This is the way. You fight an idea with a better idea, not censorship. Reason works far better as a collective function. You have some ideas that will be way off in both directions, but the collective human intelligence has been a far greater driver of human progress than the lone mind. There is a danger in only engaging with ideas that are similar, and finding yourself in an echo chamber. Almost everyone does this with something, but it's perhaps well to remember that it is mutually beneficial to everyone to reason with opposing viewpoints.

The colleges are in violation of Title 6 of the Civil Rights Act because they’ve clearly admitted that if you’re not in a “protected” group then you are fair game for any and every type of harassment imaginable. Whereas if you’re in one of the “protected” groups no one is allowed to say anything that you personally consider offensive or else they face extreme consequences. The problem is that ALL people have the exact same civil rights. These administrators (and students) either clearly don’t have a basic understanding of civil rights law or they are just blatantly breaking the law. Either way they need to be sued up, down, and sideways.
While the law has its parameters, the private colleges code of conduct can be stricter as to who they allow on their campus that violates their code of conduct, as long as they aren’t discriminating. I don’t know which school you are siting and where in their code of conduct that you’ve found them stating or insinuating that one group is off limits and another isn’t. Can you give me a reference to this (like a story and the actual code of conduct of said colleges)? Would be helpful to follow what you are referring to!

A friend of mine whose political views I'm not sure of just because we haven't had a chance to talk about it, was complaining about inflation. First off, I'm in total agreement with making sure the protection of our Rights comes first. But our Rights have always come with a caveat: In the exercising of your Right(s), you do not get to infringe upon or deny someone else their Rights. In the case of Israel/Hamas, it's one thing to share your opinion on whether or not each group is Good/Evil or Moral/Immoral. Or who owns what plot of land. Etc. That is Free Speech. Calling for violence against someone, or some group, is where the definition changes. Are you merely speaking words, or wielding a weapon? Is it "Speech" or "Violence"? Remember, words matter. If they didn't, advertising wouldn't work. So when we talk about Free Speech, understanding the definition ( or Intent, if you will ) of your actions is paramount.

Great to hear Bill Maher continue to defend free speech! And I’m a huge fan of Greg Lukanov and his organization. But we have to stop using “fire in a crowded theater“ to represent the exceedingly narrow carveouts for unprotected speech. It was a phrase in an opinion by Oliver Wendell Holmes, which he himself participated in overturning shortly after. Unless speech is clearly tied to “imminent lawless action“ (or a very small collection of other narrow exceptions), it’s protected.
I think objecting to "fire in a crowded theater" is a way for pro-speech people to recognize each other in the wild, ha. Whenever I see someone making that point I go "that guy gets it." I guess it's easier to remember that imminent lawless action.
The university position on context needing to matter would be okay if they had that position for all derogatory speech towards every minority/ethnicity. The problem is for the past few years, they have enforced retribution on those who have conservative positions on issues, who have said far less controversial and hateful things than calling for the genocide of a group of people. Yet now, they are suddenly arguing for free speech. The inconsistency is the problem. The fact they have so strictly policed negative speech towards other communities, but seem okay with it towards Jews is a major policy failure. The double standard is why these leaders need to go.
Talking about the double standard: I am not an American and am limited to what I see on youtube, which, let’s be honest, is probably not the best thing. What doesn’t make sense to me is the binary nature of the debate. Team-Israel or Team-Hamas, as it is explained. In diluting the debate to pro-Israel or pro-Hamas, a binary choice, you amplify the double standard because by being pro-whatever, you have no option but to excuse which ever atrocities your team is committing. This is not and cannot be just a pro-Israel or pro-Hamas debate. There are a lot more to this. There is a debate as to whether Israel is entitled to its own State. There is a debate as to whether Palestine is entitled to its own State. There is a question as to the actions of Hamas in fighting for an independent Palestine (or even if that is what they are doing), whether those actions are a crime against humanity. Some of it seems to be. Likewise there is a question as to whether Isreal is allowed to defend itself. Of course they are. Is Israel allowed to defend themselves in the way they are doing now? From what I have seen, there are human rights violations. But we break it down into a debate as to if we are on team-Hamas or team-Israel, as opposed to a debate about the various principles that apply. I see no cognitive dissonance in condemning the human rights violations on both sides. And there seems to be horrible human rights violations on both sides. But to only condemn those that shout ‘death to the Jews’ and not also condemn those that shout ‘death to Palestine’, that is a double standard of note.

The problem with this free speech debate is the complete misrepresentation of what a lot of people are saying. Most college students who are protesting against Israel are not "pro-Hamas" or "pro-terrorist" and practically none are calling for genocide, even rhetorically. And even those being overly strident at rallies aren't necessarily the same people threatening and bullying Jewish students (and Muslim students are getting just as much harassment and death threats). Nor are they necessarily the same people trying to "cancel" their professors. This gross mis-characterization of a whole lot of people and their actual message is the first step to squelching their free speech.

