    The minute the landlords lose their ability to collect rent (that is not actually being paid) based on government moratoriums, should be the minute the landlords no longer need to pay property taxes (and possibly mortgages).

      @@dwaynegeejr renters are the ones paying the mortgage. They are kept from getting ones of their own because of the structure of housing under our current system. Don't have a large sum of money to make a down payment? No house for you. Even if you have shown the ability and reliability necessary to pay monthly payments on time. Better question is, if landlords are so capable, why don't they just pay the house off before renting it out. Oh, they can't. That's why they get a tenant. So they can have someone else effectively paying for the house while making a profit on top.

State suprememe court shut that racketeering move. This current stunt is causing detriment, and it's wrong.

    Now, I understand why my brother sold his apartments. He was afraid that tenants use covid protection for not paying rent. Also, property taxes here are ridiculous. On top of that landlords need to pay a percentage of the earnings. This sux 😔

    This is EXACTLY why there is a housing crisis. As more of these things happen to the mom and pop landlords, they are taking their houses out off the market. Then all that is left are the corporate landlords who can charge those outrageous rents. Those are the same corporations buying up the houses with "cash".

    Exactly. This is happening to me, too. I have a housemate who won’t pay, won’t sign her portion of the rental assistance, and hasn’t signed a declaration of hardship. Me and my kids (I’m a single mom trying to hold on to my house) have to live with this person with no money and she refuses to leave. And there is literally NOTHING I can do about it because of the eviction moratorium! This is messed up!

      Here is a proposal for those landlords whose tenants are thumbing their nose at the landlords who think they can get away with never paying tens of thousands of dollars in rent that they owe, I'd like to suggest that you consider 1099ing your deadbeat tenants. According to the IRS, nearly any debt you owe that is canceled, forgiven or discharged becomes taxable income to you. If the landlord doesn't feel they have the funds to sue for a judgement about the unpaid rent, this is another avenue to consider taking. True enough, you won't personally get paid, but it is a way of giving a well deserved consequence to the tenant. You report to the IRS the amount that the deadbeat tenant has failed to pay. You also report the amount they owe you for property damage if they trashed the place after eviction. If you have not sued for the money and instead chose to discharge the debt, the IRS will in turn count it as income for the tenant. The tenant will then owe the IRS taxes on the amount of rent for which they stiffed you. And despite the fact that there are plenty of state laws that let tenants stiff landlords, there are no federal laws that let tenants stiff the IRS on paying tax on the debt they owe you, which will be viewed as income by the IRS. Speak to an accountant about it so that every penny they owe you for unpaid rent or property damages is counted as income for them by the IRS - income for which they will have to pay federal and state taxes. It may trigger other consequences for them, especially if they applied for federal funds to pay rent, but then used that money to buy TVs or go on vacation. It will cause their income from prior years to be recalculated, and they may then owe back taxes for the portion of income they did not report (recall that the unpaid rent is viewed as income by the IRS).
      I'm not guaranteeing this will work in all markets, but suggest that you run it by a local accountant and a tax attorney.

    I live in NY. And I had a tenant who I would see leave for work everyday..his wife and son wear working daily as well..nothing changed during the pandemic yet they refused to pay me rent because they “ could”..as soon as I was able to , I kicked them out..the wife started crying and said she would pay me the full amount in cash immediately…that actually made me more furious because they were saving money instead of paying me..they had a very affordable rent for a house that I could have EASILY gotten 1500$ MORE but I felt bad because they had small kids ….but they were saving all the money, and causeing me to lose my income while they lived in my property for FREE for. A year…I will never ever rent to struggling people…the tenants I have now are a younge professional couple who worry about their credit score and I learned my lesson to never help losers again

    The landlord shouldn't have relied on the tenant providing the credit report, which turned out to be fake. They should have done a credit check themselves. Live and learn.
    Still even when a potential tenant checks out good, they can still fall into hard times, then their problems become your problems. One of the perils of being a small landlord.

