    no more child hood cautions, or adolescent/juvenile mistakes, the multiple rule about 2 convictions as old as 30 years ago no longer valid. Minor errors when young do not make a criminal. We all know the real criminals, the paedophiles, etc. Well done Unlock for standing up for people.

      That indeed, is the usefulness of the UK Database. It filters out all the trivial matters and concentrates on those who have been vile, the kind of people you wouldn't want to know or work with, those on List 99, a big list with many thousands of names of people who are deemed unfit to work with children or vulnerable people in general, people convicted of serious indictable offences. Any other serious offence details can easily be found out by typing a person's name onto a search engine and see if it brings up any newspaper articles referring to criminal offences. Anything non-trivial will show up without exception, for all the newspaper archives are online these days, and information can be pulled up in seconds.

    Thank you so much for all your efforts. You’ve helped change my life. I had two cautions that I thought would haunt me for the rest of my life. I’ve had a career within the health care sector having to disclose my cautions that did not reflect the person I am. I cried when my dbs came back clear. So thank you so much for changing the lives of many !!! ❤️❤️❤️❤️

      @@dannyplush9568 Hi Danny, I was told that this is incredibly difficult to do unless you can show that you can prove that you were given the caution incorrectly, just wondering if you know anything different from what I heard? I had a small amount of cannabis on me when I was 19 and now it is causing me trouble to advance in my career and moving to the US

    If you have two people with the same conviction, one a British citizen, and one a foreign citizen, the conviction will show up on the British citizens DBS, but it won't necessarily show up on the foreign DBS. This is because it can't be traced from abroad. This means direct discrimination is happening to the British job hunter. Many nursing homes only employ foreign staff because it is near impossible to DBS check them, and so saves them a lot of hassle.

    I have completed NVQ level 2 in Child Care and BA honours(2:1). One of my child disclosed in school that my partner raised his hand on my daughter and we both were persecuted. However, police and social worker did not find any marks on all of my children. They have even put me into a neglect category because I did not do my 2 years development check for my youngest daughter. At time she was 3 and healthy child and I did not consider it was necessary to be taken. It was like a joke they have interviewed all my children, myself and partner without any sign of abuse. They charged us and I admitted that to discipline the children I do gentle tap them often while it was recording. I am so heartbroken as I would be graduating this year and it will show on my dbs. This system is so unfair and I don’t feel like attending my graduation ceremony as my future will be like a black hole. I am so fed up 😢 and devastated, it has been 6 years since that incident happened and any changes of me to get into Health and Social Care looks are gone. I have spoken to Chris on Unlock regarding this issue and he has provided me assurances. If the police did not find any marks why is it still showing up in there system. I have applied for the dbs and waiting for the outcomes.

      @@WTMT_NG , the system is so unfair, the Social workers are just after the money and they can do anything to make the case strong against vulnerable individuals. I am applying for the enhanced DBS check and praying 🙏 to lord to ease for me the journey ahead.

    This is a great first step. I don't know why cautions seem to be treated the same as a criminal conviction. I hope that the next step will be that all cautions will be filtered after a certain period of time.

    At the end of the day we are all human beings and make mistakes, the fact that it has taken this long to get this far is unbelievable! Everyone who has made a mistake and served there time ect should be given the opportunity to start again without being held back on job opportunities just because of a previous mistake, I myself do not have any criminal past so luckily this has stopped me but I do know many decent people that made bad life choices decade's ago that do not deserve to be held back so thank you for you effort and keep it up, I totally understand that there are some times that certain people should not be working in certain fields and agree that there should be some level of appropriate checks done in those positions for the general publics safety but I am only just finding out that these changes have been made for the less serious convictions that won't necessarily mean that an individual cannot perform well in a good working environment without the need to worry!

    Stay on benefits. Sod the work. If they don't want us, and insist on raking up old convictions and punishing people forever, then live on benefits. The whole DBS system is belittling, humiliating and cruel.
    Note that MP's are not required to have a DBS themselves. What a surprise! Expect so much from the little people, but not of themselves.

      I agree. Also, isn't it interesting that journalists are not required to have DBS checks, even though their role is - supposedly, accordingly to them - crucial to our democracy, and so much depends on them telling the truth. You would think they would be pleased to undergo such checks and it would not be hard to arrange: just make it a requirement for NUJ membership or for a journalistic or broadcasting role with OFCOM-regulated or self-regulated media or press entities. Remember, this is soooo important. It's about the safety of [kids/women/cute puppies/panda bears]. It's vital for [our democracy/the war on terror/our nation's future/our children's future/the safety of women/the NHS].
      As you are implying, all these concerns from people with criminal records are for average folk anyway. People on here are fretting over not being allowed to be a better-paid wage slave, which is what the majority of people are, including most professionals. The solution is to start your own business or let them dole you off and live a stress-free life away from their rat race.

