Louisiana Parole Revocation hearing. I don't agree with the board on this one.

    I think you're missing a couple of very important points. One, he justified himself by saying his offense wasn't against a woman or child & somehow that excuses him just b/c the laws in 1976 didn't classify rape of a man as being a sex offense!! Second, you say system is broken b/c they aren't giving him help; the reason for the revocation-granted 1 violation was mj-were the 3 charges of failing to follow thru on his agreed to sex offender treatment program. Therefore, he's not getting help solely b/c he doesn't think he needs it & refused those mandated programs which would have given him help. I also find it extremely troubling that he maintains that his sexual assault of a man is perfectly fine & that he specifically stressed that the gkid he wanted to do so much w/ was male. Given his displayed attitude regarding his sexual target of note & denying the serious nature of that; can we honestly be assured that he will not cross the line w/ that gkid? If he took, participated & successfully completed Sex Offender Treatment Programs he would have a far clearer understanding of how inappropriate his behavior was & the dilatory affect it has on his victims & that might give us at least some comfort that he wouldn't reoffend. I agree wholeheartedly w/ their decision b/c there is nothing this guy said which indicates remorse-other than he regrets his offense w/o going into why & whether b/c he spent time in jail or b/c he was wrong & the harm on his victim-understanding of the severity & serious nature of his crime/behavior or any clear statement that he no longer has the inclination associated w/ his crime. Sorry; usually I agree w/ you, but I think that you missed a few clues in this guy. Just b/c he's 65yo doesn't mean that he doesn't have any sexual desires or inclinations. My parents were well into their 90s when they passed & had they not kept rolling on their med alert button causing one of the gkids to run in to their room all a panic, I might not be able to make that last statement w/ such a degree of certainty, LMAO!

      You know, your totally right. I assumed he did something like public M. I don't realize he s assaulted a man. In that case he was acting as if it wasn't a big deal. Yeah he's still dangerous. Also crazy story with your folks. Wow.

      @@mandoo1396 it was a thin line between traumatized or embarrassed, until we all broke down in laughter then she just settled on embarrassed! My folks had been married almost 70y when Mom passed & Dad hung on for another 4 years passing shortly after midnight on his 97th BD-stubborn guy was gonna make that! I think all 9 of us had been in the front room laughing/joking for probably hour/two when Mom needed to lay down for a short nap & had a quick stroke, so she went as she lived; happy, laughing & surrounded by her kids! Miss them dearly, but so blessed to have had them in our lives, our kid's, grandkid's & great's lives for as long as we did!

      @@jwebbbk Umm, I've got to disagree on your Mandoo eval. I've watched many of his videos & listened to his commentary & most of the time he is spot on. If this felons cunning word play hadn't struck me as being 'curious' I probably wouldn't have dug back to find the origins of his crime & was only able to do that thru some newspaper archives as it was pre-digital era! That's when I realized the sexual assault was against a teenage boy & since it was pre-Catholic Church/Boy Scout Legal Challenges the Law had not considered that a Sex Crime & didn't even prosecute them unless it was a violent assault; which again, this was. However, w/o that additional info excusing the guy b/c he smoked some MJ would seem completely in line w/ today's mores. In all honesty, this is the 1st time out of all his videos that I have disagreed w/ Mandoos take & both of us were really po'd at one decision where but for the sake of two members of the full panel seeing thru the guy's BS, he was going to be paroled! So, your 'touchy/feely' really doesn't apply to Mandoo & IMO when this case is viewed w/o the context the board had in is complete file & solely from the MJ violation the decision would be a lot harder to understand.

    I agree with the decision. When he was released, he was informed of all requirements. He decided not to follow them.

      @@mandoo1396 Again, it isn't the singular event or even the product; it is the disregard for following the rules which he agreed to do. The fact that he stated that he would sign anything basically at that point b/c he wanted out of prison should be an indication that he doesn't give a damn! Yep, so he used drugs??? Yep, so he refused to enrol in mandatory sex offender programs??? Yep, so he .... At what point will it matter to you that this guy learned nothing & only did whatever he felt necessary at the time to secure his release? Will it take him raping his male gkid when he hits his teens-yes, that's why he specified his crime didn't involve female or 'child' b/c child is defined as prepubescent & when into the teen years falls into the term 'minor'? He was very manipulative & selective in his wording for a reason!

