If you want to hear what it is like to be given a run around from a company that is trying desperately to just avoid you, pay close attention to what MRK talks about.       As you have a line of communication with them can you clear up why they are going after Disney?
      His Star Wars novelization was originally publidhed by Ballatine Books, and 'Splinter of the Mind's Eye' by Del Rey, now both under the Penguin Random House umbrella. And he said his contract was with Warner Books, now Grand Central Publishing under the Hachette Livre umbrella (who actually back in 2013 bought Disney completely out of their publishing efforts). Neither of these two companies are owned by Disney in any way whatsoever, why are they not also bringing it to PRH or Hachette the two biggest publishers in the entire industry, and they two companies actually associated with his books according to this very interview (Warner Books) and his books current publisher (Del Rey/PRH)?
      I am not trying to be accusatory, just very curious after doing my own research.

      This is also about the rights of the elderly. These royalties are the author's retirement money. Most writers don't have the luxury of employer-funded retirement plans. Royalties puts the food on the table. And now when he's getting older, Disney is making a move, like a gangster. This is like watching Rick Moranis getting punched out . I'm just about through with Disney.
      And can we all agree that royalties are not a hand out, not a freebie. You get royalties when you sell a book. In other words, Disney is STEALING money from an old man.
      So sickening.

    "We can publish author's books without paying them royalties". Oh really Disney? So that means I can download and distribute the original six SW movies without paying you? Because according to you, that's how this works.

    The fact that most contracts don't have clauses guaranteeing payment by successors, but Alan Dean Foster's contract DOES, and Disney still pulling this shit with him, is absolutely ridiculous.

    The fact that someone on Disney’s legal team said “hey this is okay to do” is appalling. This isn’t something you just forget about and it certainly isn’t something they just decided to do. What MRK said about the lawyers being the only one that benefit is true. Because these are such small amounts, it would’ve been highly unlikely the authors would push the lawsuit. So some sleazy lawyer said “hey we can screw these people over and they’re never going to ACTUALLY sue us because of the cost.” Its mind-boggling

    Mary hit the nail on the head. Disney is counting on it being counter productive to these individuals to seek action (more for cost than compensation). It's a really scummy thing to do.

    This makes me wonder what happened with Garth Nix and The Seventh Tower series. It was a LucasFilms book and he said he no longer has any rights to those books.

    I know they're probably going to settle for just their correct royalties, but Disney needs to be hit with punitive damages for this. Punitive damages big enough to actually be meaningful to such a huge company, so future companies know they can't just blatantly break laws and then come out even if they're ever called to account.

    Well, I am convinced that this is a wrong that needs to be corrected. As a holder of Disney stock, I will send a message to Disney about how I view this to be acting in bad faith, and urge them to honor the royalty agreements of the companies they purchase.

    I'm really happy to see people standing up to big companies. As a society we need to acknowledge that its the big companies screwing over individual creators and that the best way to encourage creativity is to protect individual writers, artists, etc. and hold corporations accountable.

    Well, Disney just definitely lost me as a customer/consumer. I'll not watch any more of their movies, not buy any merchandise from them and most certainly not do anything to promote them. I must find out how to identify any books they publish, so I don't buy those by mistake either. Since the authors do not get royalties right now, I can do that wthout feeling bad.
    If enough people would do this, clearly stating that it is due to this attitude of the company, I'm sure the pressure would be enough to get the company moving faster towards resolving the issue.

    I actually bought a new copy of Splinter of the Mind's Eye a few months back, and, especially as an author myself, knowing that Foster didn't see a cent from that is deeply upsetting, as is knowing that other Expanded Universe authors have also likely been shortchanged in the buyout (Stackpole and Denning say they've been getting royalties via Del Rey, so maybe it's specifically from authors who wrote only for the Bantam or pre-Bantam era?). The pessimist in me kind of sees this as a potential lose-lose, too, as, if Disney ends up being forced to cut the backlog of checks, maybe they'll decide that it's not worth keeping pre-buyout stories (Legends) in print at all. Which would suck. That's still my Star Wars, as, despite trying desperately to love the Disney era (I know some people like Mando, Fallen Order, etc., but my excitement for anything from Disney Star Wars was killed after TLJ), Disney's handling of the Skywalker saga left me baffled and depressed.
    Obviously the best outcome from this is seeing people paid for their work, and that's what I hope for. I can still be jaded, though.
    Anyway, thanks for doing your part to make sure this story is heard and given its proper due, Mr. Greene.

I'd personally have preferred animation of everything post-Endor up to Crucible, with the new trilogy picking up as adaptations of the Sword of the Jedi books we were promised. Then the stories could have built into the Legacy comics. A fan can dream...

