Australian Battery Company DCS Sues YouTuber Who Reviewed Their Batteries!

  • Hi folks, Australian battery manufacturer Deep Cycle Systems or DCS has sued TH-camr Stephan Fischer for alleged defamation, for reviewing their batteries and revealing some unfavourable performance outcomes in his review.
    I strongly believe in the rights of individuals to express themselves without fear of corporate bullies, frivolous lawsuits or attempts to censor or otherwise prevent people from educating and informing others.
    I've watched Stephan's videos and don't believe he has defamed anyone. He found issues with the DCS batteries he tested though and is now being sued over it. I'm no lawyer, but this is unacceptable, so I've made this video in support of him.
    Note: I have nothing personally against DCS, I've never used their products. Please DO NOT harass them or their associates, support Stephan instead! You can do that via his GoFundMe, accessible through his channel and by watching his videos. He has several videos and updates about the case:

      @@LiquidAudio The echo of this story is astonishing, that connection to Louis really hit the home run because after that it looked like 1000's of TH-camrs jumped onto the story. I kept quiet because I know through my own legal battles in the end the companies get the rewards

      Indeed he did, but he is protected by the USA's 1st Amendment. Here in Australia, we are on our own if we call out a person or company.

      No Stephan Fischer has damaged DCS brand and business, and it's his fault of using AWG10/40amp wires in a 100A array. Stephan Fischer needs to compensate DCS. There's no going back now, as the brand has been severely damaged.

    Over the years i have learned that word of mouth is the best advertising ever. As i tell my customers " if its good, tell your friends, if its not, tell me and ill fix it."
    I have never had to run an ad anywhere and im turning work away.

      Unfortunately, what you tell your customers is not how it always works in the real world. If it's shit they will definitely tell everybody and maybe you. If it's good they might tell others and possibly you but they might not.

    With sixty thousand subscribes, the best thing DCS could have done is simply ignore the original review. Generally the best course would be to reach out and correct the issues. In this case, given the horrible product, that would probably just have made things worse. Instead they did the worse thing possible. Great video.

    Hey mate! Great video - it's admirable to see more support for Stefan against DSC. This really resonates with me as a fellow Western Australian. I’ve also been burned by a dodgy DSC battery. Long story short, it failed within six months. In hindsight, I should’ve known better, given my electronics background. Falling for the marketing about “lithium batteries being engine bay compatible” was a stretch of logic. Your video is actually pretty tame compared to Louis' rant, but you made all the right points. With all the money DSC has wasted on legal fees, they could've just improved their product - such a ridiculous business move.

      Thanks Ethan and hi to another Perth local! Yeah, possible the dumbest move ever from DCS this one, sorry to hear you also have been burned by this. The lithium in the engine bay thing is an inherently bad idea, for now at least. I have a lithium battery in my motorcycle, in an open frame, with air blowing over it at all times, totally different use-case.

    I didn’t realise until now that DCS is an Aussie company, not surprised sadly. In my experience, having had a couple of threats of legal action against me, Australian defamation laws are set up to protect the big guys from the little guys. I wish Stephan the best

      Exactly. It is David Vs Goliath. In the USA using "Legal Eagle" as an example, they educate viewers, empowering the average bloke. I wish we had the industry or a firm releasing topic specific, general advice on what constitutes crossing the line. Today I was on the phone to a lawyer on the topic of what is and isn't OK. Why? I was worried that if I made a complaint or sought legal advice and simply naming the firm, under FOI, the party suing or being reported, can request details of even a confidential complaint. Even to a government department. I've spent two weeks self destructing with stress over an unrelated matter and I'm the guy that was wronged. I can imagine how Stephan feels and admire any any everyone who stood up for him.

    The word is certainly getting around about DCS and their practise of we'll sue you if you dare let anyone know our batteries are poor performers compared to other brands.
    I wouldn't touch anything from DCS with a bargepole.

