    I am trying to see how the Judiciary could have LEGALLY kept this killer in jail. I mean, it is Parliament that make the Law, Judiciary cab only interpret what is written. Shouldn't we blame the Law Makers?

  • @innocenthapazari8699
    @innocenthapazari8699 2 ปีที่แล้ว +4

    The most honest analysis from an SACP member. Yes; blame is squarely on ANC and its partners as the gentleman rightly points out. They are the one who make laws not judiciary. Judiciary must never be expected to dance to public emotions rather to the law. If ANC & its partners create bad laws, like this parole one, then the courts can only interpret and apply those bad laws.

    Maybe if the wonderful ANC didn't scrap the death penalty then justice would have been served, and the country would have also had less crime as a result.

      Criminals cost the taxpayers millions to feed and keep healthy. (Free to the criminals.) This murderer has cost us thousands to keep him alive and in jail. Murderers should be executed and the rest should pay back their free lunch, and stay, by doing hard labour etc. Lots of roads to be fixed.

    The judicial has many ways to cub that problem especially when they foresee or knows that ,certain things, such as civil out cry,war or anything related to disorder would result, they can uphold the permitted action ,but make findings on how to solve the problem. The court according to me are meant for the people, to safe gaurd their interests, and to continue living without fear or favor or prejudice. In this case, one can say, the courts are used to create chaos in their decision process because the laws says so. What if as we talk now, other people loses their belief in the judiciary ,or they have develop a miss trust in the way things are pursued. Justice is the mother of all forms of our issues that we are experiencing in the Republic. Look at the disaster when President Zuma was taken to jail .There are many things for the law to take into account before unleashing a sentence, especially a sentence that evolve political will.

  • @heavyhookedup
    @heavyhookedup 2 ปีที่แล้ว +5

    You cannot apply the law according to the person who died. All lives have the same worth. You cannot say because it was Mr Hani they should have looked at the judgement differently. It is a pitty the ANC created this law for people to get out like that. It's wrong.

    The fact is all the families of people that has been killed feel the same. But they have to accept the law if they agree or not. The law must be for all.

  • @tlhomphocalvinmateka9843
    @tlhomphocalvinmateka9843 2 ปีที่แล้ว +1

    The are many things that the judicial should observe before delivering a judgment. In fact, the judge must apply its mind before unleashing the sentence. First, judge Zondo took advantage of the lack of understanding of Parliament to view and review its work. There are cases in my view, would not be solved because of the lacking of understanding of the Parliament to amend the laws .For instance, if not in many cases, if it happens for a person to lose the case number, usually called docket, there is no case in that situation, why Parliament is not making ways for people who lose their docket numbers, or as it to me,police officers promise that they will give us the docket number after few hours, and yet we didn't get any ,this is Philip east police station under the station commander Witbooi ,cape Town ,near stock road bus terminal.

    If Wanuz wants to be paroled, he must confess the truth as to who directed him to Hani's house, because he didn't know Han's location. Hani had body guards but on that faithful day when Hani was assassinated they were off duty all of them. I just wander even now that what was said to Hani by who in order for Chris to relieve those body guards.

    Parliament is amending the laws, it is so very shameful and sadness to have Parliament that drag its foot when it comes to amending the laws. The act of parole is not above the law, the are other ways to revoke ,rescind and repeal that act. The are other sections within the constitution itself that needs to be reviewed, examples, section 9 -the equality clause. Parliament must within a certain period meet the criteria set for it to resolve this matter immediately.