I do. But seriously, it may take class action lawsuits by students for institutions of higher learning to understand or get guidance on what is considered hostile. They should prohibit speech that creates a hostile learning environment. Perhaps, what Justice Potter Stewart said about pornography also applies to a hostile learning environment: I can't define it, but I know it when I see it. Ultimately, it will come down to universities and colleges to enforce their own policies.

The reason free speech has become so controversial is because people lost the ability to not listen to it. Everybody has an opinion, and everyone has the Constitutional right to express their opinion. But people forgot they also have the right to not pay any attention to everyone's opinions, as well as the right to keep your opinion to yourself. I have never understood why people complain about what someone put on twitter after they made the conscious decision to follow that person on twitter. Bill Maher and all of his guests became unwatchable in the last few years. Intifada has a literal translation in Arabic, which is uprising or resistance. The question said that the use of the term intifada meant that protestors were calling for the genocide of Jewish people. That’s literally and normatively not what that word means. It’s also historically not what it means - the two major intifadas have been violent conflicts between a state that is oppressed and occupied, and one which is doing the oppressing and occupying. The vast, vast majority of people on both sides of this conflict simply want peace and security for the region, for arabs and for Jews, for muslims and for those who follow Judaism. But people protesting the systematic destruction of Gaza, the mass murder of women and children, are not going to be silenced by having our words and phrases redefined by those doing and supporting the oppression.

The colleges are in violation of Title 6 of the Civil Rights Act because they’ve clearly admitted that if you’re not in a “protected” group then you are fair game for any and every type of harassment imaginable. Whereas if you’re in one of the “protected” groups no one is allowed to say anything that you personally consider offensive or else they face extreme consequences. The problem is that ALL people have the exact same civil rights. These administrators (and students) either clearly don’t have a basic understanding of civil rights law or they are just blatantly breaking the law. Either way they need to be sued up, down, and sideways.
While the law has its parameters, the private colleges code of conduct can be stricter as to who they allow on their campus that violates their code of conduct, as long as they aren’t discriminating. I don’t know which school you are siting and where in their code of conduct that you’ve found them stating or insinuating that one group is off limits and another isn’t. Can you give me a reference to this (like a story and the actual code of conduct of said colleges)? Would be helpful to follow what you are referring to!

First off, I'm in total agreement with making sure the protection of our Rights comes first. But our Rights have always come with a caveat: In the exercising of your Right(s), you do not get to infringe upon or deny someone else their Rights. In the case of Israel/Hamas, it's one thing to share your opinion on whether or not each group is Good/Evil or Moral/Immoral. Or who owns what plot of land. Etc. That is Free Speech. Calling for violence against someone, or some group, is where the definition changes. Are you merely speaking words, or wielding a weapon? Is it "Speech" or "Violence"?

Israel has always agreed to a two state solution. 20% of Israelis are Arabs and Arabic is one of its official languages. There is no call of wiping out anyone on Israel's side. The chant of "from the river to the sea" is a call for ethnic cleansing at the least (which is what most Middle Eastern countries did with the Jews and) and genocide at most, which is the actual intent. The call for intifada is a similar call. It is a call to violence, to murder. Certain forms of speech by their very nature are connected to action in the real world. This is what a speech act is. In fact, some of those utterance are legally binding. In the case of an agitated mob, if a person singles out someone and utters "get him!" That is a call to commit an act of violence and is not simply an abstract statment. Calling for genocide is not the same as criticism of a government's policies. The former is a call to action to commit a crime against humanity and the latter is free speech.

The fire example in a movie theater is a perfect analogy to free speech. If you yell fire in the movie theater and you create mass panic that’s harmful that’s a threat it cost someone their life no free speech. If you threaten someone with your words, you could be jailed sure you can say whatever you want but now you’ve caused fear in the mind of someone else. Telling a lie well that could be harmful both civilly costing someone money or criminally. You can’t say what you want in that case. However, opinions you can say whatever you want then, it could be the harshest cruelest opinion in the world. People were allowed to say whatever they wanted when it came to integration and some very hurtful things were said, people believed these things in their heart of hearts, and the government said we cannot stop you from believing this, but as long as you don’t go too far as long as you don’t cross that line, you can say whatever you want, you can protest the integration of schools, but as long as you don’t prevent us from doing it, that’s OK. you can go out there and use some of the most hateful language out there that’s OK. Now there’s a funny thing in America you say the wrong thing to someone they may punch you again the person who was in the right to speak freely and actually, I’d be wrong to hit them for it. Your reminder makes me think of how an idealist free speech person must be ready to defend the legal right of someone with the opposite viewpoint to speak in a public forum where you’d loath to have them spreading their ideas.
When discussing free speech, genocide, political protests, businesses, & school policies-like most hot button topics-we tend to jumble and confuse a lot of legal, social, financial, security, moral, and civil checks, balances, freedoms, & consequences.
Some thoughts:
1-free speech is only legally protected from government suppression (except in Florida or some school libraries?)
1b-Ie Elon Musk/Meta/etc have all the legal right to suppress, promote, or otherwise pick & choose what to “publish” or not-assuming they don’t violate their own policies, aka user contracts’ Ts&Cs… but which social media forums can change on a whim… But, advertisers, customers, employees, and suppliers ~can ~choose to do or not do business with any social media company

