    I reacquired my Filipino citizenship when I turned 70. I did it because I wanted to own a property in the Philippines. I feel more comfortable coming back every year to the Philippines.

    I was born of Filipina mother and a US citizen father in the US. I later did a delayed registration of birth through PSA and got my US birth certificate printed on PSA paper - I then was able to apply for a Philippine passport and driver's license. I have zero restrictions coming in and out of both countries. I also never applied for dual citizenship because I was born a filipino and american at the same time. I never lost my citizenship on both sides since no oath taking was done on either side.

      @@janusaquino8523 Yes, I did it while I was in the Philippines while my over stay fees were piling up. When it was all said and done, all fees were dropped. Here's a link to get you started.

    A disadvantage for a dual citizen individual, for example - a U.S. & Filipino dual citizen, you would not be 'eligible' to work for a (U.S.) government, a government contractor or any other entity that requires you to have a 'top secret' clearance as a job/work, which is usually a high-paying job, however there are exceptions.

    You should've talk about how to acquire and apply for Dual Citizenship for those who were born before 1973. Both of my parents were born in the Philippines and my father came to the US by way of joining the US military. What steps do I need to do in-order for me to acquire Dual Citizenship?

    As an American, whose mother was Filipino (deceased), I fall under the rules "before" January 17, 1973. At the age of 61, I am not eligible to acquire Philippine Citizenship, because I did not elect the citizenship at the age of majority (18) or within three years. The problem with this today is that due to the use of the Internet, we can find all the information we need on Philippine citizenship, but back in 1979 - 1982 (I turned 18 with 3 years after), there was no internet....no information readily available. As a result many people of partial Philippine ancestry are excluded from Citizenship.
    The only question I have for the future, do you think they will retroactively change that policy for people who fall under rules "before" January 17, 1973? It appears that today, it is much easier for all other categories of mixed ancestry Filipinos to acquire Philippine Citizenship (everyone after January 17, 1973)

      Hi. Unfortunately, there's no move from Congress to make the law retroactive (to children born before Jan 1973). It's not their priority. As an alternative, you can inquire from a PH embassy/ consulate if you are eligible for the 13G visa (permanent residence), if you are interested in living/ retiring in PH.

      @@marlenerodulfa4397 if the US citizen is a former Filipino (natural born Filipino), then YES he/she can buy/ inherit land, but size of land is subject to limits. If US citizen since birth (like the OP), or US citizen with no Filipino parent, then no. He/ she cannot buy land. The person must be a former Filipino citizen to be qualified to buy/ own/ inherit land. There are certain exceptions but too long to type. A foreigner can buy/ own condo units.

    Jocelyn, my 94 y o mother is demented, US naturalized, not dual, one year overstaying since March 2023. Total 19 months overstaying. To bring her back to US is very hard for her health conditions. Your legal advice is much appreciated.

      Hi. She needs to go to a Bureau of Immigration office to pay her overstay fees. Because of her condition, she will need a companion. If you want her to return to the US, she needs ECC (exit clearance) and will need someone to accompany her during the flight. IMO, you need to discuss with family members where it's best for her to stay - PH or US. Good luck.

      My son and girlfriend are U.S. citizens, they came to Philippines for vacation. They were only one day exceeded, not knowing it would affect their status. They were finalized 5,000 each person. Just for one day over stay. This happened 2024. Your mother needs to explain to the immigration why she overstayed, hoping they will consider non exempt. But knowing immigration for many years, it’s impossible not to finalize her for overstaying.

    I'm a naturalized US citizen with natural born child. Us parents did not report the birth of the child to any consular office or wherever. We simply applied for dual citizenships and our child was included in the application. The Philippine consular delegate traveled to our state during a Fil-Am event where we received our dual citizenship papers.

      @@ropineapplehead2198 Our US born child and us parents were given documents by the Philippine embassy here for dual citizenships. No Philippine passport needed . We use our US passports for travel and show those documents at immigration upon arrival.

