Dina management ruling was as regards land and I believe it applies only in that context. Besides, the court did not trash the concept of bona fide purchaser, it only emphasised on the need by purchasers to conduct proper due diligence for the principle to apply.

Most of car thieves tamper with chassis, by modifying the chassis numbers to their preferred chassis numbers. My advice is, she should take the vehicle to dci, and through a tapelift, dci should be able to check the original chassis ( The have a certain chemical that they pour to the melted metals that thieves use and the reaction leaves the original chassis number visible. Once she gets the original chassis, she can easily apply for a new logbook through a forced transfer method (Google way to transfer a vehicle via this method and documents required).
@@solomonkeith5001 but mkuru said she had all the documentation, that means the logbook is written the mzee's details and kwa ntsa tims systems most definitely inasoma mzee. And if that's the case, all she needs to do is a forced transfer with the correct chassis. They can also apply for a new logbook with the new chassis number given by dci tapelift, they're required to take the vehicle for any ntsa inspection centers, we have one at Likoni road, Thika, Embu just to mention a few. Once the vehicle passes the inspection, a new logbook will be issued.
These are mostly vehicles meant for transit, kwenda ug ama tz. So it may not have been stolen in the sense/way you think. I mean no previous owner in 254.
The easiest way out is 1st, do a tape lif report with DCI for the chassis and engine number for verification. When chassis has not been tampered with(which we believe so since she is the rightful owner). The other party will be notified to also do the same (which we believe the other party will not show up). NTSA will proceed to de-register the current registration for a new registration. That way she will be able to dispose the unit.

Sell the parts. They could get more for the parts than the actual vehicle. Think the people who sold it to them also just put parts together if it wasnt stolen
A good idea, but not legally practical. When the vehicle will be needed and it is found to in such a state, that will raise an alarm, and the argument will be they are the actual thieves. They should involve a Lawyer and the same Subaru guys to help them get tape lifting @DCI. Then take the vehicle for inspection & later apply for new PROPER entry in the system. It will cost them but legally is always safe. Short cuts will catch up with them since they're already in government radar.

A client of mine sometimes back told me this cases are usually fabricated by police, they usually know do the person who sold the car, so they give you time then they come and claim it was stolen. If you are found with a stolen property you can't be allowed to live with it at the station, another question who is the compliant?.

Where by you find two car which are very identical use the same number plate. The police know about it and they can tell which car that's correctly registered. Only that they just want to eat from those people.

I've been in the same exact situation..... Yi hua a deal between police and the car dealership... And it happens once you clear the car debt/loan ... It's a way just to extort money from you. What they do is sell you a car that has been switched the chassis number and number plat to fit an exact car model that's a salvage written off... No one will ever claim the car... What they do is keep sending different police to arrest you and extort money from you now and then. Only option she has is to sell the car to be dismantled for spare parts and even after that the police will still get to you asking you to show them whom you sold the car to... It's a never ending extortion by the police working together with the car dealers... They will never take you to court or book you in a police station... They just extort you in side the station or at the cid station and let you go with the car.... After a month or less diff police/cid get to you again and the process repeats again and again till you dispose the car... She should count her loss and sell the car for spare parts, it's the only way to end it

They can do a deregistration then re-register the car. If not so, through CID officers, they can do a tapelift then correct the mistakes and re-register.
