Ex fashion major here, Not only do you need to trademark, MAKE SURE YOU PATENT your designs. More protection and you can actually win a case that shows your design was used and the other companies didn't get you permission to use the design to exploit it.
I work in intellectual property, and was about to say the same thing. It is expensive to get trademarks and design patents, but that makes it possible to sue if anyone steals your design.

My heart goes out to that designer..As an accessories brand I have has my designs stolen by huge high end designers and even dolls kill..I was contacted by an anonymous employee of dolls kill that told me as long as they change 15% of the designs it's legal.. in the process of trade marking my entire brand so this never happens again..hope he can do the same.
I thought it was 20% you had to change then it's no longer considered the "Original" Design? Then again it may vary from State to State! I know in Maryland it has to be at least 20% or if you are Crochet/Knitting then at least 3 major things in your design must be changed for it to not be the same design. It sucks but unfortunately, in any Industry that you need a Designer, there will always be "Copiers to Popular Designs." It sucks but if you have it Copyrighted/Trademark then you have a better chance in court! Trust me! I learned from experience!

American here. We have at least 3 tote bags filled with tote bags. That doesn't include the tote bags I keep in the trunk of my car in case I forget my tote bags. I also carry a tote bag in my purse for small purchases like the corner store when I'm just grabbing milk or bread. It's getting totes out of hand 😂
I have so many tote bags. I prefer to use the string bags but it seems every place I go, they’re giving away free tote bags and really really really want you to take one even if you try to decline, or a friend will bring a plant or gift over to me in a tote bag and tell me the tote is part of the gift. My trunk has a bunch of tote bags in it and so does the back seat of my car. After my mom died I found a bunch of totes when cleaning out her place. Guess where they are now?

My husband and I solved our tote bag problem for groceries by replacing them with laundry baskets that live in the back of our car. We go grocery shopping, put everything back in the cart, load it into the baskets, and then return the cart. Plus it's SUPER easy to take in groceries in one trip if we go together and two trips if we go individually. We still have a ton of tote bags, but I use them to transport school supplies.
I go grocery shopping in a similar way. I have one of those foldable organizers in the car and a few reusable bags. If it's just a few things I take a bag or two with me otherwise I return with the cart to my car and load the things in there. Works great.

I myself go against using those lessons and tactics for the most part that are taught because everyone has caught on to them by now. As a Graphic Designer, I can tell you right now, that is NOT Uncommon for people in any industry to "Copy" a Design! Take a look at all the Cars here in the US! That is one of the best examples! One Car Company will come out with a "Popular" Design and the next thing you know several other Car Companies (big or small) are doing a "Similar" Design to that! Also, the Fashion/Jewelry Industry is another perfect example of people "Copying" one another! BUT the biggest one to see about "Designers Copying Other Designers" just take a quick trip into the Crocetch/Knitting Industry! There are so many Simple and Similar Designs that is NOT Uncommon for someone to be accusing someone else of stealing their designs without even looking at their patterns. Many of them will look similar b/c of the design but it's the WAY you make the design that makes the difference. Trust me! If you want some "Soap Opera Spill the Tea Drama Llama" just start going on TikTok/TH-cam and you can find so many stories in the Crochet/Knitting Industry!

Apparently the “sold out” tactic is quite common. It makes the buyer think that the product is requested so they become more interested in buying it. It’s also used when a product is not selling, so the vendor makes it impossible to buy and then the people who are curios will try to wait and see when it’s restocked. I recently learned that in my province, you can't take a photo or a video of someone in public if they are the focus of said media and you make profit off of it. So you can take a video or picture of a public place with people in it, or of yourself with people around you but you can't take a picture of someone in a public place. It came about because a photographer had snapped a picture of a woman just chilling in Montréal without her consent and he sold it to a magazine and it made the front page. She was awarded damages. Sad it's not like that everywhere because that OF creator would be screwed not only with sexual harrassment but also monetizing someone else's image without their consent.

In the USA you have “no expectation of privacy in public.” Meaning if you’re outside, you can take a picture of whomever you want regardless of what they do, what age they are, and/or if they say you don’t have their permission. However, when it comes to video and audio for “commercial use”, it might be required to have permission.

More people need to be aware that the Met Gala is a major fundraiser for the Costume Institute- the only branch of the Met that has to fully provide its own funding. It's not just a vanity party for rich people; it's raising money for a museum that's underfunded due to, tbh, the historical exclusive association between clothing history and women, and the attendant institutional misogyny.

I have a little doubt that if she keeps making videos like that, it's not going to end well. Either she will end up in jail or in the morgue. Especially if he does that stunt to the wrong person who takes the case to court or to the really really wrong person who takes justice into their own hands. Though this woman wouldn't be the first or last influencer or similar online persona to get caught doing illegal things or face nasty people as a result of their own actions. Sometimes you really should think before you act. It may seem hard and slow, but it will be cheaper in time than paying a lawyer and/or the victim. As Charlotte says - you nee to trademark a design to protect it. Otherwise you have to accept copies. Anyone who watches Dragon's Den type shows will notice that "patent" and "trademark" are things that business people ask about pretty quickly. I don't in any way condone copying other people's work but people in social media often forget that copying is completely allowed in law of pretty much any concept unless specific legal protection is obtained.
And this is why we stan our petty queen. Coz real talk though, any influencer who's humble enough to unironically say "yeah, block me too if having me on your feed makes you feel bad," that's the kind of genuineness we love. Ex fashion major here, Not only do you need to trademark, MAKE SURE YOU PATENT your designs. More protection and you can actually win a case that shows your design was used and the other companies didn't get you permission to use the design to exploit it.
I work in intellectual property, and was about to say the same thing. It is expensive to get trademarks and design patents, but that makes it possible to sue if anyone steals your design.