    I've been fed this video by the algorithm because of a couple videos I watched by Stephan about his battle. I hope at the end of the day he ends up owning DCS and he works on it becoming a better company. If DCS pulls the suit then he should be taking them to the cleaners.
    I have been in slightly situation years ago. I used the naughty in and out word as part of the description when I described the way something had been installed. I had photos of the installation purely because I document a lot of my work and the equipment it gets attached to. The installer was trying to claim money for the equipment not being servicable easily. If he'd installed the items as recommended the servicing is a 5 minute job and not a couple of hour job. the installer in the end had to wear his own stupidity. I wore some of his stupidity as well as it took several trips onsite to work out why an analogue to digital input was varying wildly. It turned out that he'd shortened the shielded cable and ran unshielded cable bundled together with the mains cabling for a 10kW motor.

      @@LiquidAudio I think ego plays a large role in that behavior. It's the same with DCS. I use to work in the battery industry and know of a few ugly ones who are importing and branding 3rd tier Chinese product. The product is crap, it costs peanuts to import under the ChAFTA and the markup is massive. Then all they have to do is manage warranties and returns. The Chinese don't sponsor the warranties/returns. That is the importers problem. It is an unsavoury business model to say the least.

      @@LiquidAudio Yes. I don't know why Eric was so upset. I don't see a big deal. Erin just pointed out a small bump in the low-mid freq. response, if I remember correctly. Otherwise the Tekton speaker on review scored well, all things considered. Prior to this, all of Tekton was known for all the right reasons. Now some of Tekton is known for some of the wrong reasons. What a disaster. If I were a shareholder of Tekton, I would be calling for resignations.

      Yeah that was literally a text book example of what not to do, as this also is. Erin quite liked the speakers, the review was pretty good. They didn't have a perfectly flat response, like every other speaker. There was no need to say anything other than "thank you for reviewing our speakers, we're glad you mostly liked them."

    Well, of course the circle of people who see these videos (from you and the other TH-camrs discussing this) is quite small and not many of them would have had plans to buy DCS products.
    However, it seems that in Australia there are a number of TV News channels that don't hesitate to bring controversial stories, and of course it would help much when this story is covered there and potentially many more buyers know what company to avoid.

    IMHO A company may have shot itself in the testies while playing with projectiles. I do suggest people have a look at all of the videos listed above. They are all very interesting and point out some very good information.

    DCS deserves zero sales. A bigger ma and pa company did this kind of thing in the film world. They were not making film, they were repackaging other manufacturers film and giving it a cool looking box. Then when other, but smaller ma and pa operations started doing the same thing, they started threatening to sue. All they got ultimately, was loads of bad publicity and sales went down. Only company's that appear to want to look like idiots do this. Just put DCS on your never buy under any circumstances list. They have earned it.

      CEO is the full staff 😂. DCS can only do this because they have less than 10 employees. If it was king's you can say whatever you like and they can't do anything about it

      As above.. this isn't a massive corporate entity. It's under 10 employees (and I suspect but don't know enough about it) that the battery in question is just a rebadged Chinese wholesale/ drop shipped battery

    Auto Expert did good job on DCS as well ... being careful not to have them suing him as well.
    There's a federal government document that show DCS batteries of certain variations perform poor.

    There is another review on DCS batteries from the USA done by DIY Solar, very non biased and technically accurate. Final review says sub standard engineering, very second rate assembly and attention to detail with a high probability of failure if used as a car starter battery under the hood. He also points out that it is basically a restickered cheaply constructed Chinese battery. Good on you for supporting the other TH-cam guy, it’s not slander if it’s true.

    Australian (& imported) Car companies learned back in the 1960s that there is no milage in suing for a bad review. That precedence will be hard for DCS to overcome.

    While Americans have their First Amendment. allowing Carte Blanche criticism, here In Australia, there is a wall of Defamation/Libel laws and they are brutal and cruel. Simply telling the truth can end up with a person needing a AUD25K deposit to answer the litigating company, if the company plays the Supreme Court card. David and Goliath. Be aware that even a negative G Maps review can initiate litigation.
    Again, your willingness to step up is admirable and you earnt my respect. Kudos and GoodOnYaMate !

