    Love the context. Just a quick question, why would he need to get funding for emd? Why wouldn’t he be willing to put up the 2k himself and save the additional 2k he has to pay you. Sounds to good to be true

    Hooold up. This one though, doesn't make sense. You are telling me, people are paying a $4k fee to roll $2k into an escrow account with 100% refundable contract the seller is signing? Why would anyone do this? You are not required to write in earnest money into the deal, its just a standard practice in real estate contract. As a seller, you may as well just require no earnest money to begin with. Win-win. I get the buyer might not have the earnest money but, if that's the case, then they probably also don't have the down payment either; which is way more than $2K. There are no more 0% down loans unless you are talking about VA lending.

      I know this is not a new comment I'm responding to but for informational purposes I am going to answer this. An earnest money deposit (EMD) in real estate shows the buyer's good faith and commitment to purchasing the property. It demonstrates seriousness, provides assurance to the seller, and may compensate the seller if the deal falls through without a valid reason. The deposit is held in escrow until the deal is finalized. As a seller, you would have no incentive to hold the property while the deal goes thru to closing and the buyer would have nothing to lose by pulling out of the deal for less than ethical reasons if there is no earnest money.

    If I have an LLC for my consulting business that already has some credit, can I just do some gator lending from there or do I need to create a new LLC expressly for the purpose of gator lending?

      I'm not an attorney, but if I were making that decision, I would ask myself if litigation happens due to the Gator lending, are there any assets in my original LLC that could be gone after? That said, even if there were no assets at risk in the first LLC, I would create a new LLC with a separate bank account just to have cleaner bookkeeping.

      Start with what you have, and then form a new llc from some of the proceeds of your first deal.
