I am no lawyer, and commonsense does not always line up with legal bs, but I think that it might be a legal argument that if the person suing you for an action has ignored the same action being done by other ppl, it kind of negates your case. A precedent has already been set that the person suing did not feel that the actions being contested were detrimental.

You can't DEMAND them, but you can ask for them as part of a settlement agreement, which is what they were doing here. They were saying they will not file a case IF they cover the legal fees and stop the production of the musical. What disgusts me is that this law firm even took the case - they know there is no case here and it appears to me like they simply don't care, because they're going to collect $10,000 in legal fees from one party or the other no matter what.

I think I remember it being used in a Black and White film "The sand dance" or the "Sheik of Arabi", Military unarmed combat and a few Women's Self defence manuals have a similar move, I think it's called "Knee to the Nuts", Hands on shoulders, bring knee up sharply into the groin area then Run.
So “optional events” (breakdancing being one possibility) started with the 2020 Olympics, and the optional events for the 2028 Olympics were solidified in 2023. So no, even if Raygun hadn’t happened, we still wouldn’t have gotten breakdancing in 2028.
That "dance like me" campaign, i think, is THE reason why she's engaged lawyers to stop the comedy show in the first place. They want to monopolise it, and monetise it, and they're worried that the paraody will pull from that...how cynical.

2. Court Rules in NSW If a matter proceeds to court, legal costs are governed by the Uniform Civil Procedure Rules 2005 (NSW) (UCPR). These rules do not allow recovery of pre-litigation costs, such as letters of demand, unless they are incorporated into a claim and awarded by the court. Obviously the rule isn't clear enough seeing as you completely misunderstand it. That rule is simply saying that 1) You have to wait until the trial is actually over to collect any of your legal costs and 2) it's up to the court to decide if you're entitled to those costs or not, and you don't automatically get your court costs covered because you won a judgement against someone. The rule only applies to the court itself. If you want to outside of court offer to drop a case/not file a case in exchange for someone covering your legal costs then you're entitled to do that - in fact the court encourages both parties to try and come to a settlement agreement at multiple times throughout the process and will actively admonish people for not participating in settlement agreements on good faith.
In most cases, unless there is a contractual or statutory basis, legal costs for sending a legal letter without going to court cannot be claimed from the other party. However, the demand for such costs can be included in the letter, leaving it up to the recipient to accept or challenge the claim.

I am no lawyer, and commonsense does not always line up with legal bs, but I think that it might be a legal argument that if the person suing you for an action has ignored the same action being done by other ppl, it kind of negates your case. A precedent has already been set that the person suing did not feel that the actions being contested were detrimental.

You can't demand fees from someone, for a legal claim that never went to court. Only a judge can decide you need to pay someone else's legal fees.
You can't DEMAND them, but you can ask for them as part of a settlement agreement, which is what they were doing here. They were saying they will not file a case IF they cover the legal fees and stop the production of the musical. What disgusts me is that this law firm even took the case - they know there is no case here and it appears to me like they simply don't care, because they're going to collect $10,000 in legal fees from one party or the other no matter what.
You can demand anything from anybody. What is demand but a strident request. It’s raising the stakes in a game of poker, it’s all bluff and swagger. Hopefully the comedy club has the courage and wherewithal to withstand it.

2. Court Rules in NSW
If a matter proceeds to court, legal costs are governed by the Uniform Civil Procedure Rules 2005 (NSW) (UCPR). These rules do not allow recovery of pre-litigation costs, such as letters of demand, unless they are incorporated into a claim and awarded by the court.
UCPR Rule 42.1:
"Subject to rules 42.2 and 42.3, the court has discretion as to the amount of costs and as to the time for payment of costs."
This rule makes it clear that costs are only recoverable by a party after court proceedings and at the discretion of the court.
Obviously the rule isn't clear enough seeing as you completely misunderstand it. That rule is simply saying that 1) You have to wait until the trial is actually over to collect any of your legal costs and 2) it's up to the court to decide if you're entitled to those costs or not, and you don't automatically get your court costs covered because you won a judgement against someone. The rule only applies to the court itself. If you want to outside of court offer to drop a case/not file a case in exchange for someone covering your legal costs then you're entitled to do that - in fact the court encourages both parties to try and come to a settlement agreement at multiple times throughout the process and will actively admonish people for not participating in settlement agreements on good faith.
