Depositions of Jacksonville Sheriff's Office in Police Brutality Case: JSO Undersheriff Pat Ivey

  • At about 2 PM on April 27, 2016, Jacksonville, Florida resident, Mayra Martinez reported to her first day of work at Scores Bar after recently moving from Orlando. She was reportedly fired after being served alcohol (or something else) by fellow Scores employees. Scores called the police and reported her as “trespassing.” She was kicked out without her purse, social security card and other belongings. Police arrived quickly. The events thereafter can only be described as a disturbing series of violations of her civil rights and human rights. This deposition was taken in that civil case.
    I. UNNECESSARY USE OF FORCE (PARKING LOT)
    Rookie police officer Akinyeme Borisade of the Jacksonville Sheriff’s Office reported to the scene. He and a fellow officer pinned Ms. Martinez on the ground and used “ground and pound” techniques on her. It appears the officers also hit or shoved her head into the asphalt. She can be heard screaming from a good Samaritan’s dashcam, “I didn’t do anything.” The arrest report differs from the dashcam, as these officers where not aware of being recorded using unnecessary force.
    II. UNNECESSARY USE OF FORCE (JAIL)
    Ms. Martinez was then transported to the sally port (intake corridor) of the Pre-Trial Detention Facility of Jacksonville Sheriff’s Office by the same officer. Footage depicts her handcuffed and standing around being largely ignored for some time awaiting processing into the jail. At some point she says or does something officer Borisade disagrees with. He approaches her and shoves her into the wall. She reflectively kicks back and he pummels her in the stomach, chest and face, knocking her completely unconscious.
    III. FAILURE OF OFFICERS TO INTERVENE
    Officers have a duty to protect individuals from constitutional violations by fellow officers. Therefore, an officer who witnesses a fellow officer violating an individual’s constitutional rights may be liable to the victim for failing to intervene. You can clearly see this in the above video- apathy, lack of concern, repeatedly failing to intervene or taking over for the officer who clearly had lost his composure. The Blue Line was protected despite clear abuses of power.
    No supervisor ever stepped in or controlled this probationary officer. Sure they terminated him after the incidents, but it was too little, too late.
    IV. FAILURE TO PROVIDE ANY CARE OR CONCERN FOR UNCONSCIOUS VICTIM FOR 15 MINUTES
    Detention and correctional facilities have an obligation to provide adequate medical care to detainees and prisoners. They are in the care, custody and control of the institution, and are unable to seek their medical care elsewhere, as free persons may. As such, considerable time, effort, and expense must be devoted to protecting injured or sick inmates. What you see in the above video is beyond disturbing. Ms. Martinez was left to potentially sustain serious neurological injury, or die, without one person checking her pulse, breathing, whether she would choke or aspirate on her own vomit, etc. She did not move for nearly 15 minutes and no one showed any care or concern about it.
    V. REFUSAL OF HOSPITALIZATION RECOMMENDED BY EMTS BY OFFICER BORISADE
    Once Jacksonville Fire and Rescue were finally called by JSO and arrived, they were given false or a fundamental lack of information. The EMT report indicates officer Borisade only admitted hitting her in the stomach and claims that pain in the stomach was all she complained of. She is clearly unconscious at the time of the incident. The report makes no mention of any head trauma. Making matters worse, the EMT report indicates EMTs repeatedly urged Jacksonville Sheriff’s Office to allow them to take her to a hospital in the ambulance located only a few feet away. However, the very same officer who harmed her was authorized to refuse her further medical treatment or hospitalization “against (the EMT’s) medical advice.” He had no business being in her presence at this point, much less making medical decision on her behalf after committing multiple crimes of battery against her.

      Seems like a good dude. The problem is, legally, it’s not advisable to answer with total clarity. An employee under him did something horrible, he had that employee terminated and arrested. Does that mean he should agree when asked if policies are only as good as those executing them? Legally, no. Privately it’s pretty straightforward YES.

