After 8 months of waiting... our visa was denied to Italy. Now after spending the last 9 months of building our house, what is our plan?

I'm a German, so settling in any country of the EU is easy for me. However, my wife is Brazilian, and so I have my share of experience with Visa.
My advice: Get a specialized attorney for immigration law and let him handle everything.
Going alone to that Visa appointment was the biggest mistake.
Once, an attorney steps in front of these immigration officers, they know that they are in trouble if they don't follow the law.
Yes exactly. You must always hire an attorney. Especially with the language barrier. Attorneys know what to file and you will be taken more seriously.
Totally agree, have had to deal with obnoxious italian administration too ! It’s a lottery. One employee will go the extra mile to help you, another have his 15 minutes of fame by showing you he is owing your future in his hands and going to make it miserable ! When this happens, don’t waste your patience just walk away and escalate. This is when an attorney is mighty helpful as when such an obnoxious person is waking one inch sideway from what he is supposed to do the attorney will frame him and report him right away ! In my case the guy went from that day onwards to the loo each time I entered the Municipio and other people I dealt with where most helpful ! Courage, but don’t hesitate investing in an attorney. Typically it also reduce the amount of useless paper being deemed necessary ! Your case seem extreme, you should report it through an attorney to both your consulate/embassy toge this guy’s dismissed !
Agreed. Spend some money on a professional and get your visas done. I have been through this process several times with my wife, who is South African.
I applaud your bravery and resolve. It will get you far. Just back up that resolve with professional help and it's a win!
We hired a paralegal to help us get permanent visa status, the language and legal barriers are too great to overcome to reach a successful conclusion in a foreign country.

As an Italian I'm sorry and literally ashamed by that man's attitude. you guys are amazing and your attitude is admirable. you got this, and you are gonna win!
As an other Italian I am also very sorry that you guys had to face this part of Italian bureaucracy. Probably your Visas got denied because it is how it works in Italy. From my experience they alway deny Visas at first and then they finally look at papers when you appeal (same here where I live in France). So don't worry. It's only part of a normal but weird bureaucracy that tends to use this as a way to discourage immigrants to come in Italy. In bocca al lupo! I am sure that everything is going to be alright:-)

Having a visa denied is hard. It happens to many people wanting to come to countries, USA included.
Too right fight the man's attitude is really bad his mood should not come into you're viza you get these people I life , they need took at you're TH-cam to see how hard you've worked " Good luck too you " ❤❤❤

The key is to get residency visa first before one buys real estate. Bureaucracy is complicated in many countries and one has to have a really well connected attorney who is with them every step of the way.
@@antwonk That's likely true, but I've found that sometimes my comments can help others with their own journey. I've seen too many horror stories where people buy homes, and then find out that they can't get residency status. It's sad, but first step is getting permanent residency. While Italy is a very beautiful country and the charm of Italians is legendary, they are not really pro-immigration unless someone has a great deal of assets.

I would say the key is to get residency before assuming you can live full-time somewhere. Buying a property is separate; it could be for vacationing, investment, etc. You don't need a visa to own property in most European locations ...
@@kimmancha4314 While that's correct, most people who purchase property abroad have an intention to live there. If one can only reside there 6 months of the year, then what does one do with a vacant home. How easy is it to rent it and who will manage it when they aren't there. Of course, if one purchases a property in a highly desirable location, then that's less of an issue but many people for price considerations choose more reasonably priced areas, typically harder to rent. Having a vacant home is a problem.
Then there are the tax considerations. It's not just the simple if I live out a country for 180 days that I'm not a tax resident. One needs to have reliable tax professionals. If one is from the US, our tax policies are fairly straight forward by comparison to many countries around the world. Of course, if one invest substantial sums, then one's options increase considerably. Italy is working on their own version of a Golden Visa, but one has to invest somewhere around the 1 mil mark, pretty much out of range for many people. Same with Malta, one can get citizenship by investment for around the 1 mil mark.
In this couple's case, they should have gotten their permanent residency first. I have personal residencies in several countries, I could see how the political and economic climate was changing, residencies have not only gotten more difficult but far more expensive. The country of Portugal has eliminated their Golden Visa program, one can still qualify under their other visas, but the intention is for people to live longer period of times in that country.
On a subjective note, Italy is in the midst of culture wars themselves. While it may appear less divisive than in the US, there is a greater consensus against woke culture than in the US/UK/ and many other EU nations. Italy has stood strong that only biological women can be in beauty contests. A very attractive female leader in Italy, has stood strong for family values in opposition to many EU dictates.
Since 1990 Italy's GNP has not increased 1%, so apart from any bail outs by the EU, there has been little economic value for them being an EU member. At some point, there may be a parting of the ways.
I thought that getting a visa was not how much work you did or being prepared but actually qualifying under the law. Do you qualify or not? I have doubts about your attorney/representative.
I know what you did wrong. When I went for my residency visa, I had my lawyer with me right there at the window. I said nothing and he did all the work. We went through 2 other agents before my lawyer found the right person. Sorry this happened but like I said, use your lawyer on the appeal.

