    I’m a land surveyor and have seen these issues all to often. Things can be difficult as boundaries and easements can be changed so people need to make sure the survey they have is current. Also most title boundaries are based on common law so if there is a disagreement the ultimate decision maker is a judge not the surveyor.

    Two pieces of advice that were given to me when I first started my company were when you're working near a property line always make sure you have a copy of the plat. If the customer doesn't have one or there isn't one on record with City Hall then you have a survey done. The second piece of advice was always get written permission from any adjoining neighbor that agrees to allow you to do work to overlap the property line. Never ever take word of mouth permission.

      @@kimjones2056 Because you still have to pay for defending yourself in court even if you're right, so best course if you're working right up on the line is to not brush off the neighbor just because they're not your client.

      @@kimjones2056 If you feel like you can work with razor precision on the actual property line, you're probably kidding yourself, and if the neighbor gives an unreasonable response, I would recommend either walking, getting more in writing, and/or revising your price accordingly. I defend contractors in builders risk claims, and after the contractor gets dragged through the legal process (often on the order of years) I always see so much regret that they weren't a little more proactive on the front end.

    We had a guy come across the back of our farm which we rarely access. He took it upon himself to tell the contractor he owned the property. He took out 200+ trees and put in a 20' wide road to get a double wide home in. It all ended well but man it was hell of a surprise when we went back there to cut firewood.

      @@thomas25082 we called the state forester he assessed a value on the trees. He paid for the trees and a legal right of way. We could have taken 3x the price for each tree by state law. But instead we had him cut them all up for firewood and bring it to the house. He's been a good neighbor ever since.

      It triggers people but rightfully so. If you don't protect your property boundaries, you can eventually lose your land or end up in court over it. Best thing to do is to protect it right up front when something comes up.

    You may address this so I'm probably speaking out of turn, but @ 11:30 when you find the rotten support, I'd have immediately built a "Stongback" or 2 to support the deck and keep the guys & structure safe. I don't know if it was necessary, but always a good idea & a 5 minute build to fix.

    When I was a contractor, I found myself it the same boat on a few jobs like this. Many folks do not pay any attention to the plat or servay . That is the first thing that a buyer should get set in stone b4 they buy.

      Most realtors neglect to bring up survey work as part of purchase agreements. Might be because of an extra expense that scares to many buyers away.

    Hey Stan, in watching your video, especially when Tim & Blaine were talking next to the house, I noticed a shrub next to the old wall. I think it would be very helpful if you could make a video that gives homeowners 'best practices' (and maybe 'worst practices; on landscaping (trees, bushes, shrubs, groundcover) and retaining walls and other things you do. You've built up decades of knowledge that if you put it in video(s) could really help people extend the life of the work that guys like you do!

    Had a neighbor walk up to us and complain about our paving job. He immediately walked up and started cussing my whole crew out. Calling us Gypsies, Gypos, Spics & Wetbacks. All I could do was tell him we haven’t even started. We’re just talking about our plans and job walk through. It got so bad he kept coming onto our site repeatedly throwing racist remarks and even tapping my guys with a can paint and questioning them. We eventually had to call the police. Honestly having a camera on-site is not a bad idea….

    Good instruction within the crew there - Carry Your Load Low!!! I can't tell you how many times I've seen some 19 year old at Menards with a pallet full of heavy stuff and he's driving across the whole yard with the load 15 feet in the air! Get it down, controlled, and THEN move.

    I would be a nervous wreck if I owned a property where where my house is on the city easement. I would have to have that taken care of before I spent anymore money on that property. The city I live in is very strict about being x amount of feet away from property line with any building structure. You could not have a structure on city easement you have to be 6-10 ft away. Hopefully everything works out.

    Stan, I've learned so much from you! Would love to show you the 280 Block curved retaining wall and stairs I did by myself here at my home! With out watching many many hours of your videos I would have cut some corners, but I didn't and the wall came out amazing! Thank you! Love your channel.

    I bought a metal detector on Amazon for $35 to find arrows when I missed the target where they went through. $35 and two 9V batteries. Seems like a relatively inexpensive way to find property pins. 🤷🤣

    Ambiguous property lines are common in Colorado especially in rural areas. Many lots were divided over a century ago. When surveyed with modern methods the property lines can be far from where the fences and building offsets have been placed over the decades. Can get a little confusing about what to do about it.

      @@Dirtmonkey they are dependent on the old bad surveys. Without resurveying everything it won't help much. If a boundary is established (what ever that means ) it is the new boundary.