      @@enoshadowwalker119 you’ll notice, I said an officer under him did something horrible, HE HAD THAT OFFICER FIRED.
      I didn’t say or suggest he should tolerate poor behavior from an officer. You’ll also notice in his explanation, there’s a process depending on whether or not the officer is through the probationary period. If not through the period, his position has authority to immediately terminate the officer. If through the probationary period, he has to wait until the officer has exhausted his appeals afforded to him and can only reassign the officer to desk duty until termination proceedings can officially happen.
      That was made clear. As a tax payer too… idk why people bring that up.. if you’re working, you’re paying taxes… I also expect government employees to conduct themselves in accordance to the constitution and respect the rights of anyone they interact with. I also expect tight control over any misconduct. This individual clearly explained it all.

      I agree completely. I know Borisade was fired but can't find whether he's been decertified. I think decertification is imperative to deal with a hazard like him aside from any other repercussions.

    This woman was brutally beating total of 3 times
    When they are all watching, and then before the get her in to the patrol car the little cop strike her 8 times in her back, prior to this She get punched with a closed fist on her stomach
    When She arrived at the jail is at least 8 men and 1 woman
    And She only got $92,000.00

    There's clearly a distinct disconnect between policy and the way things are done on the street. This is a command officer who oversees the organization and says things should be done based on the behavior cited but what was done when these things were flagged. Nothing. So the issue is no officers believes that another officer uses excessive force. They never complain about another officer. Why wouldn't it be policy that another officer should stop another officer from using excessive force and that removed from the situation. Isn't that common sense.

      It is absolutely common sense. The policy manual intentionally leaves things out to protect bad behavior. Your complaint was not upheld because the officer did not violate any written department policy. Convenient huh?

      While I am not a back the blue guy, a buddy I served in the Army became a cop after he etsd. He did report a fellow officer for "cowardice" an actual charge for failing to help him when citizens were in distress. What became of it idk.

      Dirty Deeds in the song refers to committing a contract murder for dirt cheap for the perceived reasons referred to in the different stanzas of the song. It is a made up phrase by the artist.

    BUT the general attitude about the use of his force shows clearly by his fellow officer saying, “You are on camera.”. This implies that OFF camera-all is ok...Cop culture is out of control lately and needs to be reeled back in.

    What is policy meant to do?
    If a policy is broken, what is the policy of JSO?
    Why does JSO punish an officer who has deviated from policy?
    If punishment for deviating from policy is to correct an officers deviation from policy. Why would you lower the punishment recommendation from the integrity unit?

    This guy says, over and over, that he doesn't know what current policies are, because they change so often.
    He tries to reinforce this claim by saying when he recently got back from vacation, he received notification of a policy change.
    Right there, he accidentally admitted that he gets notified when policies are changed.
    Policies aren't changed in the back room and the changes kept secret.

    Under sheriff says that if an officer gets caught DUI, he or she is subject to the same laws as everyone else. So, how come we keep seeing videos of DUI cops getting trivial punishments in court and walking free when Members of the public who go to court and are proven to have driven under the influence don't come away with probation, they either get landed with a hefty fine or jail time ?. Double standards needs to cease.

    Cannot resignations be denied until criminal matters have been resolved ?. Seems to me that resignation is simply a way of avoiding the consequences of criminal acts, and a way for guilty police officers to avoid the revocation of their policing licences.

    It's hard to believe that someone who's earned a law degree doesn't know the etymology of the term "sally port" and it's one more reason why more Americans should be bi-lingual, at a minimum. The more languages one knows, the easier it is to figure out the origin of words or expressions.
    This cop is the most talkative of the group of cops in these depositions, so far at least.

    Why can't they draft a policy that says "If your cop buddy is bashing a handcuffed unconscious citizen in the face with his 9mm, stop him'' and not "48 hours later, you can tell your supervisor if you are not too busy, unless the citizen is dead, in that case just go back to sleep"

    I've always maintained that the Buck stops Here in the Police Chiefs doorstep which traces back to the Police Academy. It's a rarity that an officer will Bully or Brutalize or Kill a citizen unless he knows his Boss will support his actions. This condensending Sheriff Pat responce would be.. Oh he reminds me of myself in my heyday. Sheriff Pat is bullying this lawyer right now!!! And hes angry as his tactics are Not Working with this Lawyer 😂 Picture ole Pat here 10 years ago even 5😡 we've watched Sheriff Pat struggle to hide his anger at questions from this Lawyer !!

    I believe Borisade acted out the way his was taught. He learned what to do from his colleagues. Policies are there for the hierarchy. In reality that's not how policing is done.

