    Thank you so much for getting further into this topic. What was done to Michael Oher is awful. Presented as something like an adoption (at least in the movie) is especially evil. Before Britney Spears, I really did not understand conservatorships though had heard the term before.
    Can’t wait for the next episode! Loved the pop culture trivia trail at the end.

      Something like an adoption? Did we see the same movie? Here, I'll refresh your memory, they talk about NOT adopting him and specifically say *"legal guardians"* more than once.

      @@aldoabruzzi6417 so instead of grasping the message of how awful what was done to Michael Oher is… you focus on a technicality in my comment that you interpreted a certain way. I said “like an adoption” being legal guardians is a lot closer to that than it is to conservatorship. Bravo though, you sure got me.

      @@EaglesGrl Nothing awful was done to Michael Oher. Quite the opposite. What he's doing to the Tuohys now is despicable. And becoming someone's conservator *does* make you their legal guardian.

      @aldoabruzzi6417 guardianship and conservatorship are two different things in TN law. I've personally handled guardianship petitions to give families something "like an adoption. These are typically cases where minor children are in need of a legal guardian, but custody rights are either improper or difficult to establish (e.g. a single mother's own mother is helping raise her kids, and she wants her mom to be able to enroll the kids in school, take them to the doctor, etc. but does not want to give up custody). As I stated in the video, conservatorship is *only* intended and considered proper for cases where an adult is significantly mentally and/or physically disabled to the point of being unable to make legal decisions. Conservatorship is never proper under TN law for this. At most, they could have explored a power of attorney, or some other contract as a vehicle for giving the Touhys the ability to assist Michael with certain things. But to remove his autonomy completely is unlawful and far outside the scope of conservatorship law.

      @@bookersquared Yes, they are two different things. But conservatorship also grants conservators legal guardianship over an adult. Michael Oher was 18 and not a child, so they could not simply file for legal guardianship over him. Since adoption was off the table, their lawyers suggested the conservatorship. Proper?
      - He was finally getting health and dental insurance at 18
      - He was getting car insurance for the truck they bought him
      - He was getting a chance to go to Ole Miss (if that's the college he ended up picking in 6 months)
      - He wasn't giving them control over ANY of his assets (They were filing a conservatorship of "Person"... not a conservatorship of "Estate". Besides... he had no money.)
      - IF he got his GPA up and was in college on an NCAA scholarship, the NCAA wouldn't *ALLOW* him to be paid for his name, image, or likeness for the 4 years he was in school.
      - The earliest he might POSSIBLY sign contracts or have any money was still 5 years away after college. He wouldn't be an 18 year-old kid by then... he would be 23.
      - If the Tuohys abused the agreement in ANY WAY... he was already an adult *with no disability* who could petition the court to end it at any time.
      He was going from a "ward of the State" to the "ward of multimillionaires". With Michael Oher's horrendous past, his *obvious* improvement with the Tuohys, AND his birth mother's consent... why would the judge suspect for a second that this agreement might not be in his best interest? Your Judge Benham must have considered this a no-brainer. No wonder he waived the GAL
      It takes *far less* to revoke Power of Attorney than it does to dissolve a conservatorship. Remember that the objective here was to prove to the NCAA that they were a family and not just Ole Miss boosters giving Michael Oher this wonderful life as *payment* to play ball for their alma mater. Something as temporary as POA would never have convinced the NCAA investigators that this wasn't just a business deal. I mean, people grant others POA if they are going to be unconscious for surgery for a few hours. It really doesn't show you have much "skin in the game". In fact, thinking about it... it makes perfect sense now that the Tuohys overrode the part about the conservatorship automatically expiring at 25. It proved to the NCAA that they were willing to be his legal guardians for the long haul.

    Why is Michael Oher claiming that they owe him money for using his NIL in their books and speaking engagements? They are talking about the years they spent with him... when he was in the room with them, they were at his game, etc. Why would they need to license his rights to talk about their *own first-hand experiences?* He was there... and THEY were there. They should be able to write books, give interviews, and give speeches about their OWN LIVES and everyone they interacted with until the end of time... and they don't owe him a dime.
    Are they selling pictures of ONLY Michael? Are they writing books about his life when they weren't in it? Selling Michael Oher NFL shirts or bobble-heads? NO. They are making money off of THEIR OWN movie fame. What makes him think he has ANY right to that money?

