- सुप्रीम कोर्ट ने केंद्र सरकार को जमानत को लेकर नया कानून यानि नए Bail Act बनाने पर विचार करने के लिए कहा है... कोर्ट ने कहा कि अभी भी भारत में आजादी से पहले की कोड ऑफ क्रिमिनल प्रोसीजर संशोधन के साथ आज लगभग उसी रूप में मौजूद है। कोर्ट ने कहा है कि स्वतंत्रता कानून में निहित है, इसे संरक्षित और संरक्षित किया जाना चाहिए। सुप्रीम कोर्ट ने कहा, ''लोकतंत्र में कभी भी पुलिस राज नहीं हो सकता। भारत में आपराधिक मामलों में दोषसिद्धि की दर बहुत कम है। देश की जेलों में विचाराधीन कैदियों की बाढ़ आ गई है। कोर्ट ने कहा, हमारे सामने जो आंकड़े हैं, उनके मुताबिक जेलों के 2/3 से अधिक कैदी विचाराधीन कैदी हैं। जबकि संज्ञेय अपराध के अलावा इनमें से ज्यादातर कैदियों को गिरफ्तार करने की भी जरूरत नहीं सकती। सर्वोच्च न्यायालय ने कहा है कि हाईकोर्ट को विशेष अदालतों की आवश्यकता को लेकर प्रयास करने चाहिए। इस मसले पर विशेष अदालतों में पीठासीन अधिकारियों के रिक्त पदों को शीघ्रता से भरने का भी आह्वान किया गया। SC ने सभी राज्य सरकारों, केंद्र शासित प्रदेशों और हाईकोर्ट को चार महीने में स्टेटस रिपोर्ट दाखिल करने का निर्देश भी दिया है। सुप्रीम कोर्ट ने कई दिशा-निर्देश जारी करते हुए कहा कि जमानत याचिका को दो हफ्ते में निस्तारित किया जाना चाहिए। अग्रिम जमानत की याचिका छह हफ्ते में पूरी होनी चाहिए। जस्टिस एस के कौल और जस्टिस एम एम सुंदरेश की बेंच ने ये निर्देश दिए हैं।

Hon'ble sir, kindly be received my heart felt suffering that my daugter in law died by suicide, the report by pm as cause of death is asphyxia due to antemortem hanging but marraige time was only 3months but applied several times exactly at adj court, bdk in odisha 3times& after rejection for bail under 439crpc still highcourt of odisha, ctc is nt giving bail that rejected 2times&directed after material witnesses but out of 5material witnesses 3witnesses have given in court but 2witnesses the comlainant&her nefiew are nt coming to court being summons 3times still my only son is langushing in jail custody that more than 2years for 498(a), 304(b), 34.But informant knowingly trying with anger to supress his body &brain by a plea as she is ill. 75years independence that we are going to be celebrated but highly educated persons leaving his service is languishing in jail custody but as out of 5material witnesses 3has given there is no crime for my son, still why one will suffer in jail custody. Sir, many false allegations are continuing in odisha state, the police in odisha by listening&fir without full investigation nt even 20% using his with political or other in a suicidal cases police are arresting to husband&his parents into jail those who have no link with crime they are going to jail. For human point of view kindly be enacted a law bywhich no innocent will go to jail custody that is my prayer from citizens of india though iam nt elected to say this above still my conscince oblige to inform all to consider the above matters. The complainant by putting jail to innocents are also attacking severely heather &thether but if accused persons are complaining from jail custody &out side of jail custody police are nt registering their problems basically in our odisha state. What police wants with powerful complainants are harashing bkz theirs fir is nt registering that the worst work for a justice point of view for that accused persons have no otherway except silently crying by complainants effort. They even trying to the best leble how they will more turture every where ie socially, mentally, physically, economically as no fault of the accused. Who will be responsible for suicide of a wife of m. Tech degree &after failure of opsc several times &she has stated in whatsapp chatting if I willnt pass my parents willnt say any thing but I will remain guilt for life long. With anger complainants family members attacked severely &attacked an otherday by complainant's 4th brother. I gave complain to thanaedar still it has nt been registered. How a citizen will get justice now adays in odisha. Kindly be consideredthe entire above for real justice point of view. 🙏🏾🙏🏾🙏🏾🙏🏾...........................

All discretions are colonial vestiges, is not fitting in a democratic independent State, should be wiped off. Law should decide.
2 weeks for deciding bail is too long a period. When the SC itself has said in Anil goswami's bail case that jail for one day is one day too many. A day or two days should be enough for deciding bail application.
