    A Hudson man and his attorneys have filed a federal lawsuit against a Hernando County Deputy and Walmart alleging racial profiling and a false arrest.

    Asking for a person's ID is the first step when stopping and questioning someone. How did the deputy not do that? Mr. Nguygen was humiliated in front of customers, deprived of his liberty and traumatized, He should be compensated accordingly and it should be a 7 or 8 figures.

      @@Ontiming2023 He looks asian to me, that stands out, I guess he looked like an another asian man who stole items and that's why he was singled out. Asian is a race and they come in many colors. If you were targeted in a store in front of people, police failed to ask for Identification and led away in handcuffs even if you were innocent you'd be crying like a b*tich. Stating you would sue. So don't act dumb! In 2017 a 69 year old Vietnamese American doctor was DRAGGED OFF AN AIRPLANE for not giving up the seat he rightly paid for. Asians have been targeted and been victims of racial bias. If it were me I would sue!

      Cops ask for ID to see if you have warrants so they can arrest you. But if they get half a reason to arrest you, they could care less about your ID. Even in cases of mistaken identity; because the arrest is all that matters to them.

    So much is wrong here. Not getting the man's ID immediately was a really stupid mistake. The consequences of being arrested are substantial, so arresting the wrong person needs to have huge consequences on the officer.

      @@AzeOfSpadez I get your point it's valid but only valid so far. For some people it matters just on principle alone because money is not everything for them. For business or travel having an arrest on your record makes clients skittish even if he's innocent.

      @Steven he made a mistake the proceeded to take tony back to jail after he apologized over a 2013 trespass thats been negated considering he shopped there multiple times after a year and no one did anything. Also, why didnt he just check his ID? stop making excuses for officers, they’re supposed to be professionals. He humiliated tony and arrested him for nothing.

    He has not been disciplined for his actions?! He did no investigation, he took the word of a Walmart employee. He violated 18 U.S. Code § 242. That is clear as day. Why protect his identity? If that was a civilian media would plaster their face all over. Police departments should not investigate their own crimes. For true accountability, an independent entity should be in charge. People are tired of hearing "we have investigated ourselves and found we did nothing wrong."

      @@haydenfowle7576 I've never seen solid evidence of official quotas and most cops will tell you it's B.S. There is enough crime and enough people breaking traffic laws that cops can find unlimited things to investigate. It's more like generating revenue has become the priority for police. There may be some incentives for officers to make a certain number of arrests, but it's not much more than the incentive a waiter has to be an employee of the month for the most tips and customer compliments. I don't think quotas are the problem.

    I hope a judge finds in their heart that this situation was wrong. Walmart deserves to to loose and pay because their loss prevention staff clearly has training issues. Someone better have side by side pictures and confirm a name before calling for someone to get arrested. This is traumatizing.

      @@Nadindel not only did he repeatedly shop there years after with no problem beforehand that does not negate the racial profiling and mistake which led to a coincidental arrest. This is like going into someone’s house instead of the neighbors for drug paraphernalia and then finding some carts in the house and arresting them for it. It’s genuinely nuts like that’s a genuine coincidence and if it wasn’t for the racial profiling he would’ve been fine like he was every other time.

      @@Nadindel The cops didn't know he was trespassed 10 years ago. The cops let him go and apologized for it but then they tried to cover it up later by claiming it had something to do with that trespass that Walmart voided by allowing him to shop for years.

    A no trespass can only be for 1 yr in Fl and after that if the store let him shop there the order is automatically vacated so......the sheriff using a clerical oversight to cover for a deputy is wrong.

    What they left out in the video is that in the car ride home, the chief called the deputy taking Mr. Nguyen home so that they can run his ID to see if he committed any crimes and when they found that trespass warning from years ago, they brought him back and fully arrested him for trespassing. The trespassing charge is in this video is in reference to the second "charge" of trespassing which they never would've discovered if they hadn't arrested him wrongfully, if that trespass warning is even in effect. That caller needs training, Walmart.