      @@thebespoketaylor "Enjoyed"? 😄😆😅 Yeah, I get "passionate" when people participate in the spreading of false narratives. And the fact that you did this video AFTER the Tuohys provided the receipts *proving* that Oher's accusation about them making millions while he made nothing.... was nothing more than a false accusation and a straight-up LIE? Well, that puts you two at the front of the pack.
      The part that I found particularly funny was when you were talking about how Oher was so much more *famous* than the Tuohys and ridiculed the idea that they took an even share of the movie money. As the "sports guy" I just assumed that you would know that the NFL has several players with "ghetto to gridiron" backstories... and Hollywood has NEVER done a movie about any of them. Not to mention that when the movie rights were negotiated back in 2007, Oher was just some sophomore at Ole Miss in an *offensive lineman* position. Do you really think that HE was the reason that script sold? Face it. The only reason that movie was made is because it was about *the relationship* that developed between the Tuohys and Oher during the time he lived with them. Hell, there wasn't even that much football action shown in the movie. A bit of practice and that one game.... and even those scenes were half Leigh Anne interacting with the coaches and other fans. Her role may have actually had more screen time than his role did. That movie was every bit as much about them as it was about him.
      I was also a bit disappointed that you (as the "sports guy") brought up the NCAA and their NIL rules at the beginning of the video... but then never followed through. I was hoping that you would talk about the fact that Michael Oher was still on NCAA scholarship when the studio contract was being negotiated, so he was technically not ALLOWED to make any money from the book or movie unless he wanted to kiss his eligibility and college football career goodbye. Nobody ever talks about that, and it explains SO much about this case. Like why he signed that contract giving his NIL rights away to Fox, and why Sean Tuohy had them write one big check to him. Then Sean Tuohy pays the taxes on the whole thing and slides Michael his share. Michael showing no movie income on his tax forms meant hiding it from the NCAA. It all makes perfect logical sense. Of course, it also makes Michael Oher look like an ungrateful POS... backstabbing the family that gave him so much... and that just doesn't fit the narrative does it?

      @@cullendomino8494 I wish. 🙄 No, I have no legal background.... I'm just trying to use logic instead of emotional bias. I'm assuming this is like Neil Armstrong and Buzz Aldrin. They both wrote books. They both had speaking engagements. As far as I know, they never had to pay each other for NIL rights..... because they landed on the moon *together.* They could both make money talking about their first-hand experiences, mention the other person in their stories and have pictures of them in their books.... and not owe each other a thing.
      It's not like he's the celebrity and they are total nobodies. The Tuohys' real names were used in the book and movie. They've been in all kinds of interviews since then. People aren't coming to hear them speak and buying their books because of what Michael Oher did. He could have blown out his knee senior year at Ole Miss and never played a single down of pro football. People would still have enjoyed the movie and still be huge fans because they've become celebrities in their own right and have their own fame.

    I didn’t think that I’d be interested in this podcast. I was wrong. I also thought that I knew everything about this case - I didn’t. Elizabeth made a very good point about why the Ohers didn’t adopt Michael - they’d be obligated to share their wealth with him. Why didn’t I think of that obvious reason before now? Of course!😒 I think that the Oher’s preyed on Michael’s innocence and naïveté. He seems to be a trusting person and didn’t have anyone in his life to warn him about the wolves in sheep’s clothing in his life. I’m so happy that he’s aware now and that the judges see their scam for what it is. Hopefully, Michael will be able to recover what is owed to him from those terrible con artists. Oh, and I wasn’t at all surprised when Taylor said that the Oher’s bio son has a bad reputation. Like father, like son.😞
    Good luck with your new family, Michael. I hope you have a prenup! IJS

      Recover what is owed to him? Back on November 8th, the Tuohys presented the court with all that evidence.... a paper trail showing that he was paid his equal share of what the family received from the movie. He needs to get it through his thick head..... there *WAS NO millions* hidden from him.

      Parents leave their children out of their wills all the time and they have no obligation to share their wealth with him..Had he played it smart and didn't try and extort money from them via text threats, he might have ended up with a slice of the pie.
