      I actually played with the Castle Miner Z creator back in the day. Guy was super upset that people compared the game to Minecraft, and said it was older than Minecraft. I don't buy the story or it being older (MC's alpha build came before the indie store) but it does make me question if it was inspired by, rather than a blatant ripoff.

      I still play on it steam with some friends a few times a year, it's painfully basic now and only had two small updates since it came out on PC after Xbox but still the most fun I have with the block games even still more than Minecraft.

    Regarding the modder adding Pokemon to Palworld - he was paywalling the mod behind his Patreon so Nintendo went after him, likely under the guise of Commercial Infringement, as he was making money off their IP (as Nintendo is the publisher of Pokemon games, GameFreak are the devs) without their permission.
    Edit: Friendly reminder that until the Quake series of game popularised the term "First-Person Shooter" every game released after DOOM in December 1993 until Quake was called a "Doom Clone" and nobody tried to sue other game devs over making a "Doom Clone" - hell, id Software (makers of Wolfenstein 3D, DOOM, Quake and the engines for those game franchises) actually *licensed out to other game devs their game engines*.
    "Super Noah Ark" on the SNES used the Wolfenstein 3D engine for the SNES, Chex Quest used the DOOM engine, Hexen & Heretic (both by Raven Software) used the DOOM engine, GoldSrc/Half-Life Engine from Valve was evolved from the Quake engine (and then further evolved in to Source (Portal series & TF2) & Source 2 (DOTA, Counter-Strike 2 & Half-Life: Alyx)), Star Trek Voyager: Elite Force & Star Trek: Elite Force II used the Quake 3 engine, OpenArena is an Open Source Reverse Engineered clone of Quake 3 Arena/Team Arena (which can run anything powered by the Quake 3 engine if you've got the approprate files)...

      To expand on your list of the quake or doom engines being licensed out, probably the most popular series that has came out of it was Call of Duty.
      CoD 1 was built on idtech 3, and then that evolved into IW engine. Even the modern CoD games still are based on idtech 3 (the disclaimer crediting ID software for licensing the engine is still found on the back of the boxes and digital store descriptions)

    The reason the palworld pokemon mod got nintendo/The Pokémon Company on him right away is because he was going to sell it, he only makes his mods available thru his patreon for which you obviously have to pay. So easy target since he can't hide behind it just being a 'fan thing' but is clearly done for profit.
    It's pretty much a warning shot to any other mod makers from nintendo/The Pokémon Company that are thinking about releasing a similar mod.

    I don’t think palworld has anything to worry about. It’s different looking enough. Saying you can never be inspired by something and that can not be done is ludicrous. Nintendo needs to play this very carefully because if they win it will set a dangerous precedent to creativity. Also how can Nintendo go after a community made mod that doesn’t make money? There are thousands of mods for fallout and I have never seen one taken down for ip infringement.

      The reason you see so many Fallout mods is that Bethesda (PC games) has a very different approach to modding than Nintendo (console). A dedicated modding community developed around Bethesda games back in the 90's & 00's and have been responsible for extending the life of many Bethesda games, even helping to reinvigorate games that tanked... the age-old meme is that Bethesda games are always buggy at launch but don't worry, the modders will fix it. So modders usually have to do something pretty blatant for Bethesda to issue a cease & desist.

      There's a difference in stealing the concept and making it your own (Digimon, SMT, Yo Kai Watch, Etc.) and straight up stealing assets - if palworld can just steal chunks of models from other games and be a best selling steam game, it sets a precedent for other studios to steal assets from other games to do the same thing, which is a huge blow to 3d artists, designers, modelers, etc who already have it hard getting jobs in the industry; and that'll have a knock on effect of making gaming as a whole worse in the future