for sure this is the only way. regardless of costs, italian lawyer standing there and you spoke when spoken to and smile the rest of the time

Failure can only occur when you give up the fight. Even then, it is a positive, and one only learns from set-backs.
I have gone back and binge watched all your videos related to your Italian adventure...I embrace your frustration and your visible burnout fully as I have done something similar in Hungary with my family home, renovations, re-unionification visa, etc...being a U.S. citizen in the EU is NOT a slam dunk. DO NOT GIVE UP E-V-E-R!
As Americans who have lived in Italy (it took 6 months for our visa) let me suggest two things: (1) stop saying that you will “fight”; being belligerent will get you nowhere. (2) You said you had the best people helping you. Why were my they not with you at the questura (particularly when you don’t speak Italian)? They should fix this or get a new avvocato.
What you are showing your girls in dealing with adversity with grace and dignity is priceless!!! Let the adventure continue. You all are amazing!!!

Italians are treated just as unfairly in Italy, our bureaucracy is the dumps. I am surprised the professionals that are assisting you were not there with you... Tip: in Italy all gets resolved by knowing someone that knows somebody and helps, just because the process is a freaking mess regardless. I wish you all the best ❤ and love your attitude😊

I am in the same situation. My wife and me have to leave in 6 days from China while we had invested in a business. But we are world travelers and we will move on!

I've had 10 years and counting of wading through paperwork and fees and clerks as an American immigrant to Denmark--still waiting for permanent residency--still smiling (most of the time). Europe's worth it! We're renovating an old farmhouse where some parts are around 400 years old. Your labors are inspiring! Thank you for sharing them the way you do.

@mynamename5172 I did my Ph D as a German in France in Biochemistry 1982 and then went to Cornell 1982 to 1985 - this was the most amazing period in my Life - I feel more American than anything else. USA is Self destructing and I do not see any Future in and of the USA - Language is my priority - I speak fluent French and would love to live in France - but the horrible Politics there...

@@raginald7mars408 It's a loss for the US that you stay in Germany. I also have advanced degrees and a decent work record as a university professor. Supposedly just what Denmark wants to attract! The law doesn't seem to work well for the intention.
Dealing with Government in any country is a problematic, frustrating, sometimes depressing exercise. I have found it to be like playing a game in which not all the rules or moves are to be forthcoming unless you ask the right person the right question at the right time.

We are Americans living in Italy having our "Permesso di Soggiorno" (long stay residency). Nothing in Italian bureaucracy is a slam dunk...ever.
We're interested in what the reasoning was for the denial. It seems so unclear by your explanation. But also understand it's a private family issue.

I thought Italy encourage people to come and renovate these old houses.
I didn't know the process is that difficult.
They should make it easy
Some municipalities in Italy are offering houses in their historical centres for very little money in order to rejuvenate life in remote towns. Those houses come with lots of strings attached (deadlines for renovations, use of the building after renovations are completed, etc.). The building we have here is not a house in a historical old town but a rural agricultural building.
In any case, renovating either type of building does not come with residence rights and if the owner is not an Italian or EEA national, they are either restricted to 90 in 180 days or have to qualify for a residence permit as a family member of an Italian/EEA national, university student, employee of an Italian company or self-employed person. There are quotas for most visa types and nearly all require to apply from the applicant´s country of nationality or legal residence.
I could buy a house in the US off of ebay for a couple of thousand dollars. I could go over on a tourist ESTA and start renovating. Could I legally stay? No. I´d definitely not be eligible.
I hope this family will find a way.