      I remember a story my surveying instructor told of a survey that had to be recreated in Texas. The metes and bounds description said so many cigarettes in one direction, so many cigarettes in another direction, etc until finished. It turns out the guy was riding a horse, rolling and smoking the cigarettes as the horse walked. If at all possible, it is best to use the same method to reestablish a survey as was used in the original one. There are a bunch of unknowns in this one, how fast did he roll the cigarettes, how fast did they burn, how fast did the horse walk, how long between cigarettes, how big was the horse?
      Another survey done was in the far west and very open country, the surveyor carefully measured the circumference of a wagon wheel and tied a rag onto one of the spokes. He lined up the wagon with the wheel by a corner and pointed out a specific monument for the wagon driver to aim for, he counted the revolutions of the wheel as the wagon traveled to the next corner. He then did this over again on a different compass heading.

    I thinking, there might have been a few Land Plots, that got put together. and the last land plot that got put together to make the land bigger. would be the one that goes thur the deck and kitchen area. Could have been done well over 50 years ago when it was done. But was Recorded somewhere inaccurately maybe.

    I'm an LEO. I always hated dealing with neighbors and property disputes. Like i have a magic ability to tell where the lines are. Especially when they both have papers claiming they own whatever is in dispute. One puts up a fence. Other cuts it down and they want them charged with a crime. Well i cannot tell who owns it so you will have to go to civil court. Then they want to call and complain your not doing your job. I cannot bring a criminal charge felony or misdemeanor if i cannot prove who owns it.

    11:21 this is why after the chicago party deck collapse in the mid1990s-early 2000's that foundation and exterior ancillary structures codes were changed so that wooden deck post must rest upon a water proof foundation 6" above the ground line, this also was changed in housing that all siding must be 6-8" up off the ground so that water can not wick up into the wood structure framing and all water from the peak of the roof down must weep out and away from the house even to the point roofers must install kick out tins around all abutting walls and those tins must be at no less then 35-45º angle kick out and water tight sealed meaning welded, lead soldered or solid forged no water can penetrate.
    see how concrete was poured around the wood beam, no water penetrated the concrete but the wooden beam still sucked up water and rotted from the bottom up. this is exactly how most decks rot out from direct ground level contact. there is a reason house foundations even in the 1700-1800's were brought up above the ground level. now over the course of 20 years erosion and yearly-monthly dead plant materials can build up and biodegrade back into soil layer upon layer month to year after year where the ground rises 2" in that first 20 years. i've seen old farm houses built before statehood all over america that in old photographs you can see the landscaping was much different and how it got to where it is today. the most interesting ones i have seen are in the mountains of the adirondaks and appalachian mountains such as pennsyslvania and new york and vermont where the mountain slides and shift from the precipitation events is absolutely incredible year over year and decade over decade where whole cliff faces disappear and reappear since the 1600's

    Something sorta like that for me, too - neighbours being a pain.
    Got a big yucka stalk, 40+ feet, over hanging a neighbour's property. Being the nice person I am I called in a specialist (it's a tricky spot) and we talked to one of the neighbours letting him know it would take about an hour, with any mess (used the company before and they're good at what they do) being cleaned up. Got a verbal agreement and we went ahead making arrangements with the arbourist...
    Got a day and time and went back to let them know only to get "the family has decided we don't want anyone tramping around the property" - it's an overgrown mess - and some comments that suggested a dodgy and/or disfunctional family. The eldest is basically an idiot, full of conspiracy theories, and we've had cordial disagreements before - don't know if that's a factor. So whole thing cancelled.
    Here, I'd normally be responsible for any damage the thing causes (I checked, the house insurance covers it financially, if required) when it inevitably drops but as I was prepared to have it professionally taken care off, and they are the ones who didn't want it done, I've an appointment for legal advice if they have absolved me of any resulting damage - I figure so, but...

    I had an idiot try to pull that on me some years ago.
    1st- I asked him if he was the customer I was there to work for & he said no.
    2nd I told him I was there at the direction of Mr customer.
    3rd I told him if he has any complaints or desires he needs to go talk to our customer.
    The guy went ballistic that I would not let him push me around but he did go
    & talk to my customer & then he went home & we heard no more from him.
    When we finished & knocked on our customers door to let him know we were done,
    he did not mention the idiot next door.
    !

    Hey Stanley, you may know this but if you are looking for property lines of a Clients home, go to GIS and type in their address and you will see their property lines.

    when you have a possibility of a dispute with a neighbor, have a surveyor mark the property line, it is only a few hundred dollars and can save a lot of headaches.

      I remember a job that got shut down where the neighbor was busting the crew’s chops.
      When she figured it was my turn, I chewed her a new asshole, and I wouldn’t let up.
      Her husband never even approached me.
      She shut her big yap when I started quoting not just law, but Common Law as well.
      We never got to do the job because the owner of the company died, but someone we knew managed to do it, all to spec.
      It wasn’t the first time I called out crappy neighbors for a homeowner.
      What’s more, every time it happened, I would give that neighbor the stink eye all through the job, as if I was just waiting for another “attack!”

