But to say inventions are invalid because they exist in software is nonsense. Why can some one redesign a lever and then patent it? But someone derives an algorithm to execute in an application unlike anyone else and that doesn't quality for a patent. His major problem is not with software patents, its with the issuing of software patents. No judge should have ruled adding wireless to already existing process as a patent. To qualify a patent, it has to be unique and unobvious, and that idea doesn't qualify. There needs to be some clear guidelines in the judicial process of a patent. That "idea" that was patented should have been disqualified as a patent due to natural progression.