    5:30 Yes... it is STILL plagiarism. You can use something as inspiration, as long as the final design is original enough that people don't get the too confused. Like, the Pal that looks like a crossbreed of Totoro and Electabuzz I wouldn't call plagiarized because while you may from the colourscheme and the black bolt on its stomach immediately draw associations to Electabuzz, the design itself, in my opinion, is distinct enough to be its own. Where the rodent creature at 3:48 has blatantly stolen its tail from Raichu.
    I had an associate who drew fan art of FNaF animatronics and came up with "his own original characters". One day he proudly showed me a drawing of Bonnie (or was it Springtrap?), with the ONLY "original" touch being a missing leg and a big scar on its belly. I was of course nice and praised his work, but my inner voice said: "Dude... that's just Bonnie with a missing leg and a scar on its belly... that's not YOUR character". If we are following your logic, that it is okay to use reference material as inspiration (which it totally is), then he should have used Bonnie as a base for his character (could totally have made it a bunny as well), but then make the final design distinct enough that while I may have been able to tell which character it was based on, I'd still in good faith be able to say: "Wow, that a cool new design!"
    If you show me Dante from Devil May Cry and just remove his jacket or give it new buttons, that's still Dante. Jacketless Dante doesn't make him YOUR new and original design. 2B from Near with a new dress is still 2B from Near. Pikachu with pink fur instead of yellow is still Pikachu and I could go on.
    Also, I am a writer who constantly borrows and gets inspired by other works of entertainment from all across the entertainment industry, and I constantly have to put myself on a leash and ask myself if what I just wrote in my newest book is transformative enough to call it my own, or if it borders on plagiarism and has to be change up more. Granted, no one reads my shit anyway so no way would it ever get caught by the law anyway... but as a creator I wanna be able to be proud of my work, and I can't if I feel that I am stealing, rather than being inspired. So as a creator of ANYTHING, the line between inspiration and plagiarism is a thin, sometimes blurry line, you'll constantly have to have in mind and cross ref with yourself.
    Can you, in good faith, honest to yourself, look at you creation, and say it is yours? Or does it have too many similarities with the thing it's "based" on?

    Bro, CastleMiner Z is a nostalgia trip. I remember playing for hours with my friends back in the day.
    I remember when we wanted to go to Ore Land, which had all the various ores like Coal, Iron, and Diamond, we would dig a tunnel all the way there to avoid the monsters.
    There was a sense of power suiting up from Ore Land with Diamond guns and tools, then heading to Hell to get Bloodstone.
    It sucks that it isn’t on Xbox One because I would definitely playing it again for old times sake.

    “Is it plagiarism?” I think the answer would be yes. If they use the character models from Pokémon as reference without acknowledging that or getting the rights to do so, how could it not be?
    At least in the academic sense of plagiarism, what Palworld is doing is “paraphrasing” Pokémon and without proper acknowledgement/citation would be considered plagiarism. Idk if that applies legally to a business in the same way

    The whole _Dark & Darker/Iron Mace_ situation @ 23:20 is more complex than just copyright... the lead dev for a game called P3 at Nexon left the company, spun up his own studio called Iron Mace, poached the staff who were working for him on P3 at Nexon, and then went on to develop a game almost exactly like P3 (in a suspiciously short time frame) into the game _Dark & Darker._ And the lead dev (who was fired from Nexon after using work-from-home COVID restrictions to store P3 code on an external server) readily admits to all this.
    So the offices were raided in relation to this external server issue & accusations of _direct_ theft of Nexon's IP, in addition to the copyright infringement litigation that stopped the game going onto Steam.
    D&D actually poses a much bigger legal question than just inspiration vs plagiarism... if a dev who is employed by a studio to develop a game concept using studio resources (P3 was ready to go into production when all this happened), can leave & finish making the game themselves to sell & profit from, why would studios invest so heavily in R&D? How would they protect that investment?
    Because regardless whether you like Nexon, the guy at Iron Mace doesn't do himself any favours by essentially confirming that he used P3 to make Dark & Darker and doesn't see a problem with doing so. They barely made any changes to the gameplay or aesthetic to differentiate D&D from P3.
    And the way Iron Mace have tried to paint this as as a "bag bad corpo vs small indie studio" is quite disingenuous, because having a dev walk out the door of a small studio with the equivalent of P3 would be 10x more damaging to a small studio than it would be to a company of Nexon's size.
    Even people who despise Nexon have been forced to admit that Iron Mace don't have clean hands & may set a bad precedent for the gaming industry.