      Thank you mate, appreciate the kind words. I'm just one of those guys who won't sit down and be quiet with something unfair like this. I would argue that the US is far more litigious but stupid lawsuits happen everywhere, no doubt, and this is one of them. May the more ethical and better-intentioned man win, I say!

    I have followed Stefan for years now and I find him an honest and down to earth guy. I think DCS have shot themselves in the foot and I bet they didn't count on the TH-cam community giving it so much airplay.

    This is why early Nissan Leaf battery packs performed poorly in hot climates (later ones not quite as bad). Every other electric vehicle on the market has active water cooling.
    Certainly no place for lithium under the bonnet!

    Deep Cycle Systems (DCS) didn't like the real-life testing reults of their battery, so they
    1. insideously changed the terms and conditions of the warranty
    2. sued Stephan for telling the truth
    Great way to destroy a company

    I remember in the late 1990's, Harmon Kardon produced something (I'm sure but not certain that it was a single-well tape deck) that received a poor review in a Hi-Fi magazine. I don't remember any legal action following that. What has the world come to? I also remember seeing a Hi-Fi magazine publish independent findings (including a two-page electrical equation) proving that Monster Cables were a scam. Again, no legal action.

      For sure, and we have to be able to freely discuss things. The answers are often nuanced and measurements don't necessarily tell the whole story certainly not in audio, but you can't just go suing people because you don't like their opinion!

    I watch a lot of TH-cam channels reviewing products sent to them free. Most just read the blurb on the back of the box and don't do an honest review of the product. There are some honest reviewers who know what they are talking about and are brave enough to call a crappy product crap.
    A DCS advert says they specialise in deep cycle lithium batteries that offer SIX times the battery life and less than a third of the weight of lead-acid batteries . That is a big claim for which they will have to provide prove from some credible expert.
    Law suits are expensive and the loser gets to pay the costs. By threatening to sue, the hope is that the financially stressed cannot afford to call them out. Just because DCS threatens to sue doesn't mean they will win.
    I was looking for a quality deep cycle battery from an ethical company. I guess DCS is not for me.

    I'm strongly in support of highlighting the issue Stephan has found himself in and I thankyou.
    But to categorise Lithium isn't suitable for under bonnett use clearly isn't correct.
    There is another family based business in WA doing tremendously well with their under bonnet Lithium drop in replacement batteries.
    Difference is, they market their stuff at affordable prices, unlike the company in question hence there are far far more units out there doing as designed to do without issue.
    Another TH-camr has tested them and done reviews on them being utilised for an entire lap around Australia under bonnet.
    I have run their specific under bonnett cranking battery since May 2022, so yes a lithium battery designed for under bonnett purpose can be utilised under bonnett.
    Please don't categorise, as doing so may take sales from the other family run company that are treating the public and customers right, that company is Itech.
    I do use their products and am an entirely satisfied customer.

      That's OK and thanks for your support! We can agree to disagree on the point of LiFePO4 chemistry and heat though. I've spent my life involved in science so there's no categorisation here, just information and what I know to be true based on the science. This is not my opinion by the way, it's simply about the chemistry. I neither like nor dislike the information, it's simply information. That said, I know the company you are referring to and I'm sure their products are much better.

    I watched an American TH-camr who stripped their batteries down , the batteries did what they said on the tin , but when taken apart what was inside was poor and dangerous.

    So DCS gives him under bonnet batteries to test and after 3 years he finds the batteries are not fit after loosing a lassive amount of capacity and they sue him. WTF is wrong with this company. Anyway, screwed themselves now. Only a name change will save them

    One notable example is I think New Balance. I've known for years that we step on eggshells if we criticise them publicly on media. I can't remember exactly which of the companies it was after several decades now.