    I totally agree with you on this one. I'm almost 70 and sometimes life on the outside gets crazy enough but it's nothing compared to what he's dealing with. We all will need help one day and hopefully someone will hear you.

    1976 year old crime. How long did he serve in prison? What was his sentence? Did he ever catch new cases? If he's been out and productive for many years or decades, leave him alone. If he poses any risk, he should be revoked. If not, let him go.

    These cases about never easy or black and white. But as a rule there are guiding principles: 1. The more chances a person a person has got, the more severe the time punishment and/or the need to try newer/alternative treatment methods. 2. The order of severity is : fine, Supervision, probation, jail, prison-parole death. While I personally oppose death penalty, I think Prison is sufficient as I believe no person is ever incapable and too late to change given enough time/work. If someone commits a crime and they want to move the punishment from one level to another, there are tools to do so : pardons, commutations, parole, plea deals & negotiations- otherwise it's pure innocent or guilty and you roll the dice at trial. The worse one's behavior, history, income status, and location in which you commit any offense will dictate how you are punished and how fast you can access those tools to improve your conditions.
    Parole is designed to help offenders to not reoffend. Probation is designed for offenders to improve their life. Supervision is to make sure low level offenders keep on track and do their jobs and stay out of trouble.

      I love these kinds of videos. I learn a lot about the legal system and how broken it is but I also learn that there are too many authoritarian bootlickers willing to constantly cheer holding people down forever.
      There is no benefit to anyone so the board's decision was unjust.

    I completely agree with the boards discussion to revoke his parole.... He was released with the condition to follow a certain set of rules. If he did not understand or did not have the means to comply with the conditions he should have pled his case to his parole officer... That's what they are there for... He knows the difference between right and wrong and he blatantly disregarded all of his conditions of release. Maybe if he gets out again he will follow the rules given to him....

    all i got is he being in denial and using what was not a law at the time when he committed crime he still in denial and the only thing they got out of this hearing is "his" grand kids what about the victim in his case? thats why he was denied

    If he is incapable of understanding the simple concept of “don’t smoke pot,” then I doubt he is capable of not reoffending. The fact that his victim wasn’t a woman or child does not make the crime any less life changing for the victim. The register is often abused and misused, but he sexually violated and man or a boy & they matter too.

    For ONCE I finally agree with Ms. Weiss she was right with the marijuana they gave him three chances for help and he refused his charge was not a S.O. Charge because back then charges against MEN were not considered, but they are now and he still does not see it that way. They gave him three chances to get help he declined all three and the S.O. Help so his age shouldn’t be a factor especially when he singled out his one great grand son. Just my opinion though.

    I disagree with you on this one. He said he signed whatever just to to get out of jail. That means in his mind he can do whatever he wants to do. That’s wrong on so many levels.

    Well, the weed smoking is kind of a non issue. If we gonna hold everyone to a perfect standard then lets point a finger at Big Pharma and hold them accountable too.
    This guy messed up his parole but it wasnt violent. Maybe give him another chance.

    I get it, he's a great guy and trying to do the right thing. But one of the points of being reformed is to follow directions, follow rules & guidelines. More often than not if a person cannot follow simple rules, he/she cannot/will not follow the law. He knew that he wasn't supposed to smoke that Marijuana. It may seem petty, but in the bigger perspective, it's a huge deal.

      More sophisticated resolution? You mean like requiring him to participate in Sexual Offender Program & Victim Awareness Class; both of which he refused, even tho' agreeing to as part of his parole? Had he followed that resolution he would not have been violated. His justification that it wasn't a sexual assault crime at the time just b/c the victim was teenage boy & thus it was only a violent assault & so he wasn't a sex offender shows a clear lack in understanding of his culpability & triggers & IMO he's far more likely to again beat the living daylights out of a 15/16 year old in order to force himself upon the kid. That makes this guy dangerous.

    I once worked in a clinic and a patient there was the product of incest and the victim. Her grandfather was sent to prison when his daughter was 5years old. When he came back 12 years later he didn't really recognize her as his daughter. And he raped her. She had a daughter and eventually left home AND left her daughter with her parents. So the granddad/father repeatedly molest her. She had some learning disabilities and was a fragile little thing that developed renal failure after her fifth child. At 15 she married a guy and rapidly had 5 kids and her husband beat the crap out of her on a regular thing.