    My new young neighbor was deciding where he was gonna put a fence but I said no fence til lines are established. I knew where two front ones were but couldn't find the back. I got it surveyed to locate the back ones. He put up his fence and all is well. He didn't like waiting but I knew if fence went up on my side it would never get moved.

      @@m.687 since i knew where 2 markers were, i got 'a deal' of 450 to survey mine. since i was not going to pay on the fence i paid the extra 200 for his survey too. i had shared some cost of removing big trees grown into the old fence, on his side. also shared a few other jobs that were,a benefit to me getting a good neighbor. 3750 total was my limit. he got a little upset when i said i'd done more than enough and was done paying for his stuff. got chilly after that. i don't care at all because i still got a good neighbor who beautifully renovated the dumpy house! they are 35s, i am 70 so we speak when out, but nothing extra since i cut the purse strings!!!

    Metal detector to find the corner pins of the property line. That's how the county does it when they come out and check when there repaving the roads or doing a easement check.

    Retired 2 yrs ago, as we were getting called back to work,, covid. Won’t bore you those details. But noticed a month later and followed one of our trucks to a job site near me and they had put a fine operator in a work truck. One who never got excited over anything. (Good foreman material). Wow you look good in that truck. BUT you know it is gonna rain tonight, are you ready. His eyes light ed up, umm. You know first forman job. the rain on your roof will wake you up and you will be thinking about what you may have missed. He laughed and said your right. Light teasing with a experienced warning.

    Hey, i know where the property lines are on my properties.. If a new neighbor wanted to build that close to my line i would let the contractor know where i believe the line to be also.. Many stories of contractors building over the lines out there... Just be respectful with all involved and save alot of headaches.. Everything i own has sloppy pins.. Even my own ass..🤣🤣 I wouldn't know what to do in a new piece of equipment..🤣🤣

    Hi Stan regarding the major play on the bushings and pins. It's usually from neglect of not greasing the fittings as often as they should or banging a lot to create play. It is a costly repair but, can be replaced before it gets to the point like the mini excavator in the video. Keep grinding them videos are always interesting

    Even though the neighbor wasn’t as bad as some. That is why I refused to buy near anyone. A sub division or and complex trailer park is out of the question. I don’t know why anyone would ever want to live in those areas. But I like doing things outside.

    “Yay, Timmy!” I love working outdoors with guys like this. I did commercial plumbing and boy did I deal with “ass’s” in more ways than one.
    You give great advice man. It took a couple videos to warm up to you.
    I also was certified on 11 different fork trucks and several different track hoes. You can’t teach safety to some guys. It’s part of their DNA or it isn’t.

    Engineers and surveyors don’t make mistakes. They make for allowable errors.. Their plans are flat and the world is round. They get allowances.
    You are welcome to use that line .. Surveyors love it.

    always get a [legal binding certified survey] done when purchasing land or real-estate. It will notify all parties impacted and take care of all problems prior to purchase

    Surveying is an art, not a science. They don't even think like engineers. Everytime I asked my boss a question, he would say "well, it depends". Markers can get moved or destroyed, equipment is much better now. It is not simple, that is why usually the courts won't change an existing boundary. A metal detector can help, but you still have to know what you are looking for.

    i don't talk to home owners or neighbors about property lines, the moment this gets brought up i already estimated this cost into the job as i have the surveyors come out and mark the property borders and the city/state officials certify the markers, then anything any one says MUST go by what the government recognizes. i also secretly put blue and silver patterned painted rebar pins in as soon as the surveyor tells me they completed their work.
    1:12 coolant smells means you have a cracked head or engine block or a seal went bad and your heads need resurfacing
    2:18 any one who checks a running engine for issues by sticking their body parts directly into an operating machine is 100% liability material and the epitome of jeff foxworthy's "here's your sign" joke. i bet he sticks his hands into the mower deck while it was running which is why 1996 congress had to issue commands to the entire american commerce companies " y'all need to put operator seat safety kills switches in as well as parking brake kill switches in and safety sensors for obstructions " people like that ruined everything for every one else who were not darwin award winners.

    Every time I buy a piece of property, I set the property pins in about 100lbs of concrete, No one pulls the pins out and moves them.

    I was clearing out my garden for the first time and I noticed a bunch of concrete and steel fence stumps about two foot inside the current fence line. Seems like the previous owner claimed some extra land 😹

      My old boss got home from work one day and his neighbor was digging a pond on boss's back yard property and had guys fencing it in. He knew it was wrong but thought if he got the fence up that boss couldn't do anything about it...boss was good friends with the sheriff. It got put back real fast!

