But the State and Licensing Boards need to recognize their duties to protect the interests of residents, not their licensees! Provide user-friendly information for people to verify what they dont know. Get out and do some outreach! Educate, advocate for victims instead of lobbying for insiders! Ive been in New Mexico for 2 years, and the lack of accountability is frightening!
I'm confused, dont they require hvac licenses for installers in NM? Why didnt the end buyers ask to check the license? Manufacturers will not sell units to unlicensed installers because of warranty liability.
My mind is blown that not a SINGLE one of these people asked for proof of a license or previous work. When you are going to drop that kind of money you want to feel some kind of reassurance that the work going to be done, will be done correctly

All the victims are older people that surely should have had some life experience in dealing with home improvement installations. Why did they not ask for license checks and local permits plus inspection on completion before paying anything. Chances are they were gullible enough to pay prior to the work. Not saying they brought it on themselves remember Buyer Beware and If something sounds too good to believe, just walk away.
As soon as he said he's installing goodman people should have got another bid. People don't realize but most of the guys who install only make $12-$17 per hour, lots of installers just wanna finish the job and move on. Installers are always the low man on the totem pole and are often fresh out of school and are under trained.
Most of these people hired the guy because he was "cheap"!! LOL! But--having a "license" means nothing in itself. I know plenty of "licensed" persons who are hacks at the work---but they have a license!!
They kept talking about poor installations, bad installations, in proper installation. They never said anything was wrong with the equipment, why couldn't they have simply fixed what was there. Should have been able to Simply reduct or adjust what was already there. Replacing all these units seems a bit extreme.
How could they be sure that the equipment was 100% safe after the mayor and the installer were proven to be crooks? Not worth the risk imo, better to rip it out, start over and be sure it’s safe.

Might even take two or three professionals to give estimates, to be sure you're getting an unbiased opinion. Many installers or service people don't like working on other brands or fixing other people's work, so they will gladly have you throw thousands of dollars worth of perfectly good equipment in the trash, and then they can get additional profit to replace the equipment and have it simpler for them.
Problem here is that these folks are older and are selective about who they let into their lives. Meaning that few people get across the threshold and poke around. We all hate busy bodies and and Nosey Rosies, but some people know their stuff. I fixed my sister's basement stairs and four months later, she was a jury member in a civil lawsuit because of injury from...an attic ladder that exploded with an inspector three rungs up. A home is a party-time job, due diligence is key. Just brain damage from CO is pretty serious.
There would be no reason to replace the equipment unless it was not properly sized. Might have been installed wrong but corrections should have been able to be made so they didn't have to get new equipment. They always overblow this type of thing.
The person who installed the replacement ones is probably as dishonest as the 1st guy, and got 1/2 them people to just give them the units ,then he resold them

Flue, electrical, drain and duct are all correctable. It's not like he cut a hole in the heat exchanger. These people don't understand all of this and trust the state and their minions. I do understand all of it. I've done HVAC for 40 years and I say they scared everyone into buying new equipment. Not my first time at the rodeo.
Perhaps it's the cynic in me, but all of these 'victims' seem pretty well to do... summer homes, business, etc...... just makes me wonder what he did to get a smearing from these 'illustrious' 'citizens'.......... (maybe I'm wrong, and Bob's kosher looks have my Ash detector going off, but I smell a rank fish)