    What I don't quite understand is how Disney expects to get new contracts with authors if this is how Disney treats them. Do they just plan on only making money from already-published books until the end of time? Anyone who wants to make money off their own work (i.e. every freelance writer in America) isn't going to go to work for a company who won't pay them for their work. This temporary boost to their profit, which was established in the video to not be all that big compared to Disney's massive amounts of cash flow, isn't going to matter much in the long run if authors don't want to deal with the Mouse House.

      Writing Star Wars (or other big Disney-owned properties) is sort of the culmination of the nerd dream for many aspiring sci-fi authors. If Disney chases off all the established crowd, there will doubtless be smaller authors who'd love the opportunity to play in that sandbox, even if the terms of the contract are less than ideal.

      Anyone hired to write a novel tie-in for Disney doesn't actually get royalty-based contracts any more. It's a flat rate up front fee, thanks and goodnight. No back-end percentages. Alan Dean Foster's works ARE, however, royalty-based because they are older contracts (originally with different companies, too). So honestly, it makes no difference to future authors going forward because they get their flat fee up front. Or rather, usually more like 30% on contract, 70% on satisfactory delivery.

    Would anyone be interested in helping me put together a google doc/ list of publishers that are considered ethical in terms of how they treat their authors, illustrators, editors etc...? I think it would be cool to have a reference list that can be passed around for this purpose- so people don't unknowingly buy from unethical publishers/corporations? Most importantly so people can stay better informed. It's just an idea, let me know what you think please :)
    EDIT: To add, we could break the list down by countries and then have a list for international publishers!

    Im just going to use the fact that Im relatively early to tell Daniel (and anyone else reading this) that he needs to read "House of Leaves" by Mark Z Danielewski. I know Daniel likes horror and well no story has managed to unsettle me quite like this one. Id say more but its the kind of story best experienced blind, but whether you love it or hate it I doubt anybody will deny that theres really no other book out there like this one.

    I read so many novelisations in school, and the Alien ones are the only ones that I remember. So vividly they have stuck in my mind, that I can hardly see the movies as anything other than very good adaptations of the books.

    You should do an updated video on this. Many authors, such as those who formerly wrote for the Star Wars EU, still haven't been seeing royalties for their works. AC Crispin's (who wrote the Han Solo Trilogy) family has been especially vocal about this. The Alan Dean Foster case received publicity, but there's far far more that's been swept under the rug. A popular booktuber like you could bring attention back to this.

    Not long into Mary's description of the interaction with Disney I started getting really angry. I recognized the behavior that the Disney contacts were using. Hello, past experience with crappy companies/people! Disney is hoping to give Alan, and all trying to help him, the runaround until it became too frustrating or expensive to continue trying to get the money. It's disgusting, and I now want to burn Disney to the ground. Good on you, Daniel, for putting a spotlight on this.

    Most people think that the Star Wars Expanded Universe began with Timothy Zahn, but it was Alan Dean Foster when he ghost wrote the original Star Wars novelization (released before the movie) and followed up with Splinter of the Mind's Eye. He's a bit unknown by many fans but his impact on numerous fandoms is huge. He should be shown a little gratitude. Still, Disney being scum; why am I not surprised.

    What if, as a form of protest/protection, writers start insisting on cancellation clauses in contracts that would only go into effect if the rights are acquired by disney? Something that would disallow the acquisition of the author's work and its continued publishing? Anyone think that could work?

    The moment this ridiculousness came to my attention, I immediately cancelled my Disney+/ESPN+/Hulu-no-ads subscriptions, let Disney know why, and that I wouldn't spend another dime on any Disney property (and I actually buy 4K Blu-ray Discs of movies I like, including basically every Pixar/Marvel/Star Wars, buy many Marvel comic books, among others,) until this is corrected.
    And while I do absolutely *LOVE* The Mandalorian, I will just have to go without until they resolve this. Because this is unconscionable.
    Also, I see people crying "Walt wouldn't want this!" - sadly, that's not true. Walt was *FAMOUS* for getting around copyright. When he couldn't secure the film rights to "A Jungle Book", he just waited for the copyright to expire to release the _already made film_ so he didn't have to pay for it. Then, of course, he (and the Disney company after his death) pushed for copyrights to be extended ad infinitum to protect their OWN properties.
    No, this is not new behavior for Disney. But it is appallingly egregious.

    As you have a line of communication with them can you clear up why they are only going after Disney?
    His Star Wars novelization was originally published by Ballatine Books, and 'Splinter of the Mind's Eye' by Del Rey, now both under the Penguin Random House umbrella. And he said his contract was with Warner Books, now Grand Central Publishing under the Hachette Livre umbrella (who actually back in 2013 bought Disney completely out of their publishing efforts). Neither of these two companies are owned by Disney in any way whatsoever, why are they not also bringing it to PRH or Hachette the two biggest publishers in the entire industry, and they two companies actually associated with his books according to this very interview (Warner Books) and his books current publisher (Del Rey/PRH)?
    I am not trying to be accusatory, just very curious after doing my own research.