But we have to stop using “fire in a crowded theater“ to represent the exceedingly narrow carveouts for unprotected speech.
It was a phrase in an opinion by Oliver Wendell Holmes, which he himself participated in overturning shortly after. Unless speech is clearly tied to “imminent lawless action“ (or a very small collection of other narrow exceptions), it’s protected.

The university position on context needing to matter would be okay if they had that position for all derogatory speech towards every minority/ethnicity. The problem is for the past few years, they have enforced retribution on those who have conservative positions on issues, who have said far less controversial and hateful things than calling for the genocide of a group of people. Yet now, they are suddenly arguing for free speech. The inconsistency is the problem. The fact they have so strictly policed negative speech towards other communities, but seem okay with it towards Jews is a major policy failure. The double standard is why these leaders need to go.

Talking about the double standard: I am not an American and am limited to what I see on youtube, which, let’s be honest, is probably not the best thing. What doesn’t make sense to me is the binary nature of the debate. Team-Israel or Team-Hamas, as it is explained. In diluting the debate to pro-Israel or pro-Hamas, a binary choice, you amplify the double standard because by being pro-whatever, you have no option but to excuse which ever atrocities your team is committing.
This is not and cannot be just a pro-Israel or pro-Hamas debate. There are a lot more to this. There is a debate as to whether Israel is entitled to its own State. There is a debate as to whether Palestine is entitled to its own State. There is a question as to the actions of Hamas in fighting for an independent Palestine (or even if that is what they are doing), whether those actions are a crime against humanity. Some of it seems to be. Likewise there is a question as to whether Isreal is allowed to defend itself. Of course they are. Is Israel allowed to defend themselves in the way they are doing now? From what I have seen, there are human rights violations.
But we break it down into a debate as to if we are on team-Hamas or team-Israel, as opposed to a debate about the various principles that apply. I see no cognitive dissonance in condemning the human rights violations on both sides. And there seems to be horrible human rights violations on both sides. But to only condemn those that shout ‘death to the Jews’ and not also condemn those that shout ‘death to Palestine’, that is a double standard of note.
Idk if you've noticed, but Americans are ready to hate and employ mob justice at a moment's notice. All they require is being told who to hate. The framework to start this segment doomed it from the beginning. Reasonable people can make distinctions like you have. That's not how we roll in the states. Just point people in the right direction and they'll do all the heavy lifting for their billionaire masters.

Yup, "useful idiots" is sadly the best description of this generation! I say that as a parent of two kids of this generation. So far, mine are balanced, but they are still in highschool so these radical teachers have some years to brainwash them.
The problem with this free speech debate is the complete misrepresentation of what a lot of people are saying. Most college students who are protesting against Israel are not "pro-Hamas" or "pro-terrorist" and practically none are calling for genocide, even rhetorically. And even those being overly strident at rallies aren't necessarily the same people threatening and bullying Jewish students (and Muslim students are getting just as much harassment and death threats). Nor are they necessarily the same people trying to "cancel" their professors. This gross mis-characterization of a whole lot of people and their actual message is the first step to squelching their free speech.

I do. But seriously, it may take class action lawsuits by students for institutions of higher learning to understand or get guidance on what is considered hostile. They should prohibit speech that creates a hostile learning environment. Perhaps, what Justice Potter Stewart said about pornography also applies to a hostile learning environment: I can't define it, but I know it when I see it. Ultimately, it will come down to universities and colleges to enforce their own policies.

Free speech imho should be open season. I personally loathe cursing, as it weakens the words overall and spoils language by destroying definitions, but other people curse irl and I just deal. Live and let live. But when someone decides to attack me with their words? I'm fighting back. Should lying be permitted? No more than you would permit public slapping. Should prayer be permitted? If they're not disturbing others why not? The issue is when you force others to endure you, thereby destroying their freedom, or you choose to use yourself to knowingly commit harm. Other than that, speech should be free. Let the best ideas rise to the top while the dregs settle below.

