Well there are clear rules in the contract the contestants sign that talk about treatment of staff. But there are very few rules about how contestants treat each other. E.g. no punching or you are gone. So it was easy to use the staff harassment as an excuse to avoid a lawsuit. I am sure the stuff on camera was really what got him but they say otherwise to be safe. Some players actually use tactics that many feel are disgusting in order to further themselves in the game and it actually works more often then you would think.

Kellee didn’t do anything wrong, and it really upset me to see her get manipulated by Missy and Elizabeth when it really did affect her emotionally. As for the incident with the female staff member, I think the producers have full power to remove someone from the game at any point. When it happened the first time, they did their own investigation, talked to the other castaways, and then asked if anyone wanted Dan removed, and I believe Elaine or Dean said in an interview that nobody wanted him kicked out at that point, so they monitored the situation, but still really couldn’t do anything. When it happened to a member of the staff, that was different. You can’t do anything to the people behind the scenes, so that’s why they kicked his ass out immediately after. While I do agree that he should’ve been ejected after the first time, I also understand why he wasn’t. It’s unfortunate that he lasted as long as he did, but in the end, he was exposed as the creep he is, and I give him no sympathy.
I’m honestly mad that Janet stuck up for the young girls who came to her saying they were uncomfortable with Dan & then when Dan confronted the girls about it they stabbed Janet in the back saying she was lying. JANET TRIED & DESERVED MORE RESPECT!!!

Ghostmeister no, ONE woman admitted to embellishing her story. the woman who was feeling the most uncomfortable, Kellee, shared how his inappropriate touching was bothering her since the start and she never once said she was lying. she also shared her story in the live reunion show, where Dan and Elizabeth were uninvited from.
Adeswa Hoaes yes, but this happened after he had been touching Kellee inappropriately. If you watch the full season, they were watching and monitoring him because of what she had said, and then he did something off camera again which lead to him finally being sent home.
Polgasting I think that because of this disqualification, he technically doesn’t even place 6th, but rather Elaine does, and then Karishma, with Ronnie who placed last only getting 19th as a result

Oh God. I didn't even remember him getting that far. I thought he got like 8th or 9th. I'm very concerned about the fact that he probably would have made final tribal council if this wouldn't have happened.
I honestly feel like they should've done this back at the Final 13 when it first came up, Dan never really seemed like he would ever stop doing it, glad it finally happened and I just personally feel bad for his son, must be really awkward.
They should have just cancelled the entire season and sent everyone home to be honest. This garbage almost killed the whole series and had no business airing. If it wasn't for Winners at War (the best season to date), Survivor would have been cancelled.
Of all people, why would Hollywood Talent Managers need the prize money? I just want to point out the look on Jeff's face as he marches to the camp. I can only imagine what was going through his mind with every step he took. I feel really bad for Tommy because he was actually a very very good player and deserved his win entirely, but everybody will remember this season with a negative connotation because of Dan.
Ben Faulkner kellee didn’t break survivor, she had a breakdown because she was continuing to be touched by that cretin after she made it clear to him from the first incident that she was uncomfortable. She didn’t even want anything to be done by producers or say anything to the tribe as a whole because she didn’t want to be the one to stir things up at camp. Missy/Elizabeth made the situation 10x worse by piggybacking off Kellee’s situation and created a false charge meant to create to divisions in the opposing alliance that their minority alliance of 3 could take advantage of. Dan was removed from the show for apparently touching a female staffer behind the scenes. It’s nowhere near Kellee’s fault for the shit-show this season became.
This should have been done when Kellee reported it, yet she was removed from the game and even worse, Dan acted like she was attacking him. I know this was 3 seasons ago and 2½ years ago, but it still angers me to this day.

Terrible handling by Survivor. They should’ve taken it into their own hands immediately. They see the unwanted touching of the players, and should know that it would be difficult for them to act on it due to the million dollar reward in the balance. It’s creepy, Dan had leverage on the girls because so much money was up for grabs. That’s why it’s so gross that he’s a talent agent, I can see him abusing ladies and using potential acting roles or other lucrative jobs as leverage.
I just watched this season. It took them long enough to remove him. Also shame on the other girls for lying and keeping him around. Poor Janet, she is a wonderful person and shouldn’t have been treated so badly for being a mama bear.

Even if they’d all gotten together and voted him out like they were supposed to, that would not have been enough. Voting someone out of the game is not the appropriate way to deal with real-world misconduct.
If he hadn’t been previously warned, he probably would have gotten the benefit of the doubt and people would have assumed a family emergency (like Terry in Second Chance.)