    The whole genshin stealing thing, is not because of breath of the wild, that's just the stupid majority that doesn't actually know any other games than what's popular, Mihoyo has a history of ripping animations from other popular games, like Nier Automata or Bayonetta and others.
    That topic was very poorly researched other than what you remembered and saw from a quick google search.

    I completely support the companies doing these things because they are things everyone wanted, yet the big companies that made the originals choose not to listen to their player base and jack the prices up to insane amounts.

      It's not always about "choosing to ignore player wants" - game development is complex & expensive. Making an original game is a lot harder & more expensive than making one of these games who have the benefit of copying or imitating core gameplay & design from the original game. Sure, sometimes devs will make unpopular decisions but doing things like porting a PC game to console aren't always as simple as gamers like to think it is. Like everything in life, they can't please everyone!

      Nintendo also has a history of waiting to let companies dig their graves with a fan project. They seem to usually let it get released or close to completion, and then they judge whether they want to strike... and they usually strike. They're calculatedly draconian, and they have a lot of experience in being assholes.

      I wouldn't count on that. Sometimes Nintendo waits until something becomes big so when they DO take action, they can claim a much larger amount of damages. IIRC they did this with one of the 3ds flash cart makers a few years back.
      Edit: I still don't think nintendo has a leg to stand on, just that the fact they haven't done it yet doesn't mean they won't later.

      That whole thing is crazy.... the Italian devs have been doing just about everything _except_ prove they didn't steal those assets, which should be so simple to do. It's easy to be dismissive of these huge AAA developers having to take legal action over IP infringement, but it's so frustrating to see a small indie dev like Blue Drake having to waste time, effort & money on legal action over a passion project game they don't even charge players for.

    Let’s be honest, pokemon isn’t the only pocket monster type anime game out there. There are several of them out there, and the only reason it is gaining so much traction is due to the success of the smaller company, making millions while having millions play their game. Digimon, Bakugon, Yu-Gi-Oh, there many out there that either use similar concepts, or, monsters used for battle purposes. If Palworld directly stole concepts from Pokemon, then yeah, I don’t support them. Palworld has clear differences while utilizing other concepts from dozens of games and things developers created. If Nintendo takes something away from this, it’s that their fans are sick of having games below standards considering the huge graphical and mechanical upgrades from games nowadays. Pokemon Scarlet and Violet released and got dunked on cause it looked like shit, had bugs beyond belief, and now costs $100 for full content. Nintendo should see this as a sign their fans want something simple to play, stop going after individuals and small companies and devote time to making the games work.

    Just a note about pokemon brick bronze: The devs are making their own game now! It's still on roblox, but it has its own spin on the battle system, has its own creatures with around 300 at the time of this comment, and the quality is honestly a lot higher than pokemon brick bronze (Like in terms of both the content they put out and the models, animations, environments, ect.) It also has a new story that's sorta connected to the pokemon brick bronze story on a way. The only problem is that because it's so ambitious, updates are REALLY slow to come out. Like we're almost at the 5th anniversary of the game and still only have the 3rd badge, but it's a small team making it, so that's understandable.
    But as good as their new game (Loomian legacy) is, pokemon brick bronze just had so much content packed into it and was really something special. It's honestly better than a lot of the official pokemon games imo, and that's what made it worse when it actually did get deleted. The devs were starting to tease the elite 4 slightly before it shut down, meaning it would've been probably a month or two away from actually being finished. But yeah, I'm sure loomian legacy will absolutely catch up to pokemon brick bronze in terms of content, but it really was something special.

