I'm not an attorney, but I would have thrown Alito's question back at him: "Sir, of course the FDA isn't infallible/incapable of making mistakes. Why, by the Court's recent rulings and personal behaviors, are the Justices acting as if they are infallible? Impeachment and removal can be applied to Justices. You may not have been elected to your present position, but were appointed by Congressional and Presidential power.

      Indeed
      The real question shouldn't be about infallibility.
      It's about putting trust in the people or organizations that have studied the subject and have the most/best available information. No one has ever claimed infallibility. It's about reducing the risk and getting the best reasonable results.
      But in reality, we know that he really isn't interested in their fallibility, or getting the best/safest results. This is purely about imposing his own version of ethics on the sinful, unwashed masses.

    The Supreme Court has no constitutional authority to ban any drug that isn't designated illegal by Congress or the FDA. Period. Their job is to interpret the laws as they are written, not to make judgments based on their own ideologies. If a drug can be proven to be a health risk, that would be another matter, but the plaintiffs have produced no evidence of that.

It's wrong and it must be stopped. Since the SC is the highest entity in the Country regarding the subject, I'm not quite sure how that would be done.       Asking whether the FDA is infallible is making perfect the enemy of good. "It doesn't prevent ALL death, therefore it shouldn't exist" is a favorite argument of conservatives, especially the ones that profit from death.

    The modern Supreme Court is fundamentally broken. It was never intended to take on the issues that they grab at these days, and certainly not to determine the extent and breadth of the powers entrusted to Federal agencies that were created by the other two branches of government.
    Our system is predicated upon the concept of checks and balances. What checks and balances are in place for the Supreme Court, which seems to be able to simply override the decisions of the other two branches of government with no way to have their own rulings countermanded. Note that the Supreme Court is staffed by individuals who are NOT directly elected and who serve for life, making them completely unaccountable to the American Public.
    It's time for the court to be reformed.

      I agree. Our checks and balances against the Supreme Court are extremely poor. I don't understand why it got this way, but we need to fix it fast. I say we start with 10-year term limits (10 years to ensue just enough time that a justice can be there for two presidents to offer a check on that president).

      A good start would be to dilute the power of individual judges by increasing the number of judges from 9 to at least 12, as in the UK. The traditional number for a jury is at least 12 so if it works for juries why not for the Supreme Court? A better selection procedure (a non-political expert panel in the UK) would also help but that would take longer to fix whereas the numbers issue could be fixed almost overnight given the political will.

    It seems to me that the REAL question here is do we believe that the Supreme Court is qualified to make such determinations. As I understand the function of SCOTUS, it is to interpret the existing laws and insure their constitutionality. If we were to allow doctors to make policy decisions on aviation standards, or metallurgists to set standards for financial institutions both the aviation industry and our entire financial system would be in shambles in short order. SCOTUS, which is already suffering from a plethora of public skepticism, should stick to it's lane.

    What Alito knows or does not know is not relevant. It's simply not his authority as a supreme court justice to assume and abuse the authority of the FDA. What if Alito actually knew better? Should he then have the right to overrule his fellow justices who know less? Who would test that knowledge? And how do you make sure that the guy defining the test knows better than all of them?
    The FDA has the authority to define what's safe. The rules governing the FDA have the responsibility to ensure that the FDA operates on a sound scientific basis. The executive has to implement these rules and oversee the FDA. The supreme court may validate if the rules comply with the principles of the constitution - and nothing else.

      you don't know your history- the dark ages was caused by the fall (bankruptcy) of the western Roman Empire which left Europe with a great political and economic upheavel and power vacuum. The Church stepped in to to preserve some kind of order and organization that spanned Western Christendom. The Church saved western Europe during those dark political and economic hardships.

    Biden needs to pack the court. Under Lincoln there were 3 Justices. We now have 9 because there were at that time 9 judicial districts, we now have 13. So there is no reason why Biden should not add 4 more.

      There is no requirement that a judge be a lawyer, although some legal training is required. I can envisage a judge who is a scientist. There are plenty of qualified attorneys who could provide expert guidance as law clerks, but such a judge could see things at a higher level. Maybe then we could see some actual justice being done.

      There was a time where all members of U.S. government actually held paying jobs outside of governorship. They were working people just like you and me.
      When people could be trusted to be honorable, this worked.
      As soon as people realized they could run for government office and then benefit themselves and their business or industry, it stopped working and we had to start hiring "politicians" who had no third-party monetary associations of any kind, to avoid conflicts of interest.
      The concept of lobbying and lobbyists by extension were invented to circumvent that hurdle.
      Thus, we have our current-day system of government, where you have as much Freedom™as you can pay for.
      Which is why the billionaire-class exists and why they work so hard to keep the rest of us dirt-poor.

    This really is so simple, even a Progressive should be able to comprehend it.
    According to the Constitution, Congress makes laws. Not the President. Not judges at any level. Not bureaucrats. CONGRESS. In the case of this particular abortion drug, the legal question is whether the FDA can mandate that it be made available in all fifty states. Congress has not given the FDA this authority (and, under the so-called "Chevron deference" policy, it is questionable whether they could do so even if they so wished). If the FDA lacks this authority, then under the Tenth Amendment, it falls to the states to make their own laws regulating (or not) the drug.

Even if we were to indulge your question, this case can't be rigged to that end because their evidence doesn't support it.       This case concerns the so-called "Chevron deference" and whether or not Congress can delegate regulation authority to bureaucrats. I see nothing in the Constitution which permits this. Of course, Congress can and should call upon experts in the various fields related to the subject of legislation, but it is up to Congress to pass regulatory legislation.

    There needs to be a SCJ for every federal appeals court.
    13 appeals courts, 13 SCJ. Simple math.
    These folks are autocratic and fascist; it's past time for "guardrails" to be put in place that protect every citizen!

      And anyone who does maintenance in vehicles should be stopped from doing it, because they might fail and it might cause an accident.
      Also, we should not allow any driver/pilot who can't prove they are infaillible to drive/pilot a vehicle.
      The same goes for engineers, doctors, soldiers, cops, etc.