      Yup Walmart does not rescind trespassing unless you pay a huge amount. Like several thousand dollars. Then they still don't for a couple years AFTER you pay the fines. And their ain't nothing you can do.

    Being arrested can cause lifelong issues for someone, *so cops should face lifelong consequences for falsely arresting someone.*

    The trespass was still in effect, but they let him shop there numerous times? Doesn’t that negate the trespass? This is absolutely ridiculous on behalf of the cops who didn’t even bother to verify, until after he was at the jail, the man’s identity!

    He should've sued the department as well. The fact that they're justifying an unlawful arrest based on a trespass notice years ago is concerning.
    They were not called for him they were acting based on something else and he just happened to have a trespass prior.

    I tried not to shop at Walmart in Canada and the USA. I have seen fights, arguing, threats in different locations, cities and in Canada and the USA many times. Ironically, my family shops at Target and have never seen anything even close to Walmart. It may have something to do with Walmart's staff training and the quality of their staffs.

      it has everything to do with training and quality just recently i was at my local walmart (i have severe copd,asthma and have to be on oxygen when im up and around) i went to take the cart i was using back to charge , the door greeter asked if i was parking it (there was an old guy who was sitting at a subways in there (he said he had been waiting a half hour for a cart) the intended accusation here is that i looked like i didnt even have to use the cart. (he didnt say this but his attitude said it all , as well as his tone of voice ). i gladly gave it up to the older guy no problem . i went back to the checkout where my family was so i could retrieve my oxygen tank so we could leave. i hope that (door greeter) felt like crap when i walked back out the door pulling my tank behind me.

    I think it's just a WalMart thing - I was in holiday in Texas and went in one to buy a satellite navigation system. After I'd paid, I put my sunglasses on, started walking out quickly and was accosted by security there asking me to show them my receipt. There wasn't any trouble beyond that but I did ask: "is this something you normally do?" and the guy basically said 'yes'!
    No other store I went into had a problem with me nor my sunglasses and just about every stranger I met was like a friend to me. Only in WalMart did all the staff seem unhappy from the guy that helped me find the product, to the lady at the checkout and the security guy. Perhaps in the case in this video, someone called the cops just to add something a little more interesting to their otherwise depressing day! ...Perhaps they didn't even notice!

    This has nothing to do with race that is a lie. Why would they mistake one Vietnamese guy with a person of a different race?
    The Walmart employee sincerely believed he was this other guy who had been recently trespassed.
    Do not get me wrong Walmart will be liable for their part in this and will pay for it but to say this guy was attacked for being Asian is stupid. It is not like Walmart is kicking all Asian people out of the store.

    $10-M is beyond reasonable and will just inflame the jury and hurt his case.... They should have ask for something reasonable like $100,000.... Truly the case wasn't that bad, maybe $10,000-$20,000 to be honest + pay his lawyer fees and an official apology.. yes, it is terrible, but this does not equal $10-M in damages and punitive awards.

    The bigger picture is that, the deputy failed to verify Mr. Nguyen 's identity on the spot rather than just go on the word of the loss prevention specialist until after he was booked into jail. The opportunity to do so was there and I'm sure it's a matter of policy.

    No proper investigation done by the cop and his chief and cop did not ask for ID either. This is not a mistake, cop just wanted to make a quick arrest.

    Deputy Michael McNeeley is the name of the officer who "forgot" to check the identity, David Petigrew is the Walmart employee who called police and admitted he didn't positively identified the customer.
    Racial profiling, no doubt.

    "Not identifying the officer because ... blah blah blah" He is a public servant and anything and everything he does is open to public scrutiny so protecting his identity shows your true allegiance. He unlawfully arrested the man, meaning the cop broke the law, assault and battery, kidnapping and false imprisonment and this channel thinks its necessary to protect the criminals as long as they wear blue and have guns and tin badges
