The mom has the right to due process like everyone else even though she has no case and texts of her plans are admissible as evidence and virtually will guarantee prison and terminated rights too. She'll probably get permanent restraining order against her to stay away from her kids when she gets out of prison, provided the inmates of general population in women's prison doesn't take care of her themselves. Female prisoners are worse about crimes against children than their male counterparts as most female inmates are in there for protecting their children against real or imagined threats and were overzealous in the eyes of the law or their children were involved in some way as to why they're in there in the first place.
