- Bryan Neumeister, a metadata expert hired by Johnny Depp's legal team in his defamation trial against his ex-wife Amber Heard, was asked more details about photographs showing Heard with bruises. Neumeister could not say whether the photos were altered in any way by a photo editing app, but said he could not authenticate the photographs in general because of the data on each photo.

Even after the judge asked the witness to answer the "yes or no" question, his answer was, "this is not a yes or no question." I absolutely love seeing his integrity.
Well that's what Expert testimony is for, to give explanations as to why it's not a yes or no question.
Well in all honesty , that question was in fact not a "yes or no" sort and did in fact need explanation as to what why. There might be jurors that don't quite understand what happens when you transfer pics from one device such as an iPhone to that of a Microsoft based device. He tried to explain it but her damn attorney just wants a yes or no like a polygraph examiner would.

Well, this a yes/no question in the same manner the question "Does your spouse know that you are cheating on him/her?" is. Neither yes or no is correct if you are not cheating.
Because if he answered yes or no , that would be a lie either way , It's like asking a question about event that doesn't exist , but you want a definite.
For instance "will you drink coffee tomorrow?" . You can't tell if that will or will not definitively happen , unless you're some kind of farseer.
This is a hero of the trial. He stood his ground and did not allow a lawyer change the narrative about something he is an expert in. He was sharp, articulate, and deserves a bonus for his tests 👏👏👏

Well done to the expert for standing his ground and not being forced to provide a negative answer under the pressure of AHs lawyer. He couldn’t analyse it from a scientific point of view so couldn’t answer “no”. He’s definitely more an expert in his field than AHs lawyer in his field.
There are questions that couldnt be answered like that but ppl who dont know anything about it will demand answer and there waw example when attorney and even judge doesnt know that much about technical side of that and demand answer to question that couldnt be answered yes or no..
The total mic drop was when he exposed them for having changed the photos from the original Apple format to something that was changed on a PC. So her lawyers manipulated the data either knowingly or through their lack of expertise. Wow just wow.
The judge is not supposed to force the witness to testify to something he has repeatedly said he can not testify to.

It's their job. Apart from the old lady who seem to keep forgetting to open her mic whenever she speaks, they're actually good lawyers that you want on your side when you need one. It's just that this case isn't very winnable in the first place so it would look like they're reaching.

I think there's a sense of "grouping" AH's lawyers as on the "bad side" but honestly speaking. Amber herself is the atom bomb. And it's likely she's been lying in the name of self righteousness, arrogance, and indignation, even to her lawyers. The only people you should suck it up and tell it to like it is, and they can say " ok I can work with this". But I don't think her ego can bear her breaking the facade. and also the feeling she has it covered, because, superiority complex. That she won't ever have to, even to her lawyers. And for ego reasons it's important to her that they see her as the victim and truthful one too.
And when her lawyers are getting curveballs mid cross exams and discovering lies for themselves by defense witnesses, it's not pretty. And you get this.

Heard's lawyer opened the door to the very information he didn't want introduced, then couldn't "remember" his own question to try to stop it being introduced. What a whopping great mistake.
Yes! Even if the jury didn't understand what was going on until then they will have noticed what happened.
That was an extremely dumb question to ask. I mean, it is so obviously opening the door to discuss other means of ascertaining whether or not those images were altered in some way beyond the exif data and metadata. And the best result of that open door was, the tech expert could clearly explain to the jury in laymans terms that the images were not originals, but were in fact 3rd gen copies that underwent multiple layers of processing before he even got them for his investigation. So no tech expert could possibly determine if they were real or not, which AH team did not want the jury to understand. I get that AH is a terrible client to have to defend, but man her lawyers are not up to par...

Our judicial system is such a crock. Attorneys trying to stop witnesses from completing their statements, they just try to get them to say what will work for their case, it's so much manipulation that it's extremely irritating to watch, makes me feel for those who are the victims of this system. I do computer forensics. Without access to he original photo on the ORIGINAL device you can NOT show the photo is original photo!

Opening and saving a file in an editing/sorting software program is technically a change to the photo!!
Also, there is no way those two photos would have an EXACT overlay if they were two different photos!
She claimed they were just with different lighting, but she would have moved somewhat (even subtly) if the lights were changed!
In my opinion, this are the same photo with red saturation changed to enhance the look of the images!

Her pictures were declined because the court also examines them when put to evidence to see if they are authentic, clearly they missed more

The witness is answering the question exactly how it is being asked.
Amber's lawyer is trying to stop the witness giving his witness.
So basically, the photo has been edited. This means that anything at all that's in the photo could be not from real life. This bruise could have been lifted from another photo and painted seamlessly onto Ambers arm. Even 12 years ago the software was good enough to do this, I could have done this in adobe photoshop
Not true.
Issue is, photo evidence provided is not the original file. It is a copy, which in turn "could of been" modified.
Therefore, the photo cannot be used as evidence for Amber, nor can it be used for Jonny.
Only way to prove if the photo is real, is to obtain original file directly from the phone... so either Amber knows its edited, and didn't provide it, or she lost her phone.