    my guy, several models have exactly the same topology and polygons. Like they are ripped straight out of the pokemon games with minimal if any changes. taking inspiration form something is one thing. Using existing pokemon as reference is another thing... but this is neither of those. It's straight up theft and that's what ppl have been pointing out

    I would say that Palworld is the Pokemon game that people wanted 10+ years ago, but GameFreak is allergic to innovation or maybe they are just tired. All that money must be heavy and must make it hard to move around and do stuff. The biggest "innovation" they've made is switching from 2d to 3d "open-ish" world, but most of that work was probably done by some other team. I wouldn't be surprised if they "borrowed" most of the 3d systems from the Zelda team, generated a world, slapped from Pokemon around, and then plugged in their turn-based fighting system. And then did it twice more for Scarlet and Violet.
    The reason Palworld is so popular (and it's not even a finished game yet) is because it's the Pokemon game people have been dreaming about for the last 28 years. It's what every kid imagined every time they booted up their Red and/or Blue (Red and Green in Japan) Pokemon games in 1996. Especially once the Anime started. Every kid wanted to be able to run around side by side with their Pokemon and actually bond with them as if they were a family pet.
    EDIT: About the Genshin BOTW clone thing. People are dumb. Any time something was cell-shaded and/or had a stamina meter, people called it a BOTW clone as if Nintendo invented stamina or cell shading.

    I completely disagree that you can't make the argument that some Pal designs were stolen from Pokémon, when of course, to boost your own argument, you use some of the less aggregious ones as examples. Take the rodent at 3:48. While the design overall may appear original, it is clearly a mix of Meowth for the body, Ampharos for the cone shaped ears, and most obvious of all the lightning shaped tail that is CLEARLY stolen from Raichu.
    So while I agree that you'd have a hard time in court with something as simple as a sheep just because they look similar, are both round, and have the same color schemes. There are WAY more aggregious examples in the game. So yes... plagiarism it is. If there is smoke, there is fire, only it may not be a strong enough fire that Nintendo can sue.

    Giana Sisters on the C64 was the most obvious Mario rip off ever. But for us poor C64 owners it was awesome. I remember the first time I actually tried Mario on the NES.     If you want the same vibes as Pokemon: Brick Bronze, check out Loomian Legacy, TBradam, the dev of P:BB made it as a direct sequel, using some of the plot points from the finale of P:BB, and continued out the story and gameplay in a very similar way to the Pokemon games, but uses custom modeled Loomians, and is pretty far in development.

    The difference between the Mod and the game is that the only evidence that is substantial in the game is minute and farther between so it would require dissecting the assets further, as industry experts have even spoken that the similarities are bit concerning but not outright proof to them, whereas the mod used ripped assets directly. The AI part, if they did use AI in their process at all but did not disclose it would cause issue with being listed on Steam. I only have issue about your claims of studying the games as the developers stated they never even had real experience or knowledge before starting and learned while working, on top of the claim that their only designer who made all the pals did so in Middle school with a job on top? I honestly have been interested in this and had it ready to wishlist when it first announced, Craftopia put me off from pulling that trigger on release but if nothing is found from Nintendo's side and the hype doesn't just die off right away like these games tend to do, I will be buying this.

    I find funny how most ppl mad at Palworld are just Pokemon fanboys that have been paying tons of money on the last pokemon games that clearly were outdated and with a lot of problems including reusing assets from older games, but are now really mad seeing a new fun take on the monster collecting genre that is CLEARLY a PARODY of Pokemon like a fan game. Don’t get me wrong I will fully be against it if the use of AI and real plagiarism is proven, but that’s really not what ppl are mad about, meanwhile that are other pokefans just enjoying the game exactly because they enjoy pokemon and want this new fun take on them that the real pokemon company won’t do.

    The clip that you used at 5:17 clearly shows 2 models overlapping with each other. It's obvious they just took the Pokemon model and changed it slightly then put it in their game.