They should have done this sooner. By this point, Janet was the only one left who didn't absolutely suck. Dan was running the game entirely because he aligned with people who chose to manipulate a situation for their own gain. The first 4 eliminations post Merge were entirely because of Dan. They deserved a chance to play the game without sexual harassment clouding their every move.
This was the biggest Survivor scandal in history. I know people wanna blame Jeff sometimes but I remember hearing about how the other executives and CBS officials called him back to the states during the season to discuss this. For one Kelle had allegations that could have been handled right then and there BUT then other players used this to get HER out. So her game was ruined, the allegations were tarnished because of the girls lying, a man that was then kicked out after, a player was ready to quit because of it, and several players that played based on hearing his actions. The whole season and its dynamics were ruined. (I defend Kelle, but I remember her video before her vote of the producer telling her to come forward. But she didn't. I'm not blaming her, but the events after paved the way for this god awful season).
This is probably my least favourite season of all time, and besides Janet and Kellee, everyone else was either not memorable or not likeable. She had a genuine incident happen to her and was costed a million bucks out of being a victim? That's awful! Least favorite boot and season of all time.

I honestly don’t know why the hell Dan Spilo was even allowed to stay on the show in the first place. He should’ve been immediately ejected to prevent it from getting worse. Sexually harassing Kellee was one thing, but doing it to one of the production members pretty much crossed the line.
I think if Missy and Elizabeth didn't lie about the Dan situation to begin with, the producers would've removed him right away instead of just a warning. Unfortunately, they did and it only was a he said she said problem because of that. It sucks it took another incident to validate Kellie's compliant. I think it's sad and it's a shame because this season had some great moments, but this whole situation tainted it. But I think the finale can still be good. We'll see. Just can't wait for all winners in February.

The fact that most of the crew knew about the situation and not only said nothing, but he was allowed far into the game when all of the survivors no just knew but were using it as an advantage. It’s offensive to the game itself, this should’ve been ended much sooner. It’s horrible that he made it much further then even the women that outed him. Dan's drama completely overshadowed this entire season. I don't even remember anyone from this season except for Dan and Kellee. That's like Will Smith slapping Chris Rock's drama and no one remembers anyone's wins that night except for the drama.

What people don’t realize is when the host of a show pays a visit to the cast when they usually don’t, something bad happened. Cara Maria explained a similar situation when T.J. Lavin appeared to tell Sarah about Trishelle quitting the game resulting in Sarah having to leave as well.
Yep, this happened in Survivor 42 with Jackson since he was taking a drug that could've negatively affected him in the game that he hid from Jeff and the staff.
I think it is part of the reason why they started doing the 50% minority rule for CBS game shows. They tried to “make up” for their lack of action and that’s what they came up with.
When they kept him in the game after just issuing a 'warning' it made me sick to my stomach. It was so obvious he was a predator too with the way he talks and how he attempted to defend himself, all the red flags. I feel bad for his wife and kids.
This is the second such expulsion of a castaway for inappropriate behavior in survivor franchise history. The first one happened in France earlier this decade.

I think because of the odd strategy that Elizabeth/Missy used. Dan was being told by Kellee/production that he was doing too much, while Elizabeth/Missy were telling him that they weren’t bothered and he was fine. He should’ve realized that production has an all seeing eye and knows the truth, so he’s not excused, but I kinda get why they didn’t eject him then
So CBS knew they were gonna kick Dan from the game entirely so prepared for it and gave jack( pre merge boot) a spot in the jury, wtf something stinks and I really didn't like the excessive drama this season but at least The Controversial player is out, they should have investigated it long ago when the first claim was made by kelle, Sad moment indeed

I don't think they knew they were going to at the time. They do expand the jury to premerge sometimes (like in heroes vs villains). But even if they did for that reason, better late than never. At least hes not gonna be on the jury

I saw a documentary on at once and the staff members are way more present than you would believe. They have to shadow the players all the time as well as spending hours prepping them for the challenges. They are always around the contestants but it’s hidden really well. Quite possible Dan was alone with one of them.
Allegedly there WAS a sexual harassment incident involving a contestant, but he got ejected for an off camera incident involving a crew member, though it was never specified what that incident was
i looked into it, and it was something like he had felt up one of the female crew members on the boat on the way back to camp. i dont know all the details though so dont take my word for it

This was a pretty low season for me. I hate the fact that the first time it happened, despite the disgusting actions of Dan on and off cam, they ignored it. And the fact that some of the women there even defended that man, just wrong.

I totally forgot they did this weird season of Survivor with Rob and Sandra lurking in the bushes at Tribal Council for no reason. Worst concept and execution in Survivor history. I think the producers just wanted to get Rob and Sandra out to Fiji and throw some easy money at them so they would stick around for Winners at War.

