      Apparently 60% of court cases is WON by the fathers - if/when they fight for their kids, so I guess it's not just for women.

They don’t care if you have the children, all they care about is that you pay. If you don’t pay you will be punished. Just like this man had his kids for four years and they still say he own back money.

      The father should have gone to court a lot sooner and filed a change of circumstance. Luckily, she was a no-show, and he got credit for the time he had them. She should have to pay him back the difference, though, and then some.

      Don't think for one bit that she a state employee that they not gone take that money from her expeditiously. However, there are processes unfortunately that are not through the same courts. But if you listened they said they will be getting things cleared and refunded what's holfjng and the possession credit and go back to him

      @@missdee212 That is the problem. We cannot have a court system that can impose payments, but not order them to be returned. It is one sided. If a judge cannot refund a payment, then they should not be able to order a payment to begin with.

    My mom collected child support from my dad for years. I found out at 26 that he wasn't my biological father, and she knew she cheated on her husband all along. She tried to pass me off as his being they were married. She divorced him and demanded child support for a child that wasn't even his! Over 20k she received. Had my dad put in jail and every for child support back in the day. I was only a paycheck for her. None of the support money went to me. She is now alone and suffering with no friends to call on. She had a long run but a short fall.

      I’m not sure the law is the issue. I think it’s the application of the laws and the lazy use of case law that’s brought us to this.
      Any time you hear ‘ in People vs Smith’ they are using case law as a precedent to ease the case burden. It’s lazy, not always wrong, with bad judgements getting cemented as ‘law’.

    My kids lived with me for over 2 years and ex wife missed 4 court dates before they finally gave me custody and stopped taking child support. I was paying $6,500/month on 3 kids and alimony. Never got the money back. I had $12k in lawyer fees on top of that. The system is stacked against men.

    This same scenario happened to me starting in 2004. For nearly 5 years the AZ. Division of Child support enforcement garnished my paycheck after I was granted full custody of my 3 young sons. They completely ignored legal documents and sent my money to a woman who hadn't seen her children in 5 years! I pawned family heirlooms, ate Ramen noodles and Worked any side job I could find, just to make rent, and keep the lights on. The hardship we endured was painful and never should have happened.

    It's outrageous how fast the child support court holds a father accountable when he misses his obligation but doesn't do anything when a mother abuse the system and take money she knows she shouldn't get .

      I'm glad the father finally received some relief. However get the other party to repay back money is rare. I've only seen one case that the mother had to repay child support. That only happened because my friend who was assumed the father wasn't, he was also a Police Officer. That was the only case that I've seen a reversal.

      No one know that she was trying to run over him, once these things are set in motion the State does all of the rolling and the custodial parent is passive. (what ever happens - happens because of those slanted ass legal construct! Even if they had an understanding between themselves - The State will not usually help. The State will have both paying at the same time in Illinois - They real crooks!

      He was concerned about his children. If he had went after before, because she wasn't the primary custodian of the children, but had legal custody, he didn't want his children taken away from him and given back to her. So he stayed silent, supported his children, and continued to pay child support to her. He didn't want the drama or the trauma to his children. His priority was in the right place. That's why she didn't show up for court. She knew she was wrong and thought legal issues might arise against her. Her children will know what she did while their father was providing for them twice over. At this point she will be lucky if they ever speak to her again. She committed fraud and got away with it.

      Agreed, I got railed after raising my daughter her first 4-years, they claimed that as back payments of 4-years, and used the income from a job that had not worked for more than a year, and at that time I was on unemployment. They constructed it this way to dis-enfranchise, and divide us.

    I had my kids, my kids mom was still receiving child support. I went to the county and applied. They got her for fraud, canceled my $103,000 arrears and I started receiving child support from her. In California

      There is the option of pressing charges. The problem there is that most attorneys advise against it, as it can look bad on the father in the family court proceedings. AND in criminal court it actually looks bad for men to press charges on women too. it is really disgusting.
      This man and others do also have the option of a civil case... suing her.

      @@dalimitless01 It's true. I'm in Texas. My child's father repeatedly would go months without paying. My daughter had her card most of the time. So I wouldn't notice until seeing the statement they'd send each month. Then would slip my mind. I remember one time I finally called because he swore he was.
      They said they wait 3 months. then send him a notice. then after 90 days if he does not give sufficient reason, they schedule an appearance, which takes more months.
      Look how much this guy supposedly owes.
      Texas is pretty lenient

    This doesn't surprise me at all. My husband was telling me his ex-wife did the same thing with her other ex-husband. He had the kids, and she wouldn't give up the child support. She lied to my husband, but he found out later on through the ex.
    Unfortunately, the ex went to jail for non-payment, and she would laugh and talk mess. My husband said that's when he started to take her seriously.
    My husband should've taken heed. He went through hell after that with his own child he shared with her. It's so sad that when women do this, they never face any criminal sanctions.