My heart goes out to that designer..As an accessories brand I have has my designs stolen by huge high end designers and even dolls kill..I was contacted by an anonymous employee of dolls kill that told me as long as they change 15% of the designs it's legal.. in the process of trade marking my entire brand so this never happens again..hope he can do the same.
I thought it was 20% you had to change then it's no longer considered the "Original" Design? Then again it may vary from State to State! I know in Maryland it has to be at least 20% or if you are Crochet/Knitting then at least 3 major things in your design must be changed for it to not be the same design.

My husband and I solved our tote bag problem for groceries by replacing them with laundry baskets that live in the back of our car. We go grocery shopping, put everything back in the cart, load it into the baskets, and then return the cart. Plus it's SUPER easy to take in groceries in one trip if we go together and two trips if we go individually. We still have a ton of tote bags, but I use them to transport school supplies.
I go grocery shopping in a similar way. I have one of those foldable organizers in the car and a few reusable bags. If it's just a few things I take a bag or two with me otherwise I return with the cart to my car and load the things in there. Works great.

As a Graphic Designer, I can tell you right now, that is NOT Uncommon for people in any industry to "Copy" a Design! Take a look at all the Cars here in the US! That is one of the best examples! One Car Company will come out with a "Popular" Design and the next thing you know several other Car Companies (big or small) are doing a "Similar" Design to that! Also, the Fashion/Jewelry Industry is another perfect example of people "Copying" one another!
BUT the biggest one to see about "Designers Copying Other Designers" just take a quick trip into the Crocetch/Knitting Industry! There are so many Simple and Similar Designs that is NOT Uncommon for someone to be accusing someone else of stealing their designs without even looking at their patterns. Many of them will look similar b/c of the design but it's the WAY you make the design that makes the difference. Trust me! If you want some "Soap Opera Spill the Tea Drama Llama" just start going on TikTok/TH-cam and you can find so many stories in the Crochet/Knitting Industry!

I recently learned that in my province, you can't take a photo or a video of someone in public if they are the focus of said media and you make profit off of it. So you can take a video or picture of a public place with people in it, or of yourself with people around you but you can't take a picture of someone in a public place. It came about because a photographer had snapped a picture of a woman just chilling in Montréal without her consent and he sold it to a magazine and it made the front page. She was awarded damages.
Sad it's not like that everywhere because that OF creator would be screwed not only with sexual harrassment but also monetizing someone else's image without their consent.

More people need to be aware that the Met Gala is a major fundraiser for the Costume Institute- the only branch of the Met that has to fully provide its own funding. It's not just a vanity party for rich people; it's raising money for a museum that's underfunded due to, tbh, the historical exclusive association between clothing history and women, and the attendant institutional misogyny.

Although it is EXTREMELY public that the gala is a fundraiser- the Wikipedia entry talks about it, Vogue mentions it every year, the official name is even the Costume Institute Benefit...much as I wish they said "THIS IS A MUSEUM FUNDRAISER FOR A HISTORICALLY UNDERAPPRECIATED FIELD OF STUDY" every time they showed Zendaya dressed as Joan of Arc, I doubt they're going to do that when they've already said it once (and, again, not sure they want to belabor that point because then people might start asking "why does just this branch have to fund itself?")

The fact she posted herself exposing herself to OF for views is enough to get her several charges from the law, including indecent exposure and S harassment. Not to mention it would fall under exploitation with him being posted in the video with consent. I hope he does lawyer up.
I really hope that's true, but some cities ether softened such laws or just stopped enforcing them.
I have a little doubt that if she keeps making videos like that, it's not going to end well. Either she will end up in jail or in the morgue. Especially if he does that stunt to the wrong person who takes the case to court or to the really really wrong person who takes justice into their own hands.
Though this woman wouldn't be the first or last influencer or similar online persona to get caught doing illegal things or face nasty people as a result of their own actions.
Sometimes you really should think before you act. It may seem hard and slow, but it will be cheaper in time than paying a lawyer and/or the victim. And you'll live to be old when you don't piss off the wrong people.

As Charlotte says - you nee to trademark a design to protect it. Otherwise you have to accept copies. Anyone who watches Dragon's Den type shows will notice that "patent" and "trademark" are things that business people ask about pretty quickly. I don't in any way condone copying other people's work but people in social media often forget that copying is completely allowed in law of pretty much any concept unless specific legal protection is obtained.
And this is why we stan our petty queen.
Coz real talk though, any influencer who's humble enough to unironically say "yeah, block me too if having me on your feed makes you feel bad," that's the kind of genuineness we love.