    Get a metal detector to help find those stakes, which know you guys know that’s how they find and mark out when call. Metal detectors etc…..
    Also kinda surprised the property lines weren’t marked before project started as notice of commencement would have property lines marked out from property survey report etc…. Unless you guys don’t need those docs up there in your state…. Stan, can ya talk about this, and what’s required for you guys to file for permits (do you need permits) and what about flagging/painting everything and such. Curious compared to other states etc…..

    My cousin had a neighbor that kept complaint about his dog barking. Dog would bark for maybe a minute when they left him out in their yard at most three ti.we a day. Cousins wife made her husband give away his beloved dog to not have any problems. A few months later neighbor had a 3' high wall built and a fence on it for over 100'. Neighbor asked MT cousin how he liked the job. Cousin said that it will look better when he moves it over almost a foot . Neighbor hired a surveyor and found out that entire wall was a few inches inside of my cousins property. Cousin made him tear it down. Guy threatened him then hired a lawyer. My cousin would play a tape of a dog barking at least once a week to piss off the neighbor even more.

    I have pulled GIS maps on all of my properties. I had 1 customer tell me that my map was wrong, and the county was wrong, and he would not look at the map. I don't know that property anymore.

      @@Dirtmonkey My neighbor to the west the same way, she thinks she owns roughly 10 feet of my newly installed septic field and the alley on the south side of the house, she doesn't own the alley the village does and the county confirmed where the property lines are, she wouldn't shut up and kept threatening to have the septic field tore up that she thinks she owns, had my lawyer send her a letter confirming the property lines and stating that if she carried out those threats I would sue her for all I could get, now she's quieter and I'm patiently waiting for her to either buy the farm or move to a rest home so I can buy her house and merge her spare lot into mine to make it a 1/2 acre lot for future projects

    Happens to me constantly. Usually end up with a stinking metal detector for an hour looking for buried stakes.

    GIS maps are not considered survey grade item (do not call them survey maps). A GIS map, used from the county for example, should never be used. They are only there for planning. Only a licensed land surveyor can mark your proiperty.

      This is very true. On my own property, when I bought it was told by the seller where he thought the line was. My elderly neighbor had her property surveyed some year later. To my surprise the line was closer to my house by 6 feet than I was operating under. Fortunately I'm on good terms with my neighbors and no problems have arose. But, it goes to show that without a good, recent survey folks can get under the wrong impression about where lines actually are.

      Not if you have a neighbor that purposely paid to have someone move the survey stakes and paid the surveyor OT drive rebar though your sprinkler lines and when I paid to have my property resurveyed and property put the stakes where they belong and put in wooden stakes so I can have my village force him to remove his fence that he has installed on my and into my fence. The neighbor has been caught on camera pulling out the wooden stakes and when confronted about it he goes out of his way to try to trespass me from my own property

      @@evanrude2544 sounds like my idiot neighbor who tried to get me trespassed. Now the survey reveals a 33 ft discrepancy in his favor. He wants 5k and sorry to say I am going to pay it. The whole dam road is off! South side wins north side loses.

      @@evanrude2544 when my neighbor had her property survey done I talked to the surveyors, and watched them locate the original steel ground spices, remeasure the property and replace those spikes. They didn't move them an inch, just put new ones in as the old ones had gotten bent sometime in the past.

    Ok stan maybe it's easier going there, but here in the Seattle area you just don't touch any earthwork beyond utility repairs with out known property corners. If it means calling a survey crew it is what it is. Had so many holdups and a few lawsuits before I went to that extent. Haven had an issue since, well once I did but made a killing in the countersuit so oh well

    Two surveys that have that big of a difference is scary. Obviously one is way wrong. You can’t even rely on one the bank “approved”. Banks and title companies make mistakes. I know I owned my own real estate company for 22 years. I have seen corners surveyed by different surveyors with several stakes surrounding the original pin in as much as a 10’ diameter. If you cannot find the original pins, you are throwing the dice. Physical pins usually take precedence over plat maps, but not always. Modern surveys with lasers and gps are more accurate than old school transits and tapes/chains. When in doubt after a modern survey, an agreement between city and/or county gov’ts. and current neighbor as to an “as built” condition recorded, helps to ease stress.

    Pretty sure that what Stan said about one survey saying/showing he doesnt own part of his kitchen is incorrect. Just because there is an easement on/across your land doesnt mean you dont own it.

    I got talking to a servay guy and there was an entire street where the houses were built in the 70 or 80 and the developer of it his servay guy f up and put part ot the kitchen on the neighbor's lot and this was not discovered till someone passed away and sold the house and they guy went to addon to his kitchen