When I saw them what they were doing I was thinking: hmmm…..they ended up in xhit, they are in xhit. In Italy he bureaucracy kills you, they’ll finish building that house in who knows in how many years and they’ll have to throw lots of money to the l’ingegnere l’architetto il Comune etc. If the comune doesn’t like how you build the stairs inside the house they can order you to remove all and build it again and again until they’ll have a nice day and will tell you an ok. And i have to say that people who work in public officers are very dumb, they understand nothing about their job and can make your live terrible. Regarding immigrants they prefer the illegals ones, they don’t have much brave to make them feel upset- they’ll be consider racists. Before moving in an another country you should check…..As a UE citizen I received the Italian residence as a student, I had to show them my bank account I had in my native country.
I guess from la questura they have a problema because they don’t have a steady job, I mean un lavoro fisso, a stabile income. Go there and try to explain them that your job is TH-cam, you earn and provide for your families from there. Maybe la questura from bigger city would understand what it’s about, but in a mountain village……
Once in a while I watch their channel for this reason, I’m curious as us citizens how will they end up, be treated by authorities…..or if one day they say screw all letters go….

I lived in Spain for years, the paperwork processes are similar. I would NEVER attempt to submit any paperwork without a native speaking person in attendance. With the help of friends/neighbours/paid legal representatives, we got our government paperwork passed, even then it wasn't quick or easy.

When you become a emigree of a country you should have your immigration attorney with you, and good command of the language.
I’m sorry this happened, it’s such a shame the bureaucracy is so thick, and the system is so broken. Unfortunately we have similar challenges in Germany. It can be so stressful, and it prevents good people from staying long term in the country. But if there’s a will, there’s a way 🙏🏻❤️

I am sorry you have to go through this. 30 years ago we had to go through a similar process coming to America. Our visa was denied and we were on deportation proceedings. It took us 4 years to get our green card and lots of strength. So proud of you guys!! Keep going

I once wrecked on my way moving to a new locale, and thus missed my orientation and the job I had secured there. I was devastated at the lost opportunity until I learned that a freak accident happened at the property in my absence, which would've definitely been the end of me. Sometimes our paths are diverged to keep us from a chain of events that would bring us a much worse outcome. It doesn't make sense at the moment, and may seem brutally unfair, but I still think about this. Say you were approved, went to go celebrate at a restaurant, then got back on the road the one moment someone coming the other way was distracted... Ya never know. Guys, I'm Italian, born in the '80s. The shortage of young people is downright FAKE, and I'll tell you why. I literally had to leave my home country, just as hundreds of thousands other young people, who graduated from university. I left almost 20 years ago and believe that I tried to move back, but there was no place for me (and by me, I mean us, lots of young, capable and qualified people willing to stay in their culture and contribute to society the best they could). Now, because of the governments' decisions of the last three decades, it was literally made impossible for youth to grow and thrive. Very few made it, but just so you know, people who work at immigration offices are not there to welcome you, they are there to reject as much as possible (in Germany it's the same story, you better believe it). About Italy, if one is happy to earn very little and do jobs one didn't study for, then welcome to stay. Everyone else had to make the hard decision to leave instead. I can tell you that it's not because you are particularly unlucky that you're being denied the Visa. There's a plan to turn the country into a cheap bunch of ruins, so that some "wonderful saviours" with a lot of (corporate) money, will come and buy it off for a few dimes. Take a look at Greece and what happened to its economy. Do a quick research and find out which names were behind the economic failure of that country and you'll see the blueprint for Italy. That's why our generation had to be out of the way, so we couldn't be there to stand up for our country. This is of course just one of the reasons as for why good people with good intentions find hostilities when trying to settle in the country. We need to open our eyes and observe the contemporary global framework we are moving in. Many blessings to the entire family and don't give up! Stay strong!

Heather Happy Birthday! Sorry to hear. It sounds like typical bureaucracy in action. Immigranting to a new country is a pain as we went from Italy to Canada. Only to loose my Italian citizenship due to a temporary legal situation. I wish you guys all the best. Deep down I wish you a very successful outcome.❤
Conversely took 3.5 years for me a 🇨🇦 with a 🇺🇸 husband to get a permanent residency. $13k in legal fees.
You guys have the absolute right attitude. I can only recommend that you give over as much of the paperwork and chasing as possible to an immigration lawyer who is Italian. Only show up to the appointments where your presence is required. And when you are there, smile and radiate patience and positivity despite what you feel on the inside. Greet everyone in Italian and thank everyone for everything, regardless of how small the service. Worked in France. May it work for you Italy! That said, I also had an income in France. Which I know is a chicken and egg dilemma -- since in most places you need the right to work/reside to earn local income.

As an Italian, married with a foreigner and relocated abroad in several different countries, I know how hard it can be dealing with Questura people. Fight it back, if you have all the papers supporting your visa, they are bound to revert this decision. Ask to deal with the main officer directly (questore), don’t give up. Good luck! 🤞🏻

I suggest you take an "avvocato" , it may help if you act through a local. But if you applied for a self-employed visa- it is almost impossible to get it, as there is a quota and you need to get work permission as well.