With respect to free speech being absolute. Well, that's obviously contradicted if you allow threats of violence to stand lawfully. Obviously, telling a person, "if you say (thing), I will then proceed to physically harm you." can not be part, and parcel of 'free speech', and is indeed not protected speech under US law.

I have never understood why people complain about what someone put on twitter after they made the conscious decision to follow that person on twitter. Agreed, but private companies and universities have code of conduct policies and if you break them, they can fire you. You won’t go to jail though.
@@Riclmnopp As I said Freedom of Speech is government related. So I completely agree with you. If it didn’t have congress involved specifically, I would not have commented. I have wondered often though if they receive government money and support does that count… but that’s another different question…
private or public, all universities and colleges take some form of federal money whether it's grants awarded to students or in the form of student loans underwritten by the federal government. Higher education is not immune to government regulation.@@Riclmnopp
Why not just rename this show "Bill Maher whines about young people because he's jealous and old" Also he is Jewish - his film Religiousity goes into it a lot. He's Jewish when he can be offended and when he wants to make a joke he's not. He's a charlatan.
As a Trump voter and a Republican (not looking for attacks or agreements) I have always loved Bill. He just says it how it is and isn’t closed minded to at least listen to opposing views.
I would be curious to know whether, as a Trump voter, you think Bill is entirely objective when it comes to Trump?
I've seen countless of my fellow liberals set aside their impartiality for the sake of bashing Trump.

I’m not a blind supporter of Trump trust me he does/says things I wish he didn’t. Also Bill and Trump have had their feud way before Trump ran. With that said Bill’s critiques on policy or even Trump as a person are valid. I just don’t like when he (and don’t like it on GOP side either) says crude or harsh things about Ivanka, Melania, or his family.
For example can you imagine if a “MAGA comedian” said the same type of thing about Obama’s kids. That’s not cool. Mob rules family members are off limits.
@@HowieFeltersnatchMD I don't know whether they should be entirely 'off limits' (especially if they are doing something that is clearly morally bankrupt like Hunter Biden), though I think going after a President's family *for no other reason than to get to the President* should always be frowned upon.
Personally I don't see much point in going after a President's family (assuming they haven't committed any crimes), because they are not the ones holding the power, the President himself is.
It would be nice if Bill actually let his guest speak!

So... Bill Maher thinks that students protesting the Palestinian Holocaust are a "bunch of idiots." Like I said, Bill's free speech may be VILE but I will defend to the death his right to say it.
Anybody who uses the words "holocaust" and "genocide" in this conflict are indeed idiots.

I don’t agree with the last statement. The school is complicit, parents are responsible also. The whole system of education in America is suspect imo. As an immigrant myself, 1974, I have often been disappointed with the level of preparatory education one receives in America. Very disappointing.
Republicans don't want an educated populous. The more educated one is the more likely they are to vote Democratic because they actually understand both sides.
With freedom comes responsible... A lot of Americans are irresponsible.

Hate speech is free speech. You just can’t threaten or harass people with speech.
Edit: also you are free to say what ever hateful thing you want to your boss and not be jailed, but you should expect to be fired.

Bill Maher and all of his guests became unwatchable in the last few years.
Intifada has a literal translation in Arabic, which is uprising or resistance. The question said that the use of the term intifada meant that protestors were calling for the genocide of Jewish people. That’s literally and normatively not what that word means. It’s also historically not what it means - the two major intifadas have been violent conflicts between a state that is oppressed and occupied, and one which is doing the oppressing and occupying.
The vast, vast majority of people on both sides of this conflict simply want peace and security for the region, for arabs and for Jews, for muslims and for those who follow Judaism. But people protesting the systematic destruction of Gaza, the mass murder of women and children, are not going to be silenced by having our words and phrases redefined by those doing and supporting the oppression.
Yadda Yadda Yadda, you always mean something else when you specifically say violence. They heard it all before Ahmed, they know you are lying to seem harmless until you're have the demographic advantage. Such a shame your brethren jumped the gun before it was time and the media is starting to wise up to it, huh?

And of course intifada means violence. Saying Israel ‘has the right to defend itself’ means violence, too. But armed conflict and genocide are two very different things. And if you had bothered to watch the Harvard questioning you’d understand my point.

At least they are open to both sides of the story maybe Chris Hedges professor Chomsky Norman Finkelstein, professor Mearsheimer, Jewish intellectuals who have dealt with this issue forever you will definitely learn something.

The issue on college campuses isn’t free speech.
It’s about getting so sidetracked by “inclusions” that they no longer value what made them in the opinions worldwide, their content and curriculum to turn out great graduates.
PLUS Entrance to these Ivy League colleges no longer based on merit, but now quotas.
No SATs originally to determine ability and overall performance.
Race based quotas have been illegal for over forty years. The only quotas that exist today are for legacy admissions (aka children of rich alumni).
People want freedom of speech also want freedom of consequence.