      Yup you always get an established real estate agent to do a full background credit check on who you rent to....even if you have to waive that first month of rent to the agent. Have never had issues going this route as a landlord.

      Do you even live in Bay Area? Do you know what is the situation of the house right now? You all just counting rent, who is paying the property tax? Who is taking care of the repairs and utilities? It’s really easy to say when you are just the tenant. When you work so hard to buy a house and put it on rent, it hurts when all the hard work just goes to waste. And talk about $44k county gave, well, that might be a taxable income, so they literally might not even get anything out of it .

    These cases make me so mad. My mother's life has been turned up side down due to these type of tenants during the pandemic. People don't have compassion for landlords. My mom has huge bills to pay and because of these type of tenant she can't sleep, she's suffering from severe anxiety, and other medical problems due to anxiety. Hiring a lawyer is no good, just more money the landlord has to pay. Essentially these people can literally take over someone's property without any consequences. People like my mom and the family in the video save and borrow money to buy these properties as a financial investment, you hope you will be able to use the rent to pay for debts or your retirement. lawmakers have to do better for small landlords. It's infuriating.

    Better to not leave it to chance and hire a real estate management company to properly vet the applicants. It's not cheap but I think it is better long term.

      Lower your rents so people can afford it.
      This is the main reason tenants stop paying rent it's because it becomes unaffordable.
      If you need extra money you can get a job.

    He gave us fake income documents and credit report? This really sucks but honestly with such a valuable investment I would never cut corners in processing someone's application. A simple credit report and verification of the information on the application could have possibly saved them the trouble.

      As a property manager/ leasing agent i can say you’re completely right, no experienced landlord would approve someone without running a credit report for $40 that you charge an application fee for. That said there are many people living at our properties that did meet all the requirements and are taking advantage of covid and owe 100k+, the alameda county eviction protocol is insane

I Have some old nightmare neighbors that racked up rent charges since March 2020 and with drug money they were able to rent a really nice house thanks to the mom having a job at target and the son having the money upfront. It was thru a property management too so you know they doing dirty cash deals as well.

How many investment properties do they own? How did they finance those properties. Were they truthful on their loan applications? Do they have problems with other tenants? I see mom and dad live with them. Did they bring them over to the US and put them SSI? I'm not saying these people are grifters, but I want to know the whole story, not just one side. I've been around long enough to know when someone cries this much about getting burned it's because they thought they were getting over on someone else and that person turned the tables on them. Just sayin'.

      Mortgage and property tax is easily more than $4000 a month in Fremont. It may not even be profitable to begin with, unless house was purchased over 10 years ago. Let alone the 30% downpay owners put into investment.

    I live in a different state, Arizona, but even when we had a moratorium against evictions to at least pay something. We somehow only managed to be late once this whole time. Even though my mom lost clients due their parents being stuck working from home and doing online school with their kids and me losing out on photography and videography gigs after graduation, we still managed to pay our rent. People were getting that extra $600/week in unemployment and the stimulus checks. Instead of doing the smart thing with that money and either save it or use for bills, they chose to waste on frivolous stuff like new TV’s and gaming systems. Even if you didn’t lose your job, it was still smarter to put it away and save it.

You clearly know nothing about how many people spent their stimulus checks (& 'interesting' attempt at making it seem like it was multiple checks ppl spent on TVs or whatever other made up luxuries you suspect all those people spent their miniscule funds on: it was all of TWO checks given out over two YEARS $1200 and $600-800 with a third stimulus in 2022 that many didn't even get ) Wow a bonanza windfall for all the lazy delinquents around the country!
      With rents in most cities what they are (& which this video is an excellent example) incredible high, most often that wouldn't even cover a lot of people rent or food bills) So the money would ve been spent with a month or two. Fremont is 7% higher than national avg for total, 57% LOWER than national avg for violent crimes, and 20% higher than national avg for property crime (makes sense, rich neighborhoods). Lived here and other places and one of the safest cities hands down. Wouldn't change it for anything. If any of your stats were correct the avg house price wouldn't be $1.5+mil. Last shooting was due to a personal matter in a family and that too in March...don't spread false info

