I can never drink goldschlager again! I was turning the bottle up and guzzling it at a house party 8 years ago. I ended up mooning everyone in the kitchen, then I went to the bathroom to throw up and puked all over every square inch of their bathroom, and passed out in the bathtub with the door locked. they had to take the door off the hinges to get me out. I was never invited back to their house for anymore parties:(
I would say in this situation if you couldn't find the painting you could contact the customer and tell him/her that you are painting it right now. Unless there is something special about the time and date you painted it, it shouldn't matter to the customer I would think. Also, the products shown on your website can look a little different than the final product, cuz it's art, it can't look exactly the same every time. Now, if you are advertising your paintings as if there is only one copy of it and the painting is unique then it should look exactly like the picture you post on your website. So, make sure your customers are aware that you produce several copies of the same painting and every time it will look slightly different. Or if you want to advertise it as unique and paint it just once, make sure you put it somewhere safe! BTW I'm not a lawyer so I'm not sure how the law exactly works in the state of NY, just speaking from experience of selling handmade products.