They make unwise and romanticized decisions,that’s the main problem.
Can you put a po box on a warehouse in Germany and just live there and even get a visa, as a foreigner?!

I may be old school. When I was young, you dressed up to go to court or official meetings. How was the immigration official dressed? Was he wearing a tee shirt? Maybe for your appeal, dress similar to how the official was dressed to subtly show respect.

Was the Italian immigration official wondering how are you going to work & support yourselves when you are not fluent in Italian? Perhaps making a living off of TH-cam is not enough to qualify for permanent residency. So many questions I don’t think the rejection ‘he had a bad day’ is the entire story

So sorry that your visa was denied and that you have had such a horrible experience. Despite all your problems and worries you have posted a really positive and inspirational video. What a wonderful example to you girls. They are so lucky to have you as parents and to have all the experiences you have been given them. I wish I'd seen your videos 30 years ago when I was raising my daughter. We did well and they are both amazing strong, adventurous women, but I regret that we focused so much on working and security in those precious years.

I am an Italian living in New York, it was not easy for me to get the green card here either, I could not leave US FOR A YEAR
Same for me a 🇨🇦 in USA 3.5 years wait and could not leave the USA for a year whilst visa was in transition

Before I came to the US my first visa was denied because the consul had a bad day too and without looking at my paperwork he said that "I didn't have enough connection to my home country to leave it and be expected to return."

Italy has got its immigration rules like every other Country in the world.
Besides for this family will be particularly difficult to get visa since Brady hasn't got a job and a steady income.

I don't understand how they can just assume they have a right to live in a country (not just Italy) without having first met the residency requirement or becoming citizens. Will they have to give up US citizenship? And are they prepared to do so? Most immigrants who don't come through family reunification immigrate because they have a job and are willing to work in the local economy. It seems they consider a visa a requisition to the government, that just has to be completed as a formality.

Hi, no they don't need to give up their USA citizenship. Many immigrants here have double citizenship.
To get Italian citizenship you need first to apply for it, pass certain exams: knowledge of the Italian language and aquantaince of Italian cultural history.
This only after TEN years of residency in the Country for which you need the Visa permit this family is trying to get.

Absolutely! I agree with every word you said. Yes, to immigrate to another country is extremely hard, you easily can get a PTSD if you let yourself internalize the difficulties. My small family and I went trough the hell of bureaucratic nightmares for years in order to leave a European country for living in Canada, but it does not matter which way you go, roadblocks are there to climb. Yes, positive attitude and willing to fight to the end is crucial. I may sound pathetic to those who did not go through this process, but believe me, you need the patient of a saint and the will of Hercules to come out winning in the end. You guys are totally capable to do it, your attitude is just what required to achieve your goal. It is worthwhile, so keep it up, we are with you!

@@vd1194 there is nothing misleading in my comment. Immigration is excruciating no matter what. It was for us, even if we did everything lawfully, straight laced and by the book. It took years to complete the process with lots of sleepless nights and uncertainty. In my comment I did not discuss any of the details how and where Brady and Heather's application for visa went wrong. I am not familiar with the process how you should act in order to have success in their case. I was talking about how immigrating can take a toll on you and how to behave generally to reach your goal. You maybe right about how they should've proceeded, but I am sure it is not helpful at all.

Our daughter, son in law and 4 grandchildren moved to Australia 9 years ago it took 2yrs + prior to that to sort everything out. Take a day/ problem at a time it WILL be ok 🙏🥰

As an American in Italy I learned the same lesson I learned being a woman in America. Sometimes you have to work twice as hard to get half the credit. Is it right? No, but there it is. I hope things will improve with time. Some things to keep in mind... First, not all Italians are excited about the surge in foreign investment in their country. You are definately helping yourselves by learning to speak Italian. Also be mindful that Italians place an emphasis on appearance. If you attend an important meeting or Court in a tshirt you wear working construction all day, it can be misconstrued as a lack of respect for the process. As an attorney I was often shocked by the attire worn to Court. I always advised my clients to dress in a manner that illustrates the dignity of the occassion.I recommend you keep a collared shirt and jacket for important meetings and hearings. It is a small thing but it can make a huge difference. Look around the town during passagiata hour for an understanding of this. Many Italians think of casual American dress as slovenly. It is sad that this difficult employee had this negative impact but you may not be doing yourself any favors by being so American in Italy. I am thinking positive thoughts for success in your appeal.
