crimes. I'm not a lawyer so maybe I'm missing something but this seemed clear to me after 10 minutes of reading about RICO crimes.

RICO is NOT a crime: it’s an ACT. There’s one in Georgia and a handful of other states, as well as the Federal RICO Act passed by Congress in the 1970s. Where do they find these witnesses? 😅
The RICO Act was created as a way to litigate against organizations that engage in racketeering activity. For those of you that don't know, racketeering is a broad term that defines different types of specific criminal activity. AOC wanted to know what the specific criminal activity was. If I said, "Hey did you see that? That guy just committed Rico." What would that look like?

AOC was correct in her description of what RICO is and the witness was unable to answer her when asked what specific RICO statutes had Biden violated. He just blathered "RICO"! There are 35 separate RICO statutes, and this witness could not describe nor name even one of them that he claims he witnessed Biden violating. Compare that to trump in Georgia, where very reputable witnesses, some lifelong Republicans with impeccable records, gave grand jury testimony about numerous violations of that State's 50 RICO statutes leading to 41 charges against trump and against his co-conspirators.
