Caster Semenya wins appeal at European Court of Human Rights over testosterone rules

Caster Semenya has won her appeal at the European Court of Human Rights (ECHR) to challenge whether her rights had been infringed by rules requiring women athletes with natural high testosterone to reduce those levels through medication.
The ECHR ruled she was discriminated against and there were "serious questions" about the rules' validity. World Athletics, which enforces the regulations, said in reaction to the decision that its rules would remain in place.
Tuesday's decision could force CAS and ultimately World Athletics to re-examine the regulations, although the path and timeline to a possible rollback of the rules is unclear.

I thought you weren't allowed to take drugs if you want to compete at elite level competitive events.
Not all drugs are banned particularly ones that have no advantage to performance or are for genuine medical usage.
Im glad she won the appeal. I can never understand how politically you're claiming men have no advantage and allowing born men to compete in women's sport, while at the same time saying hight testosterone is an advantage and trying to ban born women from competing, just because the look manly and have higher than normal testosterone. Its one or the other but it can't be both!!
He has XY genes. His condition ( 5-ARD ) only effects males. He has internal testes. He has literally fathered kids through sperm extraction and artificial insemination into his partner.

It's thanks to XY people with testes like Semenya that other XY people with testes (the male gonads that produce testosterone and sperm) have been allowed in the female category.
Semenya only was barred on some female competitions because enough XY people with testes were winning over women..

Caster Semenya is intersex, was born with XY chromosomes, and naturally produces more testosterone than most, if not all, females competing with her. While I absolutely accept that she was assigned female at birth and identifies that way, it still can't be denied that Semenya has clear biological differences and natural advantages over other female athletes. Sport is, or should be, about fair play and fair competition. It's not Semenya's fault that she is intersex, but it is also not the fault of other female athletes competing with her that she very clearly has natural advantages over them which ultimately, no matter what way you look at it, is not entirely fair.
There's a doubt Semenya identifies as a woman much outside of sports. S/he keeps a low profile, but has fathered two children and appears much more comfortable with a masculine presentation.
This is just a question, but if you say natural physical adaptation that create competitive advantages like naturally producing more testosterone than most creates an unfair advantage doesn't this take us to murky territory where other naturally occurring advantages like height, or something similar to Caster, are used to discriminate against athletes? I guess my question is where do we draw the line, for a girl like Caster who dreams of being a competitive runner, in light this ruling that affirms that what World Atletics is asking her to do to live that dreams discriminates against who she is what is the answer simple no, you are a "freak" you may not?

@@bandile126 We categorize based upon biological sex since we know that T is the primary difference that has a huge statistical difference in performance. Within those two categories we celebrate biological advantages thus we don't categorize based upon height, etc. "She" is XY 5-ARD - a male with a DSD.

So a woman who was born with a vagina must be assigned male because they have a XY chromosome even though she wasn't born with a penis?
@BabeyCapricorn I think you need to look up intersex cases. They are not born with a "vagina". Some have surgery at birth because it actually hard to tell. They genitalia are underdeveloped, so doctor assigned them female because they think it might make their lives easier.

What do u mean? Caster is intersex, was assigned female at birth, raised as female, competed in female sports her whole life, used woman's spaces and has female ganatalia, so what is the issue? The west allows people who "identify" as women to compete with women but put out a set if regulations for an intersex female ( who was born that way). That is discrimination and I'm glad Caster won.
Either create a category for intersex & trans athletes or exclude EVERYONE who is not fully biologically female.

Caster is not "known as DSD". Caster "has a DSD".
Caster is not "classed as a female". Caster was incorrectly assigned female.
Caster was not "born with female genitalia." Caster was born with "ambiguous looking genitalia."
Caster has levels of testosterone associated with a man because Caster biologically is one.
Caster's testosterone levels are irrelevant to ruling out competing in women's sports. The fact Caster is biologically male is relevant.

She does however, have a vagina ( not "female" looking). This is how she began competing in women's sports in SA and her sex verification test in 2009 when she first became famous confirmed that she has a vagaina, so they cleared her to compete.
Her medical reports were leaked and revealed that she is in fact, intersex ( 46 XY DSD)
She wasn't "incorrectly assigned female" as her external ganatalia IS FEMALE
Her genetics however, are Male, plus she has no womb but has underdeveloped internal testes.
The issue then is how is sex defined? If it is by ganatalia then Caster is female, if it by chromosomes, then she is male🤷♀️

CS is not biologically male due to the presence of XY chromosomes, rather it is due to the fact there are testes present (rather than ovaries), thus small gametes are potentially able to develop (sperm).
The vagina and penis are the typical vehicles for the delivery, but in DSDs, they are not the definer. Gonads are.
I would simply not race. I would not play a poker game if I knew someone had the cards marked beforehand.
These athletes have been training all their lives and finally get to the olympics and know it is probably going to be the only time for most of them. Not realistic to expect them to not compete.

Semenya is being championed by many trans activists.who are seeking to use DSD athletes to muddy the waters to allow trans women into elite competition. "Look see sex isn't binary so there shouldn't be an issue with letting us compete".
Are you kidding me, I'm really happy for her. It's just so dumb that we ban people for having an unfair advantage but only in some cases where we find it icky due to them being trans or intersex. If you want to make sports fair, base it on ability and metrics that make a person better or worse at that sport. Similar to weight classes in sports. There we go, now we don't have to argue gender all day long anymore, it's fair, and even if the leagues that pop up for the most part look similar to what they are today, I'm fully okay with that 👍

On the face of it I have sympathy as it looks like some great injustice, but further you look into it the ban makes perfect sense. The science strongly backs her body being much more male like which is same reason trans men aren't allowed in as you frankly just can't compete against that. I mean the fact she has 2 kids with her wife & socially identifies as a male says a lot, she's capable of producing sperm with internal testes but no womb or ovaries which most women have. Again she could compete by taking meds to reduce her testesorne to a normal level but chooses not to as clearly even she understands where her advantage comes from.
I would go as far as to say that racism played a role in how she has been treated. SMDH.

It's pretty much impossible to do the 'right thing' in this case. I do have a little issue with it though... Would she be refusing to lower her testosterone if she wasn't a pro athlete? Or would she happily go with the hormone treatment like any trans female does?
It's hard not to think she's very happy to have that massive advantage in sporting terms. If she acknowledges that she has a male hormone profile and doesn't want to get the therapy to be more female, as she identifies... She should volunteer to compete with the men, as she is choosing to remain biologically male.
I feel incredibly sorry for her, it must be humiliating, but she knows full well that she has a massive advantage, and refuses to give it up. As I say, impossible to do the right thing.
I agree, it is impossible to do what is considered the "right thing" here. She is intersex, has XY chromosomes, produces more testosterone and therefore as you say has substantial natural advantages over other female athletes. I fully support her right to be recognised and identify as female, however, it can't be denied that she has substantial advantages and biological differences. Sport is about fair play - how is it fair play when she is at a clear natural advantage compared to other female athletes who do not have a Y in their chromosomal make-up?
The right thing is stopping pretending a XY person with male gonads is a woman because he didn't develop typically.
Allowing males like Semenya to participate harms women and sends the message that for society women are still "half formed men".