    There's a tax exemption law stipulation that if you meet the "Physical presence test"; you are outside the country for 330 full days during any period of 12 consecutive months including some part of the year at issue. The 330 qualifying days do not have to be consecutive, you are exempt from taxes.

    One negative of having dual citizenship in the US, especially for a younger person. If you have dual citizenship and are trying to get a job that requires a security clearance, you will never get the clearance. There’s always the question of your loyalty to the US. Examples would be certain federal government jobs, certain occupations in the military, and jobs with private companies that are military or government contractors.

      You can still get the gov’t job, but they may require you to relinquish the dual citz. or you can try to get a gov’t job lower than a TS depending on agency.

      Happened to my son. He was required to relinquish his Philippine citizenship and passport. Once he retires or no longer needs clearance, he can easily reacquire Philippine citizenship.

    The Philippine Government -- or Congress -- should REPEAL the LAW that mandates AUTOMATIC FORFEITURE of Filipino Citizenship, when one becomes a naturalized citizen of a foreign country. When a foreigner applies for and becomes a naturalized Filipino citizen, he does NOT forfeit his original citizenship.

      AUTOMATIC FORFEITURE is not Philippine law, it is a requirement by the country one wishes to naturalize. Philippine law allows you to retain/reacquire one’s Filipino citizenship.

    When you are going out of the Philippines, you need to show your dual citizenship certificate and you should have no problem, same when you return back.
    2. I understand that every US citizen needs to file yearly tax.. Clarify lang po, do I require to file tax as well in the Philippines? I am retired from US and no other income. Just want to make sure po.

    Philippines can offer no visa required for an AMERICAN citizens entering as visiting travel or a tourist only.up to 6 months period.

    If you are a dual citizens, there's no need for a Philippine passport (it saves you money and hasstle at the Consulate Office). Just bring your "Certificate of dual citizenship" issued by the consulate and show it at immigration when you travel to the Philippines.

    I wish you complete advantage and disadvantage of becoming a dual citizenship. I heard some people says if there is war since you have dual the US will not prioritize you, and there are more also about restrictions like work in the government that’s why until now I remain US citizens with my kids.

      Yes, there are some federal positions (that need security clearance) and or if you work in the US military = you are allowed only US citizenship. If there is a war and you happen to be in PH during that time as a dual citizen, the US govt will prioritize US citizens (not duals) for repatriation. Reaquiring PH citizenship is a choice.
      For those who wish to retire in PH and are 60+, many choose to have PH/ dual citizenship simce they can stay forever in PH and they can get a PH senior ID card (and benefits).

    I am a former Filipino who was adopted at the age of 3. I plan on entering the Philippines with the Balikbayan Visa because I have a PSA birth certificate. I applied for Dual Citizenship in the States, but the Chicago Consulate said I had to do it in the Philippines. In preparation for my trip, I got all of my documents notarized and received apostilles on any document I think I’ll need, including affidavits indicating I have no information about my birth mother. Is there anything else I need to consider before applying for dual citizenship in the Philippines? I’m expecting to leave within the next month.

      So much red tape for people that don't have much money. They want you to fly a million miles, book hotels and bleed money before they tell you your paperwork is not in order. Come back later.       Didn't want to do consulate as it's a hassle. So easy to do it in the Philippines. Just birth certificate and application form. Took me less than a week to get mine!

    I do not want to be dual because I came to usa when I was 11 yo. The government paid for my middle school, my High School, my breakfast, lunch and for my trade school( Job Corps) the USA gave me the opportunities and now iam giving it back to the community. And if I was in the Philippines, I would not get the same opportunities. But i will not forget where I came from.

    Well, I just got offloaded in the the airplane. I am about to go to the US. I only present my US passport. Then they ask for my Philippine passport but I wasn't able to present it. So they suggested me to process an ECC. But I was born here in the Philippines. My mother is a Filipino. It's just that I didn't presented a Philippine passport that's why they ask me for an Exit Emigration Clearance.