    Feedback, as referenced in this video, SHOULD have been motivation to remove, improve and fix the product. Instead, the negative repercussions for this company by ignoring legitimate testing/feedback then proceeding with legal action is quite possibly enough to tarnish their credibility and possibly destroy their business. Very sad when actions such as these place the value of money before human safety.

    If a company is committed to providing the best product for consumers travelling jnto remote parts of Australia... they might welcome constructive feedback that helps them to identify flaws or improve their gear.
    As a remote outback, solo traveller myself, I would certainly consider purchasing a product from a company committed to my wellbeing.
    But not this mob. Changing the name of their business won't save them from this debacle.

    DCS must be mad that someone in authority put their ego to the forefront rather than sit down with the reviewer and talk about the review and the product. If they had done that there would have been an outcome that may have seen some parts of the review modified and also some aspects of the product improved or the instructions and warranty rewritten, and a soothing followup video and advertising from DCS. With DCS gaining credibility rather than totally losing it. Egos do get in the way of good outcomes to poor reviews.
    But they must have lost a very large part of their revenue and credibility instead. A very poor business decision that reflects very poorly on the whole company management and its products.

      Agreed, you are absolutely spot on and others have shared the same sentiment, myself included. Ego is the problem here. Suing someone who is simply making people aware of the issues on top of hundreds of others who've had problems is shameful. There is one person out of 200 in these comments sweeping for DCS. One. That tells you everything.

    It's interesting that the Australian government also did factual test on a number of different batteries and they showed the DCS battery fail badly. See Louis' video for the details. Doesn't this mean Stefan has the backing of the Australian government!? 😊

    Agree that DCS could have taken the higher ground and learned how to improve their product from this process.
    But what if this is true: what if these products are only profitable because they use salvage cells in their batteries with existing wear? What if they knew this from the get go? Maybe there isn’t anything to “learn” because they explicitly designed this product to have the profit margin it does by way of a deceptive tactic employed to deceive and rob customers of the normal cycle life of cells? Then there’s no way to make this scenario work because the company has been shady from the start.
    I’m not saying this is the case but it’s possible and if true, would explain a few strange data points.

    I have posted two review on batteries that did not meet the claims made in respect of capacity. The comparison was against two other brands using the same equipment. The two brands only reached at best 75% of the claimed capacity and I would be happy for the companies to follow it up but no response was received from them.

      Yes, I suspect a lot of people who think their batteries are 'fine' won't have tested the capacity of these batteries recently, or ever. This is one of the problems with this emerging use of LiFePO4 in a range of different use-cases, not enough long-term use data.

      @@LiquidAudio I fly radio control and a couple that I bench tested against are over two years old yet the new ones still didn't make it to 75%. I check capacity before flight and after, that still doesn't mean there may not be a problem and I have had one in a boat fail, not an issue, and one in a plane, that was an issue.

    Honest manufacturers of Lithium based batteries all have one thing in common they specify special chargers to suit them and research tells me that conventional charging systems as in Cars, Trucks and Motorcycles are not long term compatable with Lithium based Battery systems I have seen too many fail now to think otherwise.
    So if considering Lithium Batteries take note that the technology is relatively proven and safe as we see with so many things such as laptops and power tools if done right and as we also see with recalls not safe when not done properly .
    Or if used incorrectly as noted when placement in a safe environment is also critical as we see wuth cheap dodgy scooters causing dangerous fires and also some very expensive EV vehicles as John Cardogan has shown us among others exposing the dangers that have caused damage up to and including the loss of Vary large Commercial Ships due to the fire risk so many have glossed over.

    Once upon a time defamation could exist for something that is true but damages the reputation of another. The defence had to be that it was in the public interest. In the Bruce Lehrman case the defamation was dismissed solely on the basis that the judge thought that it might have been true "on the balance of probabilities". Which of these two is the correct interpretation?
    If the Lehrman standard was adhered to then any evidence that the review was true would become the end of the action. If the previous standard was adhered to then you would have to show that the knowledge was vital to consumers more generally.