      I agree with you wholeheartedly.
      We now know you can be in the police without a DBS, a judge, a politician, a solicitor and lawyer.
      If you are baseline, minimum wage nothing people like the majority, they will unfairly make us jump through hoops backwards and punish you if it's not done properly.
      One rule for us and one for them.
      Nursing homes prefer to hire carers from overseas because it's quicker and simpler to employ them. They are not subjected to the same mania around DBS checks as British people because their criminal pasts (if any) can't be checked anyway.
      This means that British people with a criminal record are being discriminated against. You have more rights coming from overseas with DBS than being born here. 😂
      You couldn't make it up.
      You're right, live on the dole.

      @@dean9235 You do need a DBS check for the roles you mention - and rightly so - but the official reason for DBS checks isn't to exclude people with criminal records, rather it is to manage risk by giving decision-makers the fullest information. If a DBS check reveals a criminal record, that doesn't mean you can't employ or appoint the individual, only that the information should be taken into account in weighing up and managing the risk posed - if you see the difference. Of course, in reality this nuance has been lost. You see people with the words 'DBS checked' on their profiles, and I'm always tempted to ask, 'But what does it say?' Someone could be a murderer and say 'DBS checked' and be telling the truth. A DBS check is a search, not a seal of approval. You are supposed to check the search result, i.e. the DBS certificate.
      If we're candid about this, nobody wants to employ somebody with a criminal record. That includes people who have criminal records themselves - not hypocrisy really, it's just understandable. In the past, this was well understood and the solution was to limit who could and could not know about a criminal record and how it was publicised. This was on the imperfect but pragmatic principle that if people did not know, it would not be an issue. Any historic information was circulated only amongst sensible people who had a reason to know it (mainly people working in the criminal justice system).
      The change that came with Huntley and then search engines means that Mavis down the street can know about your past. Is Mavis sensible enough to be trusted with this sensitive information? Meanwhile, John in HR has a right to know if you apply for that warehouse job. We can't have criminals running round our warehouse, what if they steal something? Want a job as a probation officer? Wait for Mary, Jim and Steven and other team members to review your DBS check and decide if there are any safeguarding issues. Were you a naughty boy 20 years ago? Forget about joining a profession. Stick to that factory job - didn't you know that menial jobs are a form of punishment?
      The public just have some queer ideas, but it must be understood that the average type person is a conformist, obedient stick in the mud: a person's past is also his present. Or he will jump through hoops like a dog at Cruft's for the honour of being a better-paid wage slave. Witness some of the comments on here, such as: "Good grief! I've just completed Level 6 in Advanced Cosmonaut Dental Hygiene in Martian Terraformed Environments, plus I have a PhD and my thesis was on the ethological implications of spanking kangaroos with a table tennis bat, and I still can't get a job as a trainee accountant. What the feck has the world come to?'
      That being said, a criminal records regime as sweeping as this one is bound to be repressive, encourage paranoia and produce unfair results. The motives for maintaining it are varied but the overarching points are that society has been overtaken by 'safetyism', to an extent justified because we don't want certain people doing certain jobs, but as with anything justified, it has been taken too far. There is always slippage and function creep with things like this and it plays a useful role in social control: average people have sensationalist mindsets and like to measure where they are in the pecking order, which is instilled by TV-watching. The average person thinks that the Telescreen and TH-cam channels are reality.

    it should be completely wiped when its not majorly serious crimes and you've stayed straight for say 20 years
    I had a mispent youth mainly dragged in with peer groups I haven't so much as broken a single law in 30 years but I am still screwed by my convictions age 16-20
    a murderer rapist can enter our country via channel boats and make up a brand new name and have a clean record once granted asylum

    Hi, I'm glad to have found your channel. Speaking from my experience, it has taken 55 years for my slate to be wiped clean from a juvenile court judgment even though the case was conditionally discharged. I only found out about this when applying under the 'Homes for Ukraine scheme'. The lad staying with me was medically discharged from the Ukrainian army with a heart ❤️ complaint.
    I see there's still a lot of work ahead for your organisation especially for those wishing to travel abroad visiting other countries etc only to have their plans thwarted by immigration rules or placed into schemes to enable admissibility.

    Oh.. No wonder my CRB came out clean when i got the job at NHS few years ago. I was shocked.
    I've been done for dumb things when i was younger, graffiti, cannabis and the amout of stop and search for no reason. This was when i was 15-19. I'm in my 30s now.

    However people from blitzed countries cant be checked for criminal records. UK police are not checked for criminal records via DBS disclosures, all in-house for them and a conflict of interests in law.

