This week, TH-cam creator and Newslaundry’s former editor @meghnerd is the host, joined by Newslaundry’s Raman Kirpal and Anand Vardhan, Supreme court advocate Vrinda Grover, and journalist Aditi Phadnis.
On the three criminal laws that came into effect this month - Bharatiya Nyay Sanhita, Bharatiya Nagrik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam - Vrinda says the BNS that replaces the Indian Penal Code will reduce argumentative Indians into mute spectators. “In many ways, they are a pre-Diwali bonanza for the police as their arbitrary discretions have been further enhanced and given statutory recognition.”
Raman says a lot of chaos is likely to ensue in the Indian judiciary, “especially for the police custody for ‘rajdroh (sedition)’ and ‘deshdroh (treason)’.” Meghnad talks about the first person, a Delhi street vendor, to be booked under the BNS.
On the ongoing Lok Sabha session, Anand says, “The political theatrics reflect the changing nature of engagement between parliamentarians and their audience… live coverage tweet-by-tweet has made them appeal to the larger Twitterati for virality.” Aditi says these theatrics have landed the BJP in power.

That's not the correct interpretation. False promises to marry for the purpose of getting fraudulent consent for intercourse has been considered rape even before this law.
It was a supreme court precedent, not codified but still law of the land.
They just codified it.
They don't care if a couple breaks up or if a girl gets dumped. But if the promise to marry itself was a lie then the section comes into play.
I personally think it's a dumb law. It's kind of an insult to women as well. If you wanna be "pure" then wait till you get married. Don't be stupid enough to be fooled by "promises".
Bolne ko toh koi kuch bhi keh sakta hai. And even if the promise wasn't false engagements and relationships break all the time. If this is that big a deal for you toh say no, if the guy respects you he'll wait. If not toh jaye bhaad mein.

The main reform that was needed is not done - all Indian police stations need a detectives-only department, that is good at forensics, deduction, evidence collection, interrogation without brutality, court-sanctioned surveillance and so on. At the moment, Investigation Officers as well as members of investigation teams are also burdened with mundane, unintelligent tasks, and the members are often not as sharp as a full-time detective would be. In short, the police system has a shortage of honest and sharp brains, because the brains are also forced to do brawn work, and the brawns are made to do brain work. Of course, that system can be corrupted too, but at least it will function in cases where there is no corporate or political interest involved, as well as, the detective department being different from the arresting department will lead to a check-and-balance. There will also be more FIRs going to the "closed due to poor quality information" or "false accusations" basket easier. With brains being passed on to the police station level, the burden of frivolous cases and bad evidence will go away from the courts.

Hi, Just a curiosity; how these three criminal law will have a negative impact on the drug law (NDPS Act 1965) of criminalisation, harassing people who use drugs for possessing drugs for personal use. that will be an insight for the people working for the health and rights of people who use drugs in India? Not much. That's a special law. This are the big three general laws.
Some procedures may overlap but otherwise not much changes to any of the special criminal laws.
@@simransimran9339 War on drugs is really rising in some region and it has started lynching or killing of the people.. The NDPS is colonial law still exist in the name of saving mankind but in reality its just a politics... NL can have a great debate on the drug law and its implication on poor and marginalising certain catagory of people.

Hindu religious law is known as "Bhragu Sanhita" which describes Varna System of caste hierarchy and treated women as very poorly and many more hilarious things.

@@luimui3107 I think Anand is more right to centre and meghnad is left to centre of political spectrum. But this is just my observation about their political ideology and may not be the reason on their differences. Maybe we are just reading too much into their dialogue
