The Implied Term of Trust and Confidence in the Employment Contract-Vital in Constructive Dismissal

There is an implied term of mutual trust and confidence in every contract of employment in Ireland. If the employer breaches this implied term due to his unreasonable conduct he may leave himself open to a successful claim for constructive dismissal from the employee.
The obligation of trust and confidence is a mutual one, that is the employee also needs to behave in a reasonable fashion and retain his employer’s trust and confidence.