      Hi. You are considered as a foreign national simce you are carrying a US passport. As a foreigner, if you stayed more than 6 months in PH, you must get ab exit clearance prior to ypur flight. Yoy may be half-Filipino (since your mom was a PH citizen) but it doesn't automatucally mean that you're a Filipino or dual citizen. It also doesn't exempt you from the exit clearance.
      Re: being eligible for dual citizenship, were you born before or after Jan 1973? The year matters - the vid mentions it at 3:40.

    Hi, I am a Filipino mother. The father of my four filipino citizen children is a Dual Citizen, American & Filipino. Their father is already dead last 2019 and was not able to report the birth to the US Consular. My question is, what are the reqiurements I need to prepare to claim US Citizenship for my minor children? Are they automatic Dual Citizen? What will the process? The US Embassy is requring me that my children shoulf be a US Citizen so that they will receive their SS Pension from their late father. Currently my children are receiving pension from the US Veteran Affairs. I don't know where to start on this US citizenship matter for my minor childre.

      Hi. Do you have the passport and death certificate of the US citizen father? Your marriage certificate and the birth certificates of your children? You may have to file the report of birth abroad (CRBA) in behalf of their dead father.

To make it short to my questions, I am US citizen but former Filipino ,I’m going home to Philippines around October 2023 and I’m going to apply for dual citizenship, but I’m also bringing my son with me who was born in US. What is our travel situation to be considered. I mean ,do I stands as Balikbayan and my son as well? Or is he a tourist only as he will only stay there for two to three weeks. Please clarify me and my son in order to be more prepare or aware and perhaps be at ease when traveling to Philippines! Thank you!!

      You, as a former Filipino, is considered a Balikbayan and can stay in PH for a year, visa-free. Bring proof of being a former Filipino (old PH passport, PH birth certificate).
      Your kid, thru you, will also be considered a Balikbayan (if he travels with you). Bring his birth certificate showing you are the mother.
      If your kid is a minor, it is best to have a letter from the father allowing the kid to travel with you without the father. This is only suggestion in case you are questioned.

      May I suggest apply for dual citizenship in the states if you are in a nearby philippine consulate... getting a dual in the Philippines through the bureau of immigration is SHIT, you'll just waste too much time and repeated visits...

      Yes. If you were dual during her birth, then she's also dual (was born dual). However, you'll have to file a Report of Birth at the PH embassy or consulate which covers the area/ state where the chuld was born, so that she can be recognized as a PH citizen and have a PSA-issued birth cert (will be needed in case she applies for a PH passport or if she studies in PH).

    I become a dual citizen just recently, about a year ago. My son was born in the U.S. and I was a U.S citizen when he was born. Does my son has a chance to become dual citizen? Can he qualify to apply for Filipino citizen and what are the requirements if he can? He is living in the Philippines right now for almost 4 years but he does goes out of the country every 6 months which I believed he needs to do to follow the law, he have businesses in the Philippines with Filipino partners. Is there a way for him to acquire Philippine citizenship? Thank you.

      Under his and your circumstances, he would be treated as any foreign citizen. He probably should look into becoming a lawful permanent resident first. There are numerous avenues for your son to become a Philippine citizen and he would need to choose which suits his needs/timeline. BUT one thing he will need to look out for if he decides to naturalize is if he has to renounce his US Citizenship which could become a bad proposition. When one becomes a US Naturalized Citizen, they in fact renounce their foreign citizenship. I’ve not ran into any documentation if it is or not renounced to obtain Philippine citizenship.

      Just an opinion when you re acquired your Filipino Citizenship and become dual and your child still a minor at that time he can get a Filipino citizenship by form of citizenship by derivative.

      It depends. Was any of your parents a PH citizen at the time of your birth? What year were you born? (before/ after 1973?) And is it your mom or dad who has Filipino heritage?