    First of all, all these agencies and police departments must and have to adjust and “respect” the statutes, the civil rights of citizens declared in the national constitution! ...and if I am not mistaken, in this case the court ruled against the procedure of the two officers who “set up” the girl by removing her from where she was sitting on the curb, to take her inside the parking lot to arrest her for trespassing!…which on the other hand this arrest is poorly applied since the officer who was arrested only He let himself be carried away by what the owner or manager of the Bar told him, and he did not listen to Mayra Martinez's version that told him "how are they going to accuse me of dectrespassing, if while I was edtube inside the bar I was an employee?...once they threw me out I stayed outside the property waiting for my purses and belongings that were left in my locker to be returned to me”…then once the officer collects the girl's belongings and returns them to her in the parking lot, the same officer decides on the arrest for trespassing! ..even that this officer was not the one designated for that procedure or to make the determination of the arrest! ..since that officer was the backup of the other officer, and this assigned officer in turn was the one who made the report as it should be , but he did it by taking the decision of his backup partner and not by his own determination!...even taking from what his backup partner told him that "the manager" accused the girl of transpassing!...when he himself should have having communicated with the manager, evaluating listening to both parties and deciding for himself and not relegating it to his second!...he even declared that his decision was to get a ride to take the girl home, but that the other The officer decided to arrest her instead of letting her go! Not only did he not report in the writing the situation of abuse of unnecessary force (fist blows) applied by his partner towards the detainee, he also did not report any injury suffered, nor differentiated treatment for those who are in a state of intoxication!...everything done wrong from the beginning by 2 inexperienced rookies who did not even call their supervisor before making erroneous, serious decisions that did not end in a fatal case!.it cannot happen that they leave the streets to people without the necessary instruction and experience alone to decide on the safety and future of citizens, violating civil rights at will, as if they were absolute “judges” of the streets!

    They just can't take not being the ones in charge. Imagine knowing you are being recorded for the courts, having an attorney paid by tax payers for you, and still feeling the need to insert your authority. In fact he did a test with the name mispronounciation just to see how they'd react.

    That officer thought it would just be an old boys club chat .... so used to his own way of being in charge , but when specific question arise he stumbles and gives his own opinions as to correct procedures actions responsibility and procedures... he fails to comprehend ,...he is not enjoying being over powered by the questions,, he is getting angry that he is being questioned, and is struggling in that situation of being dis-empowered = he cannot give his orders .he cannot be the command. cannot have authority over them. his casual friendly hand gestures etc are beginning to fail him. .. unfit for purpose, waste of tax payers money get rid of him.

    How was he hired in the first place? Convicted shop lifter. He says he got the wrong friends when younger!!! How many in American correctional centers say the same? How many convicted shoplifters go on to commit more serious crimes? Obviously social problems,he studied his degree at home!!! Young person choose to study at home?? Red flag for me. His employers in law enforcement do not look at his social media?? So the state of Florida paid for his way through academy and then pay his legal fees???

    incredible!!..this sheriff saying that the agency under his command be considered the best positioned nationally after all the irregularities and lawsuits for abuses of all kinds, especially “unnecessary use of force” and intentional lack of medical attention, letting simple officers with little or no experience decide whether or not an injured person needs medical attention or not, even when fire dept “rescue” ambulance personnel advise them to treat them in a hospital, many of these simple officers decide to proceed without providing care, classifying them as "fake" that they are acting!...the bervorragia that these people have that helps them ask for votes at election time, but once in office they do everything to cover themselves from all blame in the poor functioning of the agency and not to improve it !..only when cases like these are published that explode in public opinion is that when they move a little, more than anything to cover themselves!..
    Is his agency is one of the best nationally, I can’t imagine how horrible are the rest!

      This was a discovery deposition. It's our chance to truly get into their head and get to the bottom of what their opinions will be for trial. The case settled shortly after this deposition, so I certainly disagree we didn't have a plan or accomplish it, because we did.

Now this abusive fist swinging cop looked like he needed natural human growth hormone when younger so maybe he was taking steroids now-maybe not as well, IDK, but in general I can see it is an issue and they should be tested on the regular...

    This officer appears to be a good one. Judging by his demeanor and resonses. I hate what happened and they sre no longer there.