      @James Sonatore I agree, my husband won custody but she kept harassing us. Eventually, she turned my stepson against us because she couldn't live without child support. She took him during a summer visit and refused to send him home. The amount of money I watched my husband spend on litigation just to be with his son was insane. I'm so thankful he's turning 18. Now she's trying to force him to go to college, and she claims she is going to take a new support order in FL until he's 21. He's been telling my husband how sorry he is for everything.

    I had custody of my two older daughters and never received a dime of child support. I had an order for the mother to pay. When I went to support enforcement. I was told by the case worker that support enforcement was there to collect money from the fathers, not from the mothers. This was over 20 years ago.
    Now, when I got custody of my son who has a different mother, I once again went to support enforcement. The case worker again basically tried to put every obstacle in my way until I contacted the head person in the state of Washington. I had recorded the conversation with the case worker. She first tried to say I was combative and argumentative, that I had used foul language and that's why she hung up on me. She didn't know I had recorded the conversation. When I played the recording, it showed she was the combative one, she was the one that used foul language, she was the one that was trying to make me jump through all these costly hoops to get her to do her job. Not only did I immediately start getting child support but the case worker was fired. How do I know? She called me from a private line cussing me out because she got fired.
    People really have no idea what men go through. Now, when a man is being garnished and he has custody, he must come up with a 5 to 10k retainer before any lawyer will even talk to him. On top of that, the minute he tries to get the support order changed, most women will fight to take custody back. Those reasons are why most men just let sleeping dogs lie. Most men are just happy to have their children and that's more important then stopping the child support payments.

    My husband went through this with his son when he was a minor. The mom was getting child support of $300 _a week_ for him & she was getting food stamps & Medicaid from the state. She was double dipping. He went to do his taxes 1 year & was supposed to get back $15k & they took it all because of her getting food stamps! She didn't notify her worker that the child support payments increased from $60 a week to $300 for the last 2 years so they put the bill on him for it. He was beyond pissed. He ended up taking her to court & pressing charges against her for fraud.
    My step son is 32 now & literally squatting at a home with illegal power & his gf who's with him is supposedly 5+ months pregnant! She already has 4 kids & doesn't have custody of any of them.. his mom only speaks to him when she needs something. When he was 19 she wanted him to come cut her grass. We drove him down there & as soon as he was done, she told him to call us for his ride back home! He'll date anyone who shows him an ounce of attention because he never got it from her!

    My brother took her to court for an increase. She paid it and never spoke to her daughter again.

    The problem here is when he had possession of the kids permanently he should have take the mom back to court for custody. He messed up by not going back for custody. So mom been living off him without having to any mother duties she been living high on the hog.

    I have a similar story, my children were 5 and 7 when the Mom and I divorced, I got them back when they were 6 and 8...and I had to pay child support to the mother until they both reached 18
    They are now 28 and 30 but they lived with me in my house and the mother collected child support, the courts would not stop it, I brought school records, mortgage papers to prove that I was in the home, medical records, etc. and they still would not stop it, the judge didn't care what I showed or what I had
    Glad that I'm done with that, I have a much better life now

    When my siblings and I were taken into foster care, my biological mom would still use our wic and other state benefits, take out loans in our name using our social and use our birth certificates to use to smuggle people through the border. Shes still the worst person I’ve ever known.

    This story hits close to home. My son just turned 18 last year but I had to fight for 5 years to get child support even though I had primary custody and she lived in another state 8 hours away. Her excuse was that she was re married and kept having more kids and said I am a stay at home mom now and can't afford child support. Let a man go to child support court and say I can't pay child support for the same reason. You would be laughed out of the courtroom and be called a irresponsible parent bringing more kids into the world without supporting the ones you already have. I asked for back support because it took 5 years to finally get support and the judge asked me how much I made like that should have anything to do with getting back child support. I was only making $60k per year and the judge told me I made enough to not need back child support. The audacity.

      When I took my ex back to court for back support, the judge told me that I made too much being a petroleum engineer and that I didn’t need CS.
      I then got smart and took her to civil court and got the judgment I was seeking and she still hasn't paid up.

    The reason the system does not care if the mother has custody is because the state gets a percentage from the child support as a kickback. They do not make any money if the fathers are not paying into system. *It doesn't matter who has custody as long as money is being exchanged and the state is getting their cut.* If you have not filed to change it when you have custody the state has no problem collecting for the duration of the child's adolescence and teenage years.