    There's a bigger problem here and it started before covid.
    Nobody has money! You need 2 jobs just to survive! And you still don't have money!
    If I don't have money, I can't pay rent. So my landlord evicts me. Then I move into one of the many homeless camps popping up nationwide.
    Meanwhile, my former landlord can't find a new tenant because nobody has money to rent the place I used to live in.
    Now my former landlord loses money and decides to sell the property. But nobody has money to buy the property. So my former landlord is house rich but cash poor. My former landlord can't eat a house.

    EVEN if you pull a credit report today, courts are NOT reporting someone being removed for failure to pay rent and it's literally wiped off their records if they leave. This is the reason people are selling their rentals and there will be a glut of homes on the market soon.

It may be a Covid thing, since the different states do not want to make it difficult for the non-payers to find new housing, literally keeping landlords out of the loop, so states don't have to rehouse them on their dime (imo).

      I don't know that courts are not reporting eviction, but the landlord and leasing companies can and do. They can sue for back rent and if it's not paid, it goes on the credit report.

It's amazing to me that we never hear about what became of the finances of people who didn't pay rent for 17 months during the moratorium. There's no way they paid back 17 months of rent once it ended, and many didn't get rental assistance from the government to pay it back. So do they just have a big delinquent debt on their credit report? Are collectors going after them? Are they being sued by landlords for the back rent? It seems like a completely unreported story

    I’m a landlord in and same here in Hamilton .A criminal who’s not giving rent for past 5 months, growing marinjuana , messing up with neighbours , damaging property..no action yet..!!!
    Still waiting for hearing date and he happily continues there..
    When I study many of the cases, all the landlord VICTIMS are IMMIGRANTS including me..! Which is Terrible fact 🤬and the LTB or government is taking no action..

    The obvious solution here would be to advocate for those loopholes to get closed. And somewhat surprising that fraud doesnt invalidate your protections.

    Thank you for sharing your story. This is one of many other cases where landlords are being abused by tenants and the looseness in the terms laid out by the Eviction Moratoriums accross the State of CA. There are many other landlords on the verge of losing their homes, having to share their home with abusive tenants, or have to compromise their lives because they cannot evict non-paying or bad tenants.

And now everybody received a letter saying the bldg will be inspected for sale. It's the 3rd the bldg changed landlord. The 1st landlord sold because of will split, the 2nd landlord refurbished the bldg and sold, and now the 3rd landlord wants to sell. I wonder are we having tenants here that did not pay the landlord.       we have to raise our rent by 20% this year because our property taxes were raised, repairs after last squatters/tenants left was $20k for just a 1 Bedroom apartment. if we don't raise rent, we cannot afford to rent it out. We had to use our own savings for the previous repairs.

    This is obvious criminal fraud. The CDC says there are ways to evict the tenants such as if the owner wants to move into his home, if the owner wants to do extensive renovations, and if the tenants are breaking any rules such as allowing people to live in the home that are not on the lease which is happening here. They should look into this because if those tenants are subleasing to other people they are breaking one of the rules that could have them evicted during a moratorium. At least that's what the CDC said.

      Thank you I said this when it 1st started. And then there wouldn’t have been a need for skyrocketing rents, and housing shortages. But this was planned. So good luck when the large corporations take over & only offer up luxury apts & no longer take sec. 8. Which is what’s happening & I cheer them on!