      Blitzed countries? UK police are checked through their criminal records - no filtering for them, and plenty of offences that would be filtered by the DBS bar someone from being a police officer, even a caution.

    Criminal records last until the recipient is 100 years of age - meaning it's for life. Nobody can get them removed as that's the whole point of them in the first place.

    Very confused as there are offenses that are within the step-down model which have been specifically stated that should be filtered in 6 years for (eg Class B/C offenses) but is contradicted by offenses by the government own list of offenses that will not be filtered. Another grey area point for us layman, would be statements often made by the police during an arrest that your warning/caution will be struck off in 5 years (clear period) but yet people have that same offense reappear on DBS often many years later (way beyond 5 years). So where does the offender stand for future employment if the premise of a 5 year clear period is not officially valid even if has been stated by the police upon signing/admitting to the caution.

      Sadly, we have to ignore what we were told by the police, as they do the start of the process, and Unlock deals with the end of the process. Only the government's list of offences that won't be filtered is relevant. If you're not sure, contact the Unlock Helpline.

      Apparently from what I heard before, everything will be on there, minor, Relevant information, And Rehabilitation needed or not.

      The police don’t care about your freedom hence why they didn’t explained it properly.

      The SIA have a criminal record indicator. If you put details of your conviction into this it will let you know if you will be refused, accepted or refused now but can reapply at a later date. - www.services.sia.homeoffice.gov.uk/Pages/licensing-cri.aspx.

    I have an ABH caution from july 2010 which still shows up some 11 years later, I also have a caution for battery of July last year ie 2020 , I've applied for so many Jobs and I have always disclosed at the application and interview stage but always fail when it goes to a internal dbs panel, ie failed at the dbs stage, when will both of these cautions disappear and when will I get the chance to shine in my employability

      I would contact DBS to make sure the old conviction is removed due to it being 11 years old now. The caution will take another 11 years to remove unless the law changes in the meantime.

      Now, each conviction will be looked at by itself. So, if all of your convictions are now eligible for filtering, they will all be filtered if 11 years have passed since conviction. If some of your convictions can be filtered but others can't, only the convictions that aren't filtered will be shown.

    Hi, I plead guilty to a common assault charge in June 2015. My new employer are going to run an enhanced DBS check, prior to me being accepted the position. Do you believe this will be shown, or can it be filtered out? Thank you in advance for your support.

      All convictions show on an enhanced DBS check for 11 years if you received a adult conviciton when you were 18 or over. 5 1/2 years if you have a youth conviction and was under 18. Common Assault is protected and will filter off your enhanced DBS check, as long as you did not receive a prison or suspended prison sentence. So, as long as you didn't receive a prison or suspended prison sentence your adult conviction will filter off your enhanced DBS check in 2026. If you have a youth conviction it would have filtered off your enhanced DBS check in 2020/21.

      If you have been arrested, bailed but no charges raised and were free to go, then this sound like No Further Action.
      If that is the case, then you have Police Information. You do not have a conviction or a Police Caution. So, you have nothing to disclose for a employment DBS check. Police Information can appear on an enhanced DBS check under the "other relevant information" box, if it is relevant and ought to be disclosed. So, again Police Information is not disclosable, as it is not automatic that the Police will disclose the information they have on you, on your enhanced DBS check.
      However, if your Police information is disclosed on your enhanced DBS check, then contact Unlock and we will guide you on how you can challenge it.

    Permanent exclusion from bettering themselves is hideous. Especially in professions that have managed go get themselves out of the rehabilitation of offenders act. Ironically the legal profession would be better served by people with coloured backgrounds of their own that have chosen a better path...

      If the caution was for a protected offence. Then it would have been removed from your standard/enhanced DBS check after 6 years. For a basic DBS check a caution is spent straight away. So, you never have to disclose a Police Caution for a basic DBS check.

    Hi I really need some advise what happen to me I was 7 year old lost both my parents in car accident I grow up in care home I done few silly things when I was younger now I’m 34 year old with multiple businesses I have 24 employees I own 13 properties 2 my Business is shut down because I need a DBS check done I done one 3 month later still nothing continue losing money every day because we can’t do any mots 7 my employees been with me since 2018 I really don’t Wana let anyone go al have families and mortgages so I done the dbs check again still not come back I was taking my ex to court to see my daughter her solicitor decide to do a police check on me my record come back 50 pages for things I never even done or had any involvement to that stuff how do I clear my name for al this crimes been accused of one them I was wrongly picked up in the park saying I was under rest for robbery 24 hours later got the cctv they guna didn’t look anything like me let me out say sorry we made a mistake but is showing up on Record I can’t not believe it
