      I felt her pain. She’s trying to do the right thing in this case and the judge is refusing to hear her. She has laws she needs to follow which prevent her from speaking out and all she needed to do was approach for him to hear what she needed to say.

      The crazy part is that even though the client was extremely rude and his wording unacceptable, the gist of what he said was correct. She HAD just explained why she couldn't represent him anymore, at least in terms enough for me to understand and I have no background in law enforcement or the justice system at all. Judge wanted her to spell it out when she couldn't and he's far from stupid- he knows if she said she couldn't in front of the DA then she knew what she was talking about. And wouldn't let her approach to further explain outside the DA's hearing.

    • @mommy2libras
      @mommy2libras ปีที่แล้ว +2

      Sometimes they do. I know some misdemeanor offenses- I believe like misdemeanor traffic offenses, nonviolent, non drug related type things- when you finally do go to court and get fined and jail time, they will let you serve your time so as not to lose your job and whatnot. I do know that in some states, depending on things like your criminal record, what steps you've taken to take care of stuff in a timely manner, etc, DUI/DWI will be allowed to serve jail on weekends or on work release, meaning you report to jail every evening after work and then go to work again the next morning. And those are felony offenses everywhere, I believe. It really depends on the judge, you and your record, situation, etc. It's not necessarily an option for everyone.

    30:51 super, my therapist is a woman who lies to the court and defrauds the court because she’s drinks so much she can’t control herself. I’m sure she gives great therapeutic advice 👍

    • @mommy2libras
      @mommy2libras ปีที่แล้ว +8

      While it's definitely not a good look and doesn't excuse her not complying with her bond conditions, keep in mind that your therapist is still human. They're not going to be a robot or be perfect- they have a regular life and regular problems like everyone else does. Add on to that listening to and helping dozens of others with their problems every week, being there whenever and whatever time they have a crisis, etc. And simply stepping away isn't an option, if for no other reason than they don't want to leave those who do need them feeling abandoned. Most can compartmentalize and keep their own emotions out of the lives of others but what I'm talking about is a separate thing, more like intense pressure and responsibility on top of everyday stuff, and this woman also mentioned dealing with domestic violence herself.
      If this woman has been helpful to you and you have a good connection (which is important in a therapist- there are many good ones but you won't feel a connection or have good rapport with all of them and you need that for therapy to be effective), then continue to see her but realize she's not infallible any more than you are. A shift I perspective and some compassion I places you didn't have it before can and generally do have a positive effect on your outlook.

    Does the state of Michigan not pick up the charges in DV cases when the victim is unwilling to testify? I thought they did just like in James Johnson's case. The burden should be put on the state not the victims as they could be influenced by their abusers either through violence or brainwashing. It happens all the time often with devastating consequences.

      Yes they do but ultimately it will be dismissed without the victims participation. It’s extremely difficult to win a case without a victim so they won’t take it to trial. The state will drag it out hoping the defendant will take a plea, if the defendant can hold out it will likely be dismissed.
