    I'm a Professional Surveyor in multiple States, NOT MN!, but Minnesota was initially divided up using the rectangular system (sections, Townships, etc.). Those lines are as they were originally set, whether slightly off or not. The lines don't move. If original section corners were found by the surveyor(s) then it would have been a straight forward job to establish the line. BUT, fences don't always get built on the lines and if they have represented the line to both parties for 7-20 years (depending on individual State law and title) then you could have a claim to the land up to the "old" fence and vice versa for your neighbor. Surveyors usually note the presence of a "possession line" when it differs from the "title" line and the its up to court to make a decision on ownership. At least that's how we do it.

    According to my husband, a licensed civil engineer and surveyor in NC and KY, an existing fence or roadway that has been recognized as a property line and not contested by either land owner for a period of 10 years is legally defined as that property boundary. In your case of closer to 100 years, I would question the objectivity of the surveyor. Was he paid by the Fisheries and Wildlife agency?

      I know in Wisconsin it doesn't work that way.
      We lost a small amount of land about 50 years after the fence went up and they surveyed it.

      It works the same way here in Kansas after a period of 15 years. I know this because my parents went through this when the neighbors bought a additional 10 acres behind them.

    Dougo, if you are down in land acreage for this parcel make sure your tax and land assessment reflect the proper size of that farm. You’d hate to be paying more in tax than you need to.

    I am not a surveyor but I am a land owner and here in Washington state every corner should be marked with a steel rod or a brass/bronze hat. The government has tried many a time to adjust my lines by a chain length. Also a fence line in place for over 7 years without disagreement is a line. Get it back Larson farms!

      I was just gonna say that a fence there’s been in place for seven years is the line. End of story will hold up in court. Also the survey could have chosen the incorrect pin as a starting point. Best thing to do is get your own survey done.

      @@tedr8454 you missed the point, it moved 60 feet on one side but inches on the other. Pretend you buy a Tesla, it is promised with features but then doesn't come with those features... I'm sure you wouldn't feel ripped off... right? The problem is the State is trying to take land that it did not purchase - that IS a problem. Just like your attitude. Wrong.

      Others have stated that an uncontested boundary is now the legal boundary after a given amount of time and I believe I have heard that before as well. However a real question to ask is did they require the roads on either end of that section of ground to also be moved 60'? If they are adjusting a quarter- or half-mile line is their line now exactly that distance from the reference point of a road at then end of the section? Your deed provides the actual distances from a road and the roads, not their supposed digital pin. We know almost nothing is in the real location where it was supposed to be located due to the accuracy of the technology at the time. There are boarders with Canada that are wrong and not at all straight but their countries have long ago agreed to leave them as they didn't want to pay for the correction. Minnesota has counted on you aren't going to fight.
      As for doing your own survey I would also have that done. Minnesota has been getting taxes on a give amount of acres over the years. If you now don't have 2 of those acres you need to have that corrected and ask for a refund on overpayment.

    Went through the same issue with land survey. Went to court and instead of losing 50 ft ended up losing 8 ft. Need to talk to a lawyer because in Michigan if you maintain it for 15 years you can claim it.

    Maybe different in mn. I was always told adverse possession witch meant after you have taken care of a peace of land for years it then becomes yours such as a property line between two neighbors

    I went through the same thing here in Iowa. Went through Lawyers with both party's concerned and it ended up that if the fence line has not been contested for ten years ,that is the new property line.

    Happy Father’s Day Mr. Dougo! I must say I am certainly surprised that y’all rolled over about land? They should not be Judge, Jury and End All Be-All! Do you have a lawyer friend that might give you advice without charging you much for a question before going forward! If everyone continues to comply…everyone will get land taken from them! Ask around and see if there are others and maybe you all can work together for the greater good! Tell them you don’t want to “gain” it at the other end…/they can have that unusable land. You are a farmer and you need every piece of acreage you already own! Sending Blessings to everyone @Larsons Farm!

    Have the survey certified, I did this in Kentucky to put an end to the neighbors' gripping. He was pissed because he lost about 105 feet of Kentucky River frontage. Went off Army Corps. of Engineers markers

    I was a party chief for a land survey company for a few years. GPS is definitely more accurate, but if the base station is not set up properly, it can be off by a few inches or miles. Something as simple as the base station not being leveled correctly or not verifying the known point hasn't moved at all will affect the location the handheld says the property line is. In most rural areas, it's usually a piece of rebar in the ground as a known point. In the city, they use a disk embedded in concrete. Next time you're walking down a sidewalk, look and will see them. These are the simple things that can cause an inaccurate reading. Other complications can come from entering setup info wrong on the handheld, not having enough satellites connecting, not keeping the handheld still while taking measurements, not verifying your setup is correct by measuring multiple know locations. and many other mistakes. You would need to hire your own surveyor and compare it to your neighbors' survey.

    Doug I worked as a surveyor back in the early 70s a rod was for elevation a chain was for distance they were in 50 & 100 feet and we weren't allowed to be off so the surveyor handed you a crock.

      Make them find the main survey marker at a cross road a start from thete should be a large rock buried in middle of cross road, may have to get lawyer to get full survey the government will screw you over land that is yours happen all the time

      Nowadays with satellite measuring there is no allowance for gradient. So if you have land on a slope it suddenly becomes less acres.

      Have you checked on squatters rights if you occupied that land for 100 years even if the original survey was inaccurate ? I think thats a real thing, at 24:23 least where I’m from

    We had a boundary dispute with our neighbors and both surveys were in agreement on where the property line was at. In the end, we were able to prove that we had maintained the area in dispute for over 10 years and won the court case under adverse possession in MO. You might want to check into adverse possession laws in MN and even with the new fence up, the fact that the old fence is still there might cause the court to award you the land. Also would check into why the two survey companies came to different boundary lines.

    Mr Larson, I am perplexed to your explanation to why you roll. Mentioning everything except for probably the most important contribution, conserving moisture through compaction and less surface area for evaporation, especially knowing things are going to get markedly warmer. Best wishes

    Hi Doug in the Uk we used to chain link harrows to tiller the wheat fields and it works. I did the same on farm in Alberta with chain link harrows on wheat and it worked great. So it does work

    In Michigan there are metal stakes at corners, that land is measured from. No matter where you are in the US there should be a starting point and all surveys should come out to the same location.