      As long as one of your parents was a Filipino citizen at the time of your birth, then you are considered as a natural born Filipino and can apply for dual citizenship. See the website of the PH embassy/ consulate. Check also if your present county of citizenship allows dual citizenship. (example, Germany doesn't allow it)

    You missed something very important. Filipino mother and her children move to the U.S. The mother becomes a U.S. citizen and takes the oath (renouncing her Filipino allegiance). The minor children automatically become U.S. citizens as a derivative of their mother. Because they didnt take an oath renouncing their Philippine citizenship they become instant dual citizens. They do not get a U.S. Citizenship certificate because they are derivative. DFA wont issue a passport claiming they need to reacquire. BI says they cant reacquire because they dont have a U.S. citizenship certificate and didnt take the disqualifying oath. I know many people.that were caught in this trap including my children. It took expensive lawyers to fix this.

      Income earned in PH will be taxed in PH. Your income earned in the US will be taxed in the US. If you're a US citizen, you'll be taxed wherever you are in the world. You won't be double taxed if the country has a taxation treaty with the US.

      Since the child was born to a Filipino citizen mother (PH citizen at the time of child's birth), the child was born as a dual citizen. The mother needs to file a Report of Birth at the PH consulate which serves the state where the child was born. See the website of the PH consulate.

    i'm 59 yo looking to retire in the PI but bothered by definition of Natural-Born Filipino, how does this affect the process to apply for Dual Citizenship, could you do a separate video on this subject, thanks... i feel that the law is prejudicial to those born before 1973, i was born in the PI, had Filipino parents, have Filipino birth certificate which is no longer recognized, still have my expired Philippine passport and grew up in the PI up until i was 13 yo.

      Nothing changes the fact that your are still a “Natural-Born Filipino” regardless of current citizenship. If you maintain foreign citizenship, you will have to deal with visa requirements if you intend to stay longer than a year and be limited to the amount of land you can purchase. Those restrictions go away when you obtain dual citizenship.

      @tito - you were born before 1973 but both your parents were Filipinos, so you're eligible for dual citizenship. However, if you have problems with your birth certificate, you'll have to fix your BC in PH. You'll have to go to the town where you were born & go to the Local Civil Registrar's (LCR) office. You may have to make an Affidavit.
      After you've fixed your BC at the local level, the LCR will send your birth record to the PSA. When you have a PSA BC, then you can apply for dual citizenship. It may take time to get your BC from PSA. It's best to do it in PH & you'll be there for several months.

      US Permanent residence is allowed to stay 1 year outside the country, they change it from 6 months to 1 year.

      As a former Filipino, you can own land but within limit (I think 1 hectare for agricultural land). If you want to own more than 1 hectare, you'll have to be a dual citizen. If your father didn't leave a will, then the property should be divided equally among the children (or their heirs, if the child isn't alive). If your father had a will and he left it all to your sister, then you can't claim the land. If you want some of it, you'll have to go to court (long & expensive process) or ask your sister to donate some of it to you (Deed of Donation).

    A US citizen friend was born in Singapore in 1980 where her parents married and expat residents there. Her mother was a Filipino at the time of her birth while her father was a natural born US citizen. Her birth was reported at the US State Dept but not to the PH embassy in Sg. This friend learned about dual citizenship. She has a copy of her mom's PH passport confirming her mom was still a PH citizen when my friend was born but she doesn't have her mom's birth certificate. Is my friend a PH citizen too? If so, how can she claim her PH citizenship. Her dad is now deceased and her elderly mom is senile. Any help is greatly appreciated

      They can get an affidavit from friends to support the claim . I did that .2 disinterested person to make an affidavit that thry know the mother and child personslly .It is accrpted by the immigration .. dith proper Documentation ..

      If your parents were Filipino citizens at the time of your birth, then you were born dual. You or your parents need to file a Report of Birth at the PH embassy/ consulate which serves the state where you were born. After the Report of Birth, you'll need a PSA birth certificate.