@@geo41e apple have space online for apple device images etc. Most apple phones automatically download onto iCloud this doesn’t look like copy. It’s appears from what I can observe that she has messed around with filtration /saturation. If you do it with a normal image of your own on an iphone you will see how you exaggerate pink tones or blue tones etc. Also on image with bruise on arm her hair seems oddly dark. Her face looks younger there is a girlishness to her appearance that I dont see in other images of her at that time. I wondered although dont obviously know was it even of her as a married women or several years before? We are all speculating but we can be certain that images we are seeing are not originals and have been through editing software. Plus only actual bruise I see is on arm the other marks look like pink tones possibly produced by editing software and or by makeup or simply slapping her own face before taking image.

Also, the icloud backup.. is a backup. Which means not original.. so you can't say it's original or edited..swings both ways.
Again, as the expert stated, the only way to 100% confirm if the image was edited, is comparing is to the original directly from the phone..

When the EXIF meta data from your photo exhibits have been effectively ‘scrubbed’, it becomes difficult/impossible to authenticate the provenance or editing of said photos. How convenient . . .

It's interesting that they tried to corner him conducting the question as having no evidence, then AH's lawyer slips in a "correct?" at the end of the question and the expert takes the oportunity to respond as "incorrect!", rebutting the statement in the question, instead of anwer the question with a yes or no, as they wanted. Smart guy!

Amber thought that because she was Johnny Depp's wife that she was entitled to his level of stardom and income. She thought she could climb up to the top on his back. As he insinuated himself, that's obviously why she seduced him to begin with. She presented herself as his soulmate by mirroring him in only ways a narcissist could do (since she clearly isn't his soulmate). That's why it took him time to see the real her. She was slowly boiling him like a frog in a pot of water. It wasn't from the beginning. She thought she could abuse him, use him, demean him, and then be him... she thought she thought she thought. She was wrong. And now the world is watching. She will forever be ruined. And he has made history with this trial. This effects society directly as people will start to believe when a man is being abused by a woman, and will also be able to see the signs of a narcissistic abuser.

As the expert testified, it can't be proven they were doctored (or not doctored). As the burden of proof is "beyond a reasonable doubt" in a criminal trial, it wouldn't hold up.
It definitely gives the jury something to think about, they won’t forget it in making a decision.

I am no photo expert, but this guy schooled the lawyers so good that even I knew they got owned. I actually could follow exactly what he was saying. haha So I know the jury does too.
Any photo used in regular everyday manner would have photos 3.0 :) , the point of the testimony wasn't about the photos , they are arguing that if you don't have the original device then photos are not authentic , edited or not.
Altho the demonstrative where they overlay multiple pictures on top each other do show that every photo is basically different in some way to the naked eye.
Imagine you have a printed photoshopped photo, and somebody asks you if ONE pixel of the photo has been edited, just by looking at the photo printed on paper. That’s how incredibly illogical the questions of AH’s lawyer are.
I'm just thinking have AH's lawyers not seen the movie "Rising Sun" in that movie alone there is a situation where footage and photos are examined for changes and they can examine down to pixel level to detect changes. If Amber seriously thought ppl these days have never heard of or know about photoshopping and photo editing umm geez go back to the 50s darling.

It's impossible to reverse engineer photo that has gone trough a path like these jpgs did. From technically standpoint, but everyone can see the differences between some photos its safe to say these were worked on.
Pretty sure she testified under oath that the difference was that she had a light on in one picture. All this guy had to do was lay the one on top of the other to show what bs that was. Perjure yourself much?
It definitely wasn't just the lighting! The HUES in the photos were definitely different and obviously enhanced. A light make a photo look brighter or darker and highlight some areas but it's definitely not going to saturate the image and change the tones overall what she looks tanned in one and pale in the other.
I have never seen a red bruise that looks like a skin flare up or irritation from someone who has allegedly been violently abused!? Usually there's some black and or blue discoloration on the first day of the bruise. For the kind of abuse that Amber is claiming she experienced - being punched or hit repeatedly in the face with chunky rings on.. her "injuries" doesn't add up. That's kind of abuse she should be black and blue and bleeding. Since she's such a petite, caucasian female, such bruises and injury with the evidence. We all know that she faked her broken nose with nail polish. Now we know she edited her pictures to enhance her false bruises. She's DESPICABLE!!

This is what happens to fair skin. We turn red for days. A bruise will not turn black or blue for several days after the hit.

Ambers lawyers must be dense. What the expert is saying is that given the type of photos that were presented by the Amber team, NO ONE could authenticate any of the photos. So they are inconclusive on their own. Given that there are so many objective witnesses like police officers who deny seeing injuries, this only casts doubt on the authenticity of the photos and suggest they were indeed edited.
They’re being intentionally ignorant. It’s a tactic to control what’s being said so they can “validate” the case they’re making

That's why in the last part, the redirect, Norbert was finally able to expound on the itunes backup - Heard's lawyer tried to object but Depp's lawyer rebutted with "but he opened the door" - that's why the question he "forgot" is that damning and significant
Thus by explaining that the "photos" were 3rd generation backups with no way to authenticate them, Norbert shredded their credibility

Witness is right about the conversion from JPEG to screenshot format, the attorney needs to take a course in graphic design/editing and image file formats. The court room should not be the place for the attorney to learn graphic design. no reason to have an attitude because of your own personal lack of knowledge. You're fired.
