  • Is Remote ID Even Legal??
    The Federal Aviation Administration (FAA) has implemented a Remote ID ruling that will require most small UAVs (drones and radio control model aircraft) to broadcast certain performance parameters (take off location, altitude, coordinates, etc.) to allow for safe flight operations in the National Airspace System. This video will discuss if this rule is even legal, to include a court case brought against the FAA.
    The FAA Remote ID rule was first put out in Jan 2021. Manufacturers had until Sept 16, 2022 to comply with production drones, and this has since been moved back to Dec 16, 2022. All users will need Remote ID by Sept 16, 2023. The FAA has directed that a module for Remote ID be available for those systems not manufactured with it. There are three exceptions for the need for Remote ID as well, to include model weight, FAA Recognized Identification Areas (FRIA) and indoor flying.
    Tyler Brennan, a drone operator out of Florida, challenged Remote ID in Federal Court against the FAA, on the grounds of privacy and the Fourth Amendment. The court ruled in July 29, 2022 that this was not a valid argument, thus Remote ID is legal until another court challenge.
    In addition, I discuss the large industry interest in a strong Remote ID system to allow for growth of the commercial UAV industry.