    I was awarded sole custody of my daughter when she was 17 years old. Trust me, this is a big deal in New York State since child support goes to age 21 or higher if the child is in college. The very day that I was awarded custody, I petition the court to have child support terminated. I was able to get a date three weeks later, I made sure my job did not take any more money out of my paycheck since I had a court document stating that I had custody. The mistake many fathers make is not petitioning the court to have a terminated when it’s over. Some assume it will stop automatically but it just doesn’t.

      NY State hit me the very same way. I had joint custody of my son until he was 13, then he moved to MD with me until he finished college (which I payed for).
      Initially I filled all of the appropriate documents to terminate/modify the support order, but the State/Onondaga county denied all attempts change the order.
      After dealing with child support enforcement for almost 20 years I filled a suite against the State and Onondaga County and was awarded a six figure judgment.
      I understand that not everyone has the means to fight a corrupt system on their playing field, but at the very least that young man needs a better attorney!

    Here's a breath of fresh air. When I was a kid, something happened with the state (I don't know exactly what, I was little) that they raised child support for me and my brother. We were doing fine with what we got, but my mom was concerned that the increase would cause hardship for my dad's kids. So she raised hell with the state and told them to put the support rate back down to what it was, so ALL the kids could be adequately supported. She held the interest of all the children in her heart, not just her kids. I cannot describe the amount of love this woman has.

      Except the mother received money she didn’t deserve and so far isn’t paying the dad child support or returning all the money she got from him when she should not have been receiving anything. It’s absurd, there should be six monthly or at least annual adjustments on support paid due to changes in income and where the children are living so any changes that need to be made are done so asap not years later . That woman should be charged with fraud because she knew damn well she should not have been getting any money from the Dad .

    Things won't change until we hold women accountable SMH been through this as a child. God bless my late mother but I'm still healing from remembering my mother manipulating us to ask my dad for more money acting like we didn't get enough just to find out every time my mom pushed for child support increase it was denied because my dad paid above and beyond and paid it even when we spend summers and holidays at my grandmother's and dad's. In the end, ladies you lose if you move like this because it will come back to bite you and your children may resent you for it 😢 please don't take the easy route because it will cost you much more in the end. And men, stand up and say something. You're letting them get away with it you're part of the problem. Stop being so nice. Literally an ahab and jezebel situation.     This happened to me. I was still paying support to my ex wife while my kids lived with me. The child support enforcement agency told me I had to get permission from my ex wife to stop the support. Talk about crazy.. SMH..

    I was in this exact situation and I took it to court, they stopped the child support to her and the lawyer for the state asked me how did I convince my daughters to come back home and state to the court that they preferred living with me? His next statement was, do you want us to get child support from her now? Thirsty AF, The system has issues to say the least!

This is a confirmation. Thank u. BTW, he is responsible for court costs because he was dutifully served to appear because he was in arrears. If they have a legal and valid reason for the summons in child support court you still have to pay the court cost as the defendant.

    I’m always baffled at how the guy, even when innocent, always starts off looking like the deadbeat enemy in CS court.
    Like the man comes into court feeling pressure 😬

      The biggest plus that a man can do in these cases is to wear a suit! Don't care if it's too big, small or wide. A suit shows that you mean business.

      Yeah I’m calling ducktales on that one bc I dressed up and I was treated like garbage even though she was the deadbeat and the abusive one. But I had a female judge and she sided with my ex.

    Good work PBL. Love to see a man finally get justice. My brother finally got his CS order reversed, and was paid back. His Daughter's mother owes him now, and they are not going after her.

    I'm not surprised that the woman in this case hasn't said anything about not having the children or not living in the state. I believe that the ex never showed up in court is because she believed that there was no way that the man would fight for himself. Also, she probably believed that the court would side with her because she is the "mother" and the courts are notorious for siding with the woman. Just because you pushed out two children doesn't make you a mother. This woman is going to have a rude awaking when she realizes that the money she counts on to fund her life is no longer flowing, she will go to court to fight for her children back and put the father back on child support or she will tell the father she wants to see her children (in her state) and not return them and take this man back to court for sole custody again and child support. This is sad all around.

      Luckily the judge awarded him custody. He said the underage child is to remain with him. Crazy thing, he will be 18 in a couple of days.

    Glad it worked out so good for him, but normally other parent shows and fights, so it gets much nastier. This is exactly why it's absolutely necessary to get orders in place for custody & support, even if you work it out together without a hearing. If both parents agree it's not a big expensive ordeal, put your agreement on paper and file it with the court. It's meant to protect both of you when someone inevitably changes their mind.

    I don’t understand why they aren’t questioning the mother as to what she did with all that money?!?! That was FOR THE CHILDREN! NOT HER, it’s appalling! She wasn’t held accountable for a thing! So unfair!

    Had my son form 13 until now, he is 26 never got a dime for those minor years, It's hard for those who do right by their kids.
