So the fake gun gets you in trouble… IF you use it in commission of a crime. I’d say the fake gun isn’t really the problem, then.

If robbery gets you ten years, but armed robbery gets you 25, it matters. However, I don’t know why Mr. Hegshot feels the need to educate anyone contemplating either one. 🤔

Not in all areas. I can have a G19 on my hip, 100% legal in Philly but I can't order an Airsoft or BB gun G19 and train with it in Philly. I can't even have it shipped to my house. I know plenty of people who run MilSim for fun and green gas pistol to practice at home. It's actually a crime to have an airsoft or bb gun in the city. If you're training and not actually doing something stupid it's largely unenforced in the city.
NJ having ANY BB gun even unloaded on your person in the woods, in your vehicle enroute or even at home but don't have an NJ FOID card it's a crime and treated the same as a firearm. Discharge in most counties is treated as discharge of a firearm. Airsoft and paintball is good to go though.
So absolutely even an unloaded, replica of a real firearm can get you charged. I work in NJ in the Tactical Medical training area and we use airsoft and BB not to fire projectiles but to use for searches and air feedback. Never loaded with anything and I have to keep blue painted, bb guns locked in my Pelican case like it's an actual gun. I was not aware of this and a cop at a class was like "Hey, I wouldn't care on a stop. But NJ State Police is notorious for things like arresting people for these type of things. Do you have a lock box or Pelican case that locks? Might want to put that in there driving home. You have PA plates and already are a target for NJSP so just letting you know" I've kept it locked up ever since.

My family and I could not locate the card we were required to maintain to prove compliance with the law. As the only member of my family who owned firearms I had to bring the handgun to the local police for a replacement firearms registry card with my Dad's death certificate to prove my legal standing to receive a duplicate handgun registration card. It was not a big deal whatsoever.
