I make many jokes about corruption, but it is actually a super serious issue. Bribery is destructive on all levels. You may unknowingly be part of it, but you can knowingly end it. If any of your employees commit bribery, you as an employer may be charged under Section 17A. Without education, anybody is at risk of unknowingly committing bribes.
Seksyen 17A of the Malaysian Anti-Corruption Commission Act 2009 was enforced on 1st June 2020. Under the Section 17A, a commercial organization can be charged with a criminal offence if an associated person commits an act of bribery or corruption for the benefits of the commercial organization. If a commercial organization is convicted, the Directors, controllers and officers are liable to jail term of up to 20 years, and/or a minimum fine of 10 times the value of the gratification or RM1 million, whichever is higher. The only statutory defence available is for the commercial organization to prove that it has in place “Adequate Procedures” designed to prevent persons associated with it from committing the corrupt acts.