      @@Blah-blah-sure Planned or not there are idiots in government. They are to blame for this and I hope landlords especially private one's sue them for this. They act as if they are naive to people wanting money and not doing the right things with it. Unfortunately, you have to treat some people like children and make decisions for them and giving rent relief to those renters was a really dumb idea but it is as if the government is throwing money to the financially illiterate who will not make the best decisions. Which is why this should have been for landlords. A lot of schemes and scams due to no real planning and oversight shut out those in need. They do it for welfare which allows people to live off of it without pursuing better for themselves, totally disabling them. I've seen it from all walks and backgrounds too. The tough parents are going to have to step up in government and stop being Charmin soft.

      They're saving up to buy the property from their current landlords, who will have to foreclose or sell the prop to the non-paying tenant. The tenant will buy the prop at a steep discount. Smart cookies, those tenants.

    My manager kicked me out after I owed 800 and I was gonna pay him next week I lost a job and it took me a while to find one that guaranteed full time but I only owe him $800 I know he kicked me out illegally but he’s a drunk with guns so I left I wish he could see this I been working during the whole pandemic paying rent on time

    Well… My sympathies to these landlords. I can’t believe (Although I knew, sadly) That there was nothing about requiring tenants to pay a portion, a fraction, whether it was 25% or 50% of the rent, to avoid eviction- Of course, more so if they had not lost actual employment!
    It’s probably not much consolation, but when they finally get these dang thieves out of their property, at least if they go to sell it now it has probably gone up in value at least $80,000 or more over the past two years due to the insane increases of Bay Area home prices. I wish these landlords the best

      What most fools don’t realize is that when they finally do get evicted no body will take a chance on them. And as I know the longer u stay the more rent you’re going to pay. This was planned by our government it screws the small landlords who offered better housing in most cases. Ex. I had rentals for $825.00 per month, 2 bedrooms. Well I got screwed. Now just Googling 2 bedrooms for rent shows $1,200-2,000. Easily and those are even no vacancies. So bad tenants aren’t helping the few decent ones. Btw I just keep mine vacant n smh.

      Nobody is forced to live in Silicon Valley and the Bay Area. They can always move to a cheaper city snd state if they want cheap rent.

    They should never have taken a credit report, they had to run one themselves after verifying identity. I purchased a 4 apartment home just before the pandemic. My first time as a landlord. I trusted no one, and for my first tenant I asked for state ID, SS, employer name, pay stubs, bank statements, previous landlord, references, etc etc....I ran the credit report myself. I called the employer, I called the former landlord, I called the references, no stone unturned. It helped that she was a medical professional. I did fine even though with all that I could have still ended up with a non-paying tenant. For the other 3 units I did AirBnB and (I am in NYC) no stays longer than 30 days, I max at 28 days to be safe because upon 30 continuous days of occupancy they gain tenant rights. My 3 bedroom 1.5 bath for the tenant rents for $2,500/month but the same AirBnB which is usually booked solid gets me $4,800 a month, same with the other units. Why would I ever deal with tenants after this.

      @@Iceyfire12 Not sure what it is for other people but my units have a single LED in each room, plus an LED lamp in the living room. That's 5 bulbs and most are off except kitchen and living room, so where is the huge cost? Guests are out most of the day so lights are off. Water? I have a standup shower in each unit with and everything has water restrictors so no huge cost there. The things you mentioned add very little cost.

      The renters likely owe thousands in late fees. If you are months late, just paying back normal rates isn’t good enough. The rent is based on on-time payment. The owners would have late fees and penalties on their mortgage and property taxes.

      courts in Alameda County is not issuing summons for that as well. my Uncle applied 7 months back but nothing yet. Top of that he needs to pay good amount to renters in name of relocation.

    I know a friend who is going to law school at the moment. He squatted a Motel 6 for a year, and even helped a bunch of friends squat rooms in the same motel. The motel eventually stopped allowing anyone to stay 13 days, the cutoff for the protection in Washington. He would then go around the apartment celebrating his victory and egg the owner on to harass him, so he could document the harassment and "justify" his non-payment.