When my parents and I were watching this episode at the end, we were confused about what was going on and we thought it would be over, and then after we heard that Dan is gone and then saw the info at the end, what he did was so wrong to the player on the game and then off camera. I hope nothing like happens again.

He has been to camp more in the earlier seasons. they even had an immunity challenge done at camp during Survivor China

Ghostmeister no, ONE woman admitted to embellishing her story. the woman who was feeling the most uncomfortable, Kellee, shared how his inappropriate touching was bothering her since the start and she never once said she was lying. she also shared her story in the live reunion show, where Dan and Elizabeth were uninvited from.

Adeswa Hoaes yes, but this happened after he had been touching Kellee inappropriately. If you watch the full season, they were watching and monitoring him because of what she had said, and then he did something off camera again which lead to him finally being sent home.
Good that he was ejected but the fact that he made it to the Final 6 makes me vomit.

Kellee officially broke Survivor
Ben Faulkner kellee didn’t break survivor, she had a breakdown because she was continuing to be touched by that cretin after she made it clear to him from the first incident that she was uncomfortable. She didn’t even want anything to be done by producers or say anything to the tribe as a whole because she didn’t want to be the one to stir things up at camp. Missy/Elizabeth made the situation 10x worse by piggybacking off Kellee’s situation and created a false charge meant to create to divisions in the opposing alliance that their minority alliance of 3 could take advantage of. Dan was removed from the show for apparently touching a female staffer behind the scenes. It’s nowhere near Kellee’s fault for the shit-show this season became.

Terrible handling by Survivor. They should’ve taken it into their own hands immediately. They see the unwanted touching of the players, and should know that it would be difficult for them to act on it due to the million dollar reward in the balance. It’s creepy, Dan had leverage on the girls because so much money was up for grabs. That’s why it’s so gross that he’s a talent agent, I can see him abusing ladies and using potential acting roles or other lucrative jobs as leverage.
I just watched this season. It took them long enough to remove him. Also shame on the other girls for lying and keeping him around. Poor Janet, she is a wonderful person and shouldn’t have been treated so badly for being a mama bear.

Even if they’d all gotten together and voted him out like they were supposed to, that would not have been enough. Voting someone out of the game is not the appropriate way to deal with real-world misconduct.
If he hadn’t been previously warned, he probably would have gotten the benefit of the doubt and people would have assumed a family emergency (like Terry in Second Chance.)

This was the biggest Survivor scandal in history. I know people wanna blame Jeff sometimes but I remember hearing about how the other executives and CBS officials called him back to the states during the season to discuss this. For one Kelle had allegations that could have been handled right then and there BUT then other players used this to get HER out. So her game was ruined, the allegations were tarnished because of the girls lying, a man that was then kicked out after, a player was ready to quit because of it, and several players that played based on hearing his actions. The whole season and its dynamics were ruined.
(I defend Kelle, but I remember her video before her vote of the producer telling her to come forward. But she didn't. I'm not blaming her, but the events after paved the way for this god awful season).
This is probably my least favourite season of all time, and besides Janet and Kellee, everyone else was either not memorable or not likeable. She had a genuine incident happen to her and was costed a million bucks out of being a victim? That's awful! Least favorite boot and season of all time.

I honestly don’t know why the hell Dan Spilo was even allowed to stay on the show in the first place. He should’ve been immediately ejected to prevent it from getting worse. Sexually harassing Kellee was one thing, but doing it to one of the production members pretty much crossed the line.
I think if Missy and Elizabeth didn't lie about the Dan situation to begin with, the producers would've removed him right away instead of just a warning. Unfortunately, they did and it only was a he said she said problem because of that. It sucks it took another incident to validate Kellie's compliant. I think it's sad and it's a shame because this season had some great moments, but this whole situation tainted it. But I think the finale can still be good. We'll see. Just can't wait for all winners in February.

I think it is part of the reason why they started doing the 50% minority rule for CBS game shows. They tried to “make up” for their lack of action and that’s what they came up with.

I'm actually surprised it happened to a staff member. Aren't they suppose to pretend they aren't there unless it was for interviews and other things.
I saw a documentary on at once and the staff members are way more present than you would believe. They have to shadow the players all the time as well as spending hours prepping them for the challenges. They are always around the contestants but it’s hidden really well. Quite possible Dan was alone with one of them.

When my parents and I were watching this episode at the end, we were confused about what was going on and we thought it would be over, and then after we heard that Dan is gone and then saw the info at the end, what he did was so wrong to the player on the game and then off camera. I hope nothing like happens again.