      Being born in PH is not a guarantee/ requirement of having Filipino citizenship - one must have a Filipino citizen parent at the time of birth. If you are a foreigner and intend to retire in PH (no Filipino roots), you can't automatically apply for Filipino citizenship. There's a process (it's a long one) and you must renounce your foreign citizenship.

    It seems inherently unfair for those of us who were born before 1973. How many of us knew about the law of declaring for citizenship back when we were 18 years old? With that small window, it is very unfair that those of us in that age group, who are very much more so tied to the culture, are unable to gain dual citizenship, while youngsters nowadays who are more "american" than Filipino, are able to do so without issue.
    What remedy is available for those of us who were born before 1973?
    I don't believe it was the intent of the law to EXCLUDE those born before 1973.
    It feels like I'm locked out of the Philippines just because of some requirement that was unknown to us back when we were 18.

      Hi. Yes, unfortunately that is the law if you were born before 1973 to a foreign father & Filipino mother. If you wish to live/ retire in PH, I suggest to ask the PH consulate if you are eligible for the 13G visa (permanent residence for former Filipinos). If you're not eligible for that, then you can apply for the SRRV but that involves a monetary deposit in a PH bank. (See pra gov ph for SRRV details.)

      Hi. Unfortunately, you were born before 1973. Under current rules, you can't be a dual citizen/ apply for dual citizenship. If you were born before 1973, your FATHER must be the Filipino citizen for you to gain Filipino citizenship. After 1973, any parent (father or mother) can pass on Filipino citizenship to their children. Vlogger Grandpa has a good vid re: this. You can verify the info from the PH embassy/ consulate.

      @@HelenSanderson-j9p yes, unfortunately that is the law. You were born before Jan 1973, thus the rules which govern your cutizenship is the 1935 constitution. In the 1935 constitution, the child takes the citizenship of the FATHER. You are not considered as a natural-born Filipino because it was your mother who's Filipino and you were born before Jan 1973. To be considered NB Filipino, you must have elected to be Filipino when you turned 18 (age of majority in PH).
      The 1973 constirution changed the rule - kids born after Jan 1973 can be considered natural born Filipino if any parent (mother or father) was a Filipino citizen at the time of the child's birth. The vlogger mentioned it at 3:50.
      You can verify this at the PH consulate (if you're out of PH) or at the Bureau of Immigration (if you're in PH). If you want to retire/ reside in PH, ask them if you're eligible for the 13G visa (permanent residence).

I am more naturally Filipino then a US citizen.. naturally. Apparently the Philippine government does not understand and know what the word "natural" means. It is very frustrating to me. That's like me telling you that you are not Filipino because your mother has no rights as a WOMAN even though she is the person who can CREATE my body with her own flesh and blood and my FATHER can not do that. So ridiculous and stupid this law is. Basically my own people and land of birth has denied me.

      @@HelenSanderson-j9p I understand your frustration. I have encountered other ppl (half Fil/ half foreign) who were born before Jan 1973 and face the same dilemma. They can't apply for dual citizenship because of that law and it was their mother who was Filipino.
      The 1935 constitution - the law re: citizenship/ natural born Filipino was sexist and did not consider the rights of Filipino women/ mothers equally. So the 1973 constitution changed that - any parent (mom or dad) can pass on Filipino citizenship to the child. The 1973 law is not retroactive, so all half Fil kids born before 1973 are not affected/ included in the law.
      Perhaps you could find other half Fil ppl (with Fil mothers) and in the same situation, and you could make a petition to the PH govt - to make an amendment to the 1973 constitution.
      At the moment, a solution for you (band aid solution) would be to ask the consulate if you are eligible for the 13G visa (permanent residence in PH). From what I remember, they also require "natural born Filipino" but maybe they can make exceptions to half Fil/ half foreign kids, born before 1973 who have retired/ are near retirement. Good luck!
