If the Government used the Emergencies act, that is a considered a judgement call. That only way the court would force those documents to be turned over, is if there was some evidence pointing to the Government playing an illegal use of the Emergencies Act and they knew it was illegal before invoking it. No one has make that suggestion, so the Court would not allow a fishing expedition.

I am so pleased someone is doing this. We will hopefully get the opportunity to get a sense of the legitimacy of our system. Specifically the people who interpret and apply the law. It seems pretty clear to most people I talk to, once emotion is removed from the situation and only the law remains. There were similar protests where laws were broken and so they were brought to conclusion through regular legal means. The fact that the government felt they needed to invoke an act that allows them to move legal goal posts, is a strong indication that the protest, overall, was not illegal. Using a revamped war measures act against Canadian citizens because they are making you uncomfortable or embarrassing you, is not what the intended purpose of the act is. I would hope an example is made to deter or prevent narcissists from misusing our laws against our people in the future.
The government will simply redact the documents again citing that great harm may befall organizations and people that need to be protected for Canada's sake. A super duper beyond Top Secret Level that we can't even show to a Supreme Court judge; end of story.

@Richard Desrochers Not likely!! Certain Government Documents are privileged. The documents in question are not material to the case. If the Government used the Emergencies act, that is a considered a judgement call. That only way the court would force those documents to be turned over, is if there was some evidence pointing to the Government playing an illegal use of the Emergencies Act and they knew it was illegal before invoking it. No one has make that suggestion, so the Court would not allow a fishing expedition.

I am so pleased someone is doing this. We will hopefully get the opportunity to get a sense of the legitimacy of our system. Specifically the people who interpret and apply the law.
It seems pretty clear to most people I talk to, once emotion is removed from the situation and only the law remains.
There were similar protests where laws were broken and so they were brought to conclusion through regular legal means. The fact that the government felt they needed to invoke an act that allows them to move legal goal posts, is a strong indication that the protest, overall, was not illegal.
Using a revamped war measures act against Canadian citizens because they are making you uncomfortable or embarrassing you, is not what the intended purpose of the act is. I would hope an example is made to deter or prevent narcissists from misusing our laws against our people in the future.
