Indigenous people from groups which originate outside of United States of American Jurisdiction aren't considered Indigenous people within United States of America's Jurisdiction. That's the Law.

The problem is that the tribes who stay still have much proof and documentations and relationships with other surrounding tribes, sometimes positive and sometimes negative. They were forced into very specific areas and the tribes that get claimed specifically are the ones who got rounded up. If someone said I am abandoning my tribe to live over in this area and not maintaining connection, they have left the tribe. Even if their 10th great grandson feels like they are owed something they are not. That is not the case though, people fabricate ancestors and use other people's and try to find any reason they can not to maintain and be part of the Cherokee culture, but to misrepresent and make money off of it.

If there are Tribes that receive programs and services from the Secretary of Interior just because they are Indians… Are they or are they not Indians who are members of Tribes when the Secretary of Interior acknowledges or else recognizes the Tribe under the Indian Self Determination and Education Assistance Act of 1975. The BIA knows Indians and knows Tribes. It’s their unique function.

The 14th Amendment protects all Rights, Privileges, and Immunities of all American Citizens. Take another look - It is the DOI/BIA who Federally Acknowledged State Tribes using the Code of Federal Regulations to do so. Why? Because Indians are Indians just because they are Indians. This goes far deeper than administrative code. It is in the U.S. Constitution at Article I Section 8 Clause 3 which names expressly “Indians” and NOT “Federally Recognized Indians”. Look at the tribes in California who had their recognition wrongfully terminated under the rancheria termination act. Look at the Chinook of Washington look at the Lipan apache of Texas and so on..
